0ORDINANCENO.13-99WHEREAS,afterconsiderablestudy,anextensiveCitizenreviewprocess,andpublichearings,theEstesValleyDevelopmentCodeandtheOfficialZoningMapfortheEstesValleyhavebeendevelopedandproposedforadoption;andWHEREAS,theCodeandMapareintendedtoimplementthetermsoftheEstesValleyComprehensivePlan,andtoreplaceandamendexistinglanduseregulationsintheEstesValley,includingregulationsforzoningsubdivisionanddevelopmentofland;andWHEREAS,theEstesValleyPlanningCommission,afterpublichearinganddiscussion,byresolutionrecommendedthattheCodeandMapbeadoptedbytheBoardofTrusteeswithcertainamendments,andWHEREAS,theCodeandMapwereconsideredbytheBoardofCountyCommissionersofLarimerCountyandtheBoardofTrusteesoftheTownofEstesParkatajointpublichearingheldonNovember3,1999,attheBoardRoomoftheEstesParkMunicipalBuilding170MacGregorAvenue,EstesPark,Colorado;andWHEREAS,noticeofpublichearingwasdulyadvertisedinlocalnewspapersofgeneralcirculationasrequiredbylaw;andWHEREAS,theBoardofTrusteeshasconsideredtheproposedCodeandMapandtheamendmentstotheCodeandMapsuggestedbycitizens,theCountyandTownPlanningStaffs,andtheEstesValleyPlanningCommission;andWHEREAS,theBoardofTrusteesfindsthattheCodeisauthorizedbytheColoradoConstitutionandthelawsoftheStateofColoradoasspecifiedintheCode,andpreserves,protectsandimprovesthehealth,safetyandgeneralwelfareofresidentsoftheTownofEstesPark.BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPAR1COLORADO.Section1:TheBoardherebyadoptsforallpropertylocatedwithintheTownofEstesParktheEstesValleyDevelopmentCodeasthesamehasbeenrecommendedtotheBoardofTrusteesbytheEstesValleyPlanningCommissionincludingthefollowingamendmentstotheCode:A.ThosechangesrecommendedbythePlanningCommissioninthedraftPlanningCommissionminutesattachedheretoasExhibitAandincorporatedhereinbyreference.B.Section7.6E.1(a)ismodifiedbytheadditionofthefollowingsubsection(3).
