Petrocine,Robert E.Wagner,Chas.lix,Harry Miles,Marvin L.Steele Attending:Chairman Glenn Prosser,N.T.Petrocine,Robert E.Wagner,Chas.Hix,Harry Miles Also Attending:Secretary Dale G.Hill,Town Planner and Engineer Bill Van Horn Absent:Harry B.Tregent,Marvin I.Steele The minutes of the meeting held on March 21,1972,were read and approved as read. PLANNING CONMISSION OFFICERS: The following officers were elected by acclamation: Chairman -Glenn Prosser Vice Chairman -Harry Miles Secretary -Dale G.Hill These officers will hold office until April,1974. COUNTRY CLUB MANOR REZONING: A petition signed by more than thirty owners of property in the Country Club Manor Addition was presented to the Commission.This petition requeststhe following lands in Country Club Manor Addition by rezoned from the existing C-i Commercial to R—2 Multiple—Family Residence District: Out Lot No.1;Lots 1 through 6,inclusive Block 11;all Lots in Block 1 through 5 inclusive. A legal opinion from the Town Attorney recommends the Board of Trustees of the Town of Estes Park make the decision as to whether or not the above described property should be considered for rezoning.Member Hix moved that the Estes Park Planning Commission recommend to the Board of Trustees of the Town of Estes Park that the rezoning of this property be considered.Member Miles seconded the motion.The motion unanimously carried. EAST RIVERSIDE REZONING: The Planning Commission proceeded to conduct a public hearing on the proposed rezoning of Lots 30,31 and the Northerly 39 feet of Lot 29, Riverside Addition to the Town of Estes Park. It is proposed this area be rezoned from the existing R-2 Multiple- Family District to C-l Commercial District.The following spoke in favor of the rezoning:Mr.Paul Firnhaber and Mr.Dwayne Herman. There was no one present to speak in opposition to the rezoning.Town Planner Van Horn expressed his opinion as being in favor of the rezoning. Chairman Prosser declared the hearing closed.Member Wagner moved the above rezoning request be recommended favorably,and that inclusion of this area in Fire Zone One be considered,to the Board of Trustees of the Town of Estes Park.Member/seconded the motion.The motion unani mously carried.flix RECORD OF PROCEEDINGS Planning Commission Meeting April 18,1972 Page two THOMPSON’S PINEW000 ACRES REZONING: The Planning Commission proceeded to conduct a public hearing regard ing the rezoning of Thompson’s Pinewood Acres Resubdivision from the existing R-l Residence District to R Residence District.There were no persons present in favor of or in opposition to the rezoning.Town Planner Van Horn spoke in favor of the rezoning.Chairman Prosser de clared the public hearing closed.Member Petrocine moved the rezoning, as requested,be recommended for approval to the Board of Trustees of the Town of Estes Park.Member Miles seconded the motoion.The motion unanimously carried. PETITION FOR EXCEPTION-JOHN E.&JOAN E.SMITH-PROSPECT TERRACES: An amended petition for exception to Section 21 of the Municipal Code was submitted on behalf of John E.and Joan E.Smith,owners of Lots 24,25,26,27 and 2$of Country Club Manor Addition to the Town of Estes Park.This petition,with the attached plat,is made a part of these proceedings and is attached hereto.Member Wagner moved the Amended Petition for Exception to Section 21 of the Municipal Code,as requested,be recommended for approval to the Board of Trustees of the Town of Estes Park.Member Hix seconded the motion.The motion unani mously carried. CARRIAGE HILLS NEW PLANS: Mr.Bob Britzman,Planner for Nelson,Haley,Patterson and Quirk,appeared before the Planning Commission and spoke for the Carriage Hills Developers. Mr.Britzman presented two plats.The first contained 139 lots,10,000 square feet each,on property abutting the Town of Estes Park on the south. The second plat contained 41 lots,½acre each,lying south of Estes Park abutting Highway 7.Dwight Whitney,Larimer County Planner,submitted a recommendation that the land be annexed to the Town and also submitted a question as to whether or not a private sewer system would qualify under county regulations.Town Planner Van Horn expressed an opinion that the density was much toogreat in relation to the surrounding area.Mr. Elmo Peterson,engineer for Nelson,Haley,Patterson and Quirk,explained their plans for the sewage disposal system.Mr.Britzman then submitted an alternate plan for the development of the area abutting the Town of Estes Park that shows8O lots of ½acre each.The Planning Commission then reviewed an old Planned Unit Development plat that had been submitted to the county prior to this date.This being an informal presentation, there were no formal recommendations made by the Planning Commission. MASTER PLAN -ESTES PARK: Mr.Dwight Whitney,Larimer County Planning Director,Miss Jan Schrader, Assistant Planner and Mr.Bob Lee,consultant with the Allen Voorhees Company,presented some of the preliminary planning documents for the Estes Park area.After considerable discussion it was aiggested that the Planning Commission meet in study session for the purpose of review ing these documents in detail. There being no further business,the meeting adjourned. GlennProsser,Chairman Dale G.Hill,Secretary 00 PLANNING COMMISSION TOWN OF ESTES PARK ESTES PARK,COLORADO AMENDED PETITION FOR EXCEPTION UNDER ORDINANCES 21.4-7 and 21.4-2 Gentlemen: Petitioners for their amended petition respectively request your board for an exception as provided for in Ordinances #21.4-1 and #21.4-2. Petitioners report that they are the owners of Lots 24,25,26,27 and 28 of Country Club Manor Addition to the Town of Estes Park,Larimer County, Colorado.That Petitioners desire to divide each of the foregoing lots into two equaLparcels as provided for in said ordinances,with the dividing line to run north and south on the center line of each lot,excepting Lot 28 therefrom., The respective lots,when divided,will be destgnated in the deed of conveyance as the east one-half or the west one-half of said designated lot sub ject to easements for ingress and egress and for common use area (court yard) and utility easements as set forth in the map thereof recorded October 26,1971 at 10:46 a.m.in Book 1480 Page 802 of the Larimer County Records and further subject to “PROSPECT TERRACES VACATION HOMES PROTECTIVE COVENANTS”as recorded September 20,1971 at 8:32 a.m.in Book 1346 Page 808 Larimer County Records. As a further consideration of the granting of such exception for each lot the owners agree that the existing utilities now located upon said lot shall continue to be privately owned and maintained until such time as the Town of Estes Park may desire to accept said utilities and in the event of the installa tion of any further utilities,including,but not limited to,sewers and water lines,said utilities will be constructed in the easements as designated on the map recorded in Book 1480 Page 802 as heretofore mentioned. For purposes of clarity the proposed subdivisions are designated as units with the easterly one-half bearing the lot number and designated “A”and the westerly one-half will bear the lot number and be designated “B”. Lot 28 will not be divided but as set forth in the map hereinabove re ferred to,the respective lot owners will be given an easement for the use of said lot as designated on said map and subject to the protective covenants here inabove referred to. It is requested that the foregoing individual exception be approved by your board and that recommendation be made to Town Trustees of Estes Park to approve of said exceptions,individually or collectively,subject to the terms and conditions hereinabove specified by proper resolution.The map and the protective covenants referred to in this petition are incorporated herein by reference and made a part of this petition.
