Building Inspector Van Horn did, on November 18, 1971, rule that the conduct of a home occupation (physical conditioning classes) at the above location is a violation of Chapter 12 of the Municipal Code of the Town of Estes Park. Mrs. Whiteman requested a variance from the Code requirements and asked that the home occupation (physical conditioning classes) be allowed. Board of Adjustment Member Palmer moved that the request for variance be denied. Member Brownfield seconded the motion. Building Inspector Van Horn did, on December 3, 1971, and again on December 6, 1971, refuse a building permit for an office (U. S. Forest Service) on the above described property, ruling the occupancy would be a violation of Chapter 12 of the Municipal Code of the Town of Estes Park. Mr. Jenkins submitted a request for variance, a copy of which is attached to and made a part of these proceedings. Both Mr. Jenkins and Mr. Myers spoke in favor of the request for a variance. Board of Adjustment Member Brownfield moved the request for variance be granted and that the following condition be attached to the variance; This variance is for the specific use of the U. S. Forest Service Admin­ istrative Office as per the plans on file with the Building Inspection Office of the Town of Estes Park and upon the termination of this specific use by the U. S. Forest Service the Code requirements will apply and the office will revert to a use permitted by the Town of Estes Park. Board Member Steele seconded the motion. Petitioners state: 1. The National Forest Service is a desirable tenant and that the Service is and has been for many years an inte­ gral and important factor in the community. 2. The National Forest Service can be relied upon to be a model tenant and neighbor and to cause no Inconvenience or disturbances to those persons occupying surrounding land. -1- 3. The Variance will have no deleterious effect on the public health, safety, morals, order, convenience, happiness, prosperity and general welfare of the community; nor will such occupancy depreciate the value of property in the Town of Estes Park. Furthermore, such tenancy will not congest the streets, result in undue concentration of population, or have any appreciable effect on transportation, water, sewage, parks, schools or other public requirements; nor will it effect safety from fire, panic or other dangers. 4. Adequate parking facilities are available on the premises and will not interfere with the normal flow of traffic in the surrounding areas. The National Park Service is anxious to commence occu­ pancy of said premises.
