HACKBART & KRIZAN/SWICKARD - INTERPRETATION OF PROPOSED BUSINESS:
A petition was submitted by Dale Hackbart and Monty Krizan requesting
that the proposed business of "Monty's Python Parlor" to be located at
351 Moraine Avenue (Jolly Drover Building) not be classified as an
amusement. Building Inspector Fairchild interpreted the business as
an amusement which requires special review procedure in a C-2 Restricted
Commercial zoning district. Legal opinions (verbal) from the Town
Attorney and Assistant Town Attorney confirmed the Building Inspector's
interpretation. The petitioners claimed that the ecological, scientific,
and educational value of the reptile display made it a museum rather than
an amusement. Member Ed Palmer moved the variance request be denied and,
therefore, classifying "Monty's Python Parlor" as an amusement. Member
Herzog seconded the motion. Upon roll call the motion passed by the fol
lowing votes: Those voting "Yes" Members Palmer, Herzog, Wagner, Sutter,
Those voting "No" none.
There being no further business, the meeting adjourned.
