Jenkins appeared requesting a variance which would allow his sign to stand 8'2" above the sidewalk rather than the 9' required in section 17.66.300 4. of the Municipal Code. The projecting sign pre­ sently hangs from a bracket approximately 10" below the building over­ hang which allows a sidewalk clearance of only 8'2". Howard Stewart, manager of the "300 Building", spoke in favor of the variance request. Member Sager moved the variance be denied. Member Palmer seconded the motion. Upon roll call the motion passed by the following votes: Those voting "Yes" Members Herzog, Palmer, Sager, Sutter. Those voting "No" none. DURWARD - OFF-STREET PARKING VARIANCE - WEST ELKHORN AVENUE: Dr. James Durward appeared before the Board of Adjustment requesting the following variances with respect to his property located in Block 7, Town of Estes Park: 1. A variance allowing parking spaces to be varied in size to serve small and large cars and, therefore, achieving more spaces for parking. 2. A variance allowing amortization of payments over five years. 3. A variance to require only the net retail area be considered when determining the off-street parking requirements according to square footage of area. More specifically, restroom facil­ ities, storage areas, elevator and stairways be excluded. 4. A request that the Building Inspector use subsection 7 of 17.64.010 to measure the number of parking spaces rather than subsection 5. Dr. Durward then stated that he felt there was no reason to argue these points at this time since they had been asked for before and denied. Assistant Town Attorney Bill Babcock advised the Board that it must consider evidence presented for a variance request and determine if such evidence is sufficient to grant the variance. However, no evidence had been presented in support of this variance request and, therefore. Assistant Town Attorney Babcock recommended the Board deny the request. Member Sager moved the variance be denied. Member Palmer seconded the motion. Upon roll call the motion passed by the following votes: Those voting "Yes" Members Sager, Palmer, Herzog and Sutter.
