November 13, 1969

Dr. James A. Durward, owner of Lots 25, 26, 27 and the west 19.5 feet
of Lot 24, Block 3, Town of Estes Park, appeared before the Board and
requested a variance to the zoning ordinance.
The variance requested is in regard to Section 12.10-2 of the Municipal
Code that states "A set back of eight (8) feet shall be required from
all river banks and river walls, etc.".
Member Dannels recommended Dr. Durward be granted a variance allowing a
building to be built with a six (6) foot set back from the existing river
wall and that an additional variance be granted permitting this building
to set back three (3) feet for two (2) diamond shaped windows; one forty-
eight (48) feet from Elkhorn Avenue in a northerly direction and one (1)
seventy-three (73) feet from Elkhorn Avenue in a northerly direction.
Member Grove seconded the motion. Upon roll call the motion passed by
the following votes. Those voting "Yes" Members Dannels, Steele, Grove
and Sutter. Those voting "No" none.
There being no further business, the meeting adjourned,
