Home My WebLink AboutORDINANCE 11-99CCINITIATEDORDINANCE#11-99WHEREAS,itisthedesireofthecitizensofEstesParktoprohibittheexhibitionofanimals,becausethecagingand/ortetheringforexhibitionofanimalsisnotdesirableinitself,nordoesit,intheopinionofthecitizens,reflecttheuniquecharacterornatureoftheEstesParkcommunity.Theexhibitionofanimalsandtheprocurementofsuchforexhibitionirrevocablydiminishescommunitycareandrespectforsuchanimalsandimposesonthemanunnaturalandcruelexistence.ThenaturalhabitatthatanimalsexperienceintheRockyMountainNationalPark,whichiscontiguoustotheTownofEstesParkandistheprimarysymboloftheTownforallvisitorstotheEstesParkarea,istheimagethatthecitizenswanttopreserve;andWHEREAS,itistheintentofthisordinancetoprohibittheexhibitionofanimals.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADO:1.ThattheEstesParkMunicipalCodebeamendedtoaddthefollowingsection:Section7.06.040ExhibitingAnimalsProhibited(a)Itisunlawfulforanypersontoexhibitananimalinacage,kennel,box,cell,showcase,orotherenclosureortoexhibitananimalbytetheringtheanimalortyingorattachingtheanimaltoanyobject.(b)Itisaspecificdefensetoachargeofviolatingthissectionthat:(1)Theanimalwasexhibitedtemporarilyforaperiodnotexceeding120hoursforeducationalpurposesbytheParkSchoolDistrictortheRockyMountainNationalPark;(2)Theanimalisdomestic,asdeterminedbytheColoradoWildlifeandAgriculturalCommissions,andwasexhibitedintheordinarycourseofbusinessbyapetstore,dogkennel,farm,ranch,fair,livery,stablesorrodeo;(3)Theanimalwasexhibitedforpurposesofadoptionbyanon-profithumanesociety;oranon-profitPetAssociationofEstesPark,Inc.whichisexemptfrom 00FederalincometaxesunderSection501(c)(3)oftheunitedStatesInternalRevenueCode;or(4)Theanimaliswildlife,asdefinedbytheColoradoRevisedStatutes,andwasbeingheldforrehabilitationormedicaltreatmentbyapersonlicensedbytheStateofColoradotoprovidesuchrehabilitationormedicaltreatment.TOWNOFESTESPARK,nOCORADOAflEST:By:__________________________j9wrftlerkNOTE:TheBoardofTrusteesdidnotapprovethisInitiatedOrdinance8124199.ItwasreferredtotheregisteredelectorsoftheTownofEstesParkfortheLarimerCountyCoordinatedElectionscheduledNovember2,1999.TheregisteredelectorsofEstesParkapprovedthisInitiatedOrdinancewith1,181yesvotesand1,049novotes.
