Petrocine,Robert F.Wagner,Chas.Hix,Harry Miles, Marvin L.Steele Attending:Chairman Prosser;Members Tregent,Wagner,Hix,Miles Also Attending:Secretary Dale G.Hill,Town Planner and Engineer Bill Van Horn Absent:N.T.Petrocine,Marvin L.Steele The minutes of the meeting held on April 18,1972,were read and approved as read. COUNTRY CLUB MANOR ADDITION REZONING: The Estes Park Planning Commission,as directed by the Board of Trustees of the Town of Estes Park,proceeded to conduct a public hearing regard ing the rezoning of the following described land in Country Club Manor Addition:Out Lot No.1;Lots 1 through 6,inclusive Block 11;all Lots in Block 1 through 5 inclusive,from the existing C-l Commercial District to R-2 Multi-Family District.Those speaking in favor of the rezoning were Mrs.Marge Wolpert and Mr.Gene Fuller.Mrs.Marge Wolpert submitted a petition in favor of the rezoning signed by sixty seven persons.Those speaking in opposition to the rezoning were Mr.Stanley H.Roberson,representing Mr.James H.Mezen,Mr.Dale Whittaker,re presenting Mr.Dietz,Mr.James H.Mezen and Mr.Joel Bacon.Those speaking in rebuttal and in favor of the rezoning were Mrs.Dorothy Schanhals and Mrs.Mabel E.Schiatter.The Secretary of the Planning Commission read a letter from the Town Attorney,Ernest C.Hartwell, dated March 18,1969.This letter contained Mr.Hartwell’s legal opinion that the Town of Estes Park did have the authority to rezone the prop erty.Chairman Prosser asked several times for a motion regarding this rezoning and failing to receive one announced that the public hearing would be continued to the next regular meeting of the Planning Commission., HERSHMAN PETITION TO DIVIDE LOT 4,WHITE MEADOW VIEW PLACE ADDITION: Mr.Don Hershman spoke in favor of the division of Lot 4,White Meadow View Place Addition and emphasized the fact that this lot is divided into two parts by a public road.Town Planner Van Horn reported to the Planning Commission that he had no objection to the division of this lot. Member Wagner moved that the petition to divide the above mentioned lot be approved and that the Estes Park Planning Commission finds: (a)That there are special circumstances or conditions affecting said property. (b)That the exception is necessary for the preservation and en joyment of a substantial property right of the petitioner. (c)That the granting of the exception will not be materially detrimental to the public welfare or injurious to other property in the neighborhood in which the property of the petitioner is situated or in conflict with the purposes and objectives of this chapter. 00 RECORD OF PROCEEDINGS Planning Commission Meeting May 16,1972 Page twO and that the Estes Park Planning Commission also attaches a condition, as provided for in Section 21.4-2 of the Municipal Code.This condition is that any improvement included on this lot,identified as parcel “A”, must be connected to the sanitary sewer operated by the Estes Park Sanitation District.Member Hix seconded the motion.Upon roll call the motion unanimously carried. HESS PETITION TO DIVIDE lOT 9,BUENNA VISTA TERRACES: A petition,dated April 11,1972,from Mr.and Mrs.L.M.Hess,owners of Lot 9,Buenna Vista Terraces Addition,was presented to the Planning Commission.This petition requested permission to divide the above mentioned lot as per the attached plat.Member Tregent moved that the petition be denied.Member Hix seconded the motion.Upon roll call the motion unanimously carried. REILAND PETITION TO DIVIDE LOT 3,GRAND ESTATES: A petition,dated April 3,1972,from Mr.Ronald J.Reiland,owner of Lot 3,Grand Estates Subdivision,was read to the Estes Park Planning Commission.This petition was for permission to divide the above men tioned lot into two parcels,as per the attached plat.Member Tregent moved the request be denied.Member Wagner seconded the motion.Upon roll call the motion unanimously carried. HOSPITAL ZONING: The Planning Commission instructed the Secretary to work with the Town Attorney in preparing some amendments to the Municipal Code that would eliminate the need for C-l zoning for a hospital.
