The minutes of the meeting held on August 17,1971 were read and approved
as read.
PLANNED UNIT DEVELOPMENT:
Mr.Trafton Bean,Vice President of Harman,O’Donnell &Henninger Assoc..,
Inc.,Planning Consultants,appeared before the Commission for the pur
pose of discussing the theory of Planned Unit Development and also to
review the proposed amendments to Chapter 12 regarding the methods of
administering Planned Unit Developments.
Mr.Bean reviewed,in detail,the proposed amendments to Chapter 12 and
informed the Commission that he would be available to work with the Town
Attorney in answering questions and providing a final draft of the nec
essary amending ordinance.
PRELIMINARY HAT-PINEWOOD ACRES RESUBDIVISION:
Mr.Paul Van Horn appeared before the Commission representing Mr.M.R.
Thompson,owner of the proposed Pinewood Acres Resubdivision.Corres
pondence from Lowell Soester,Assistant Planner from Larimer County and
Mr.Walt Colwell,Assistant Town Engineer for Planning,was reviewed by
the Commission and made a part of these proceedings.
Mr.Van Horn stated that Phillips,Carter,Reister and Associates had not
required contour lines on the preliminary plat;that the State Highway
Department had approved the intersection of Pinewood Drive on to South
Saint Vram Avenue;percolation tests have been submitted and accepted
by the Larimer County Health Department;Mr.Thompson has agreed to
extend the water line to State Highway 7 with a valve installed at the
end of the line and the front property line of Lot 6 will be changed to
meet standards.
Mr.Van Horn submitted,on behalf of Mr.Thompson,a petition requesting
exceptionsto Chapter 21 as provided for in Section 21.4-1 of the Municipal
Code.These exceptions are attached to and made a part of these proceed
ings.The above exceptionsinclude allowing lots of a smaller size than
are required by the code and allowing an intersecting street grade in
excess of code requirements.
In accordance with Section 21.4-1 of the Municipal Code,Member Brownfield
moved that the petition for exceptions as filed be recommended to the
Board of Trustees for their approval and that the following findings are
made:

(a)That there are special circumstances or conditions affecting
said property.
(b)That the exception is necessary for the preservation and
enjoyment of a substantial property right of the petitioner.
(c)That the granting of the exception will not be materially
detrimental to the public welfare or injurious to other
property in the neighborhood in which the property of the
petitioner is situated or in conflict with the purposes and
and objectives of this chapter.
Member Hix seconded the motion.Upon roll call the motion unanimously
carried.
In accordance with Section 21.3-8 of the Municipal Code,Member Brownfield
moved that conditional approval for the preliminary plat be granted.The
conditions for approval are as follows:
1.The water line shall be installed to the State Highway 7 right-
of-way line.
2.The front property line of Lot 6 shall meet the requirements
of the Municipal Code.
Member Miles seconded the motion.Upon roll call the motion unanimously
carried.
PUBLIC PARTICIPATION AT COMMISSION MEETINGS:
The Commission discussed the participation of various members of the
public at Planning Commission meetings.The Planning Commission unani
mously expressed the opinion that they would like to have active public
participation at their meetings,and that the participation should be
on the agenda.Chairman Prosser indicated he would prepare a press
release urging the above.

Dear Dale:
The plat referred to us does not appear to meet all require
ments of the now revised Chapter 21.Contour lines required have
not been shown.
Drainage easements have not been shown for the two culverts
located on Pinewood Drive.Run—off from these culverts as shown
would inundate portions of Lots 6 and 8.
sight distance problem appears to exist at the proposed
location of pinewood Drive and its intersection with South St.Vram
Highway.It would be difficult to see southbound traffic on St.
Vram from the intersection.The State Highway Departments comments
concerning this intersection would be noteworthy.
The sight distance problem could be corrected by redesigning
pinewood Drive as a cul—de—sac which would terminate at the west
edge of Lots 5 and 8.2ccess to South St.Vram would thereby be
afforded only at the intersection now in existence.
If septic tanks are to be used for the subdivision the developer
must submit percolation tests and other soil data required by the
County Health Department along with appropriate State Water Pollution
Control application forms.

Re:Preliminary Plat Thompson’s Pinewood Acres.
Subsequent examination shows the following items to be in conflict with
the Town requirements:
1.Six of the nine lots are smaller than one acre.
2.Pinewood Drive meets Pinewood Lane with a seven percent grade.
(21.5-1(9)PCR recommends variance.
3.Water main should be extended to State Highway No.7 right-of-
way line with valve installed on the end of the line.
4.Lot 6 shows a fifty foot front dimension.Code required a
minimum of seventy-five feet.(21.5—2)

TO:THE ESTES PARK PLANNING CO?I$$ION
I,Naurice Thompson,owner and developer of Thompson Pinewood
Acres Re-Subdivision do hereby petition the Estes Park Planning
Commission for an exception to 21.5-2 of the Ordinance No.18-71
pertaining to subdivisions that specifies a one-acre minimum lot
size for lots not served by a public treatment sewer line.
Several of the lots shown on the above mentioned plat are
slightly under the one—acre size,however,the overall subdivision
area exceeds the nine-acre requirement for nine individual lots.
The area was divided as shown on the plat to better preserve the
natural beauty of the property and the individual building sites.
The physical characteristics of the land were also considered in
making the subdivision.
Any conflict with the requirements for Section 21.5-1 as
to intersecting street grades are asked to be waived as the single
street abutting all lots has an entrance or exit to the existing
city street and state highway and all travel could be on a down
hill grade from Pinewood Drive to the South St.Vram Highway.
