RECORD OF PROCEEDINGS
Planning Commission Meeting
February 27,1973

This meeting was reconvened after being adjourned on February 20,1973.
Chairman Glenn Prosser presiding.
The minutes of the meeting held on January 16,1973,were read and
approved.
RESIDENTIAL USE IN C-l,C-2 AND I-i ZONES:
Chairman Prosser proceeded to conduct a public hearing as advertised
regarding the proposed ordinance that will allow residential use in C-i,
C-2 and 1-1 zones by special review.Mr.Jim Swickard spoke in favor
of the ordinance and Mr.John Ramey spoke in opposition to the ordinance.
Chairman Prosser declared the hearing closed.
Member lix moved the Planning Commission recommend to the Board of
Trustees of the Town of Estes Park that the ordinance be passed.There
was no second to the motion.Chairman Prosser declared the motion lost.
Member Hix moved the ordinance be recommended to the Board of Trustees
for approval.Member Wagner seconded the motion.Upon roll call the
motion passed unanimously.
DIVISION OF LOTS 48 &49,GRAND ESTATES:
A petition,signed by Mr.and Mrs.Klingel,owners of Lots 48 and 49,
Grand Estates Subdivision,requesting an exception,as provided for in
Section 16.40.010 of the Municipal Code,was presented to the Planning
Commission.
This is a request to change the location of the property line divid
ing these two lots as per the plat submitted.
Town Planner Van Horn recommends approval of this exception.
Mamber Wagner moved the Planning Commission finds:
1.That there are special circumstances or conditions affecting
the property;
2.That the exception is necessary for the preservation and the
enjoyment of a substantial property right of the petitioner;
3.That the granting of the exception will not be materially
detrimental to the public welfare or injurious to other
property in the neighborhood in which the property of the
petitioner is situated or in conflict with the purposes
and objectives of this title.
and that the Planning Commission recommends to the Board of Trustees of
the Town of Estes Park that the requested exception be approved and
granted.Member Steele seconded the motion.Upon roll call the motion
passed unanimously.

SPECIAL REVIEW NO.1:
Mr.Ray Moran,owner of Lot 2,DeVille Subdivision,submitted an
application for special review,request no.1.This application is
to allow an outdoor miniature golf course and batting cage.Town
Planner Van Horn reviewed the information submitted with the request.
Those speaking in favor of the request were:Tom Brown,Surveyor;
James Hillhouse,Lord and Associates and Mr.Joel Bacon,Realtor.
Those speaking in opposition to the request were:Henry McKim and a
letter from Mr.C.J.Leland,opposing the request as presented.Mr.
Brown and Mr.Hillhouse reviewed the lighting and sign designs.Mr.
Brown stated that the miniature golf course and batting range will have
no loudspeakers on the property.Member Petrocine moved that the request
be recommended for approval as submitted on the above described plats and
application.Member Wagner seconded the motion.Upon roll call the
motion passed unanimously.
PRELIMINARY FLAT -PARK VIEW SUBDIVISION:
Mr.Newton,owner of the proposed Park View Subdivision,presented an
amended preliminary plat.Mr.Newton explained to the Planning Commission
that he could meet all of the requests of the Planning Commission except
that of petitioning for the R-Residential Zoning District.The setback
requirements in the R-Residential Zoning District are not acceptable to
Mr.Newton but Mr.Newton did agree that his convenants and restrictions
did include the limitations that apply to permitted uses in the R
Residential Zone.
Member Wagner moved that the preliminary plat,as submitted by Mr.
Newton,be given conditional approval.This conditional approval is
subject to the conditions contained in the Town Planner’s letter,dated
February 20,1973,except for the agreement for rezoning.The limita
tions that apply to permitted uses in the R-Residential should be in
cluded in the covenants and that the petition for exception,dated
January 27,1973,be approved and the Planning Commission finds the
following:
1.That there are special circumstances or conditions affecting
the property;
2.That the exception is necessary for the preservation and the
enjoyment of a substantial property right of the petitioner;
3.That the granting of the exception will not be materially
detrimental to the public welfare or injurious to other
property in the neighborhood in which the property of the
petitioner is situated or in conflict with the purposes
and objectives of this title.
Member Petrocine seconded the motion.Upon roll call the motion passed
unanimously.
PROPOSED PARKING REGULATIONS:
Chairman Prosser proceeded to conduct a public hearing on the proposed
ordinance amending Chapter 17.64 of the Municipal Code relating to
off-street parking.Town Planner Van Horn reviewed both the present
and the proposed off-street parking ordinance.
Those speaking in opposition to the proposed ordinance were:James
Durward(submitted a petition),Greig Steiner,Michael Marden,Wendall
Harding,John Ramey,Charles Herzog and Henry McKim.

Town Planner Van Horn spoke in favor of the proposed ordinance.Chair
man Prosser declared the hearing closed.
Member Hix moved that the Planning Commission recommend that the proposed
ordinance not be passed.Member Wagner seconded the motion and then
moved to amend the motion,recommending further study of the off—street
parking ordinance.Member Hix seconded the amended motion.Upon roll
call the motion passed by the following votes.Those voting “Yes”
Members Petrocine,Prosser,Steele,Marsh and Wagner.Those voting “No”
Member Hix.
Member Hix withdrew his original motion.Member Wagner agreed and with
drew his second.Chairman Prosser ruled that the motion and the amended
motion are not adopted.Member lix moved that the ordinance not be
approved.Chairman Prosser ruled this motion lost for a lack of a
second.
Member Wagner moved that the ordinance be tabled and that the Chairman
of the Planning Commission call a study session immediately.Member
Petrocine seconded the motion.Upon roll call the motion passed unanimously.
REZONING A PORTION OF BLOCK 2,WEST PARK CENTER:
Member Hix moved that a public hearing be held at the next regular
meeting of the Planning Commission on the proposed rezoning of a portion
of Block 2,West Park Center Resubdivision from the existing R-2 Multi
Family Residence District to C—l Commercial District.Member Steele
seconded the motion.Upon roll call the motion passed unanimously.
FINAL PMT -PERKINS RESUBDIVISION:
The final plat of the Perkins Resubdivision was submitted to the Planning
Commission.The Town Engineer and the Town Attorney both approved this
plat.Member Petrocine moved that the final plat be approved.Member
lix seconded the motion.Upon roll call the motion passed unanimously.
LOT SPLIT -PORTION OF LOTS 14 &17,LITTLE PROSPECT MOUNTAIN:
Mr.George Nytes,owner of a portion of Lots 14 and 17,Little Prospect
Mountain Addition,submitted a petition,dated February 13,1973,and
plat showing the requested division of the above mentioned
property.Member lix moved that the Planning Commission finds:
1.That there are special circumstances or conditions affecting
the property;
2.That the exception is necessary for the preservation and the
enjoyment of a substantial property right of the petitioner;
3.That the granting of the exception will not be materially
detrimental to the public welfare or injurious to other
property in the neighborhood in which the property of the
petitioner is situated or in conflict with the purposes
and objectives of this title.
and that the following conditions be attached:
1.Separate utilities provided f€r both lots,including
easements.

LOT SPLIT -PORTION OF LOTS 14 &17,LITTLE PROSPECT MOUNTAIN(continued):
2.Apartment removed and replaced with a residence.
3.Adequate access provided to both properties.
Member Steele seconded the motion.Upon roll call the motion passed
by the following votes.Those voting “Yes”Members Wagner,Steele,
Petrocine,Prosser and Hix.Those voting ‘No”none.Those “Abstaining”
Member Marsh.
NEXT MEETING DATE:
After considerable discussion,Chairman Prosser announced that the next
meeting will be called to order at 1:30 P.M.on Tuesday,March 20,1973.
This meeting will be preceeded by an informal luncheon meeting.
There being no further business,the meeting adjourned.
