R?strT10Ied Commercial zone. which includes a Montgomery Wards store. °rDa?e Coo?S|1Bul?SnfiSi0n # RECORD OF PROCEEDINGS Board of Adjustment May 10, 1978 Page Two (2) Inspector, claimed that although certain retail uses are allowed in C-2, a general retail use such as a Montgomery Wards is not. A letter was received from Town Attorney Hartwell dated April 25, 1978 supporting the Building Inspector's interpretation. Member Sager moved that the Board of Adjustment finds that the Building Inspector's interpretation of Section 17.36.020 regarding permitted uses is correct and that it does exclude general retail stores. Member Thomas seconded the motion. The motion passed by the following votes: Those voting "Yes" Members Sager, Thomas, Rumley. Those voting "No" Member Lamson. WEST - LOT SIZE VARIANCE FOR TWO-FAMILY DWELLING ON LOT 18, TWIN VIEW ADD. Frank West submitted a request to construct a two family dwelling on Lot 18, Twin View Addition which is 11,723 sq. ft. in size rather than the 13,500 sq. ft. required according to Section 17.68.060 of the Municipal Code. Mr. West stated he purchased the property with the understanding that a duplex would be permitted. Member Sager moved that the Board of Adjustment finds that there are not special conditions unique to this property and that an undue hardship would not result and, therefore, the variance request is denied. Member Thomas seconded the motion. The motion passed by the following votes: Those voting "Yes" Members Sager, Thomas, Rumley. Those voting "No" Member Lamson. GERARD - SIGN CODE VARIANCE - 180 SOUTH SAINT VRAIN AVENUE: Frances Gerard dba Gerard's Bakery submitted a petition requesting to hang a suspended sign from the Village Square Building overhang which would allow an 8'9" clearance from the sidewalk rather than the 9' required in Section 17.66.300 5 of the Municipal Code. Member Sager moved that the Board of Adjustment finds that the sign variance request does not meet the conditions set forth in Section 17.66.340 of the Municipal Code and, therefore, the request is denied. Member Lamson seconded the motion. Upon roll call the motion passed by the following votes: Those voting "Yes" Members Sager, Lamson, Rumley. Those voting "No" Member Thomas.
