It was regularly moved,seconded and carried that the Commission dispense with reading of the minutes of the last meeting. PARK VIEW SUBDIVISION: Mr.and Mrs.DeEstaing R.Newton and Mr.Tom Brown presented the preliminary plat of “Park View Subdivision”. Mr.Newton explained his petition for exceptions to the Municipal Code: 1.2l.5-2A —Lots 7,8 and 10 have less than 75 foot road frontage. 2.2l.5-lD -The proposed extension of Park View Lane exceeds 400 feet in length. 3.21.5-lE -The proposed street radius is not 100 feet at the entrance of the subdivision and on entering the cul-de-sac. Mr.Newton stated that all utilities will be placed underground and that the owners,he and his wife,would petition the Town to rezone this property from the existing R-l Residential District to R Residential District.Mr.Newton stated that all requirements in the R Residential zone will be complied with. The following letters were read to the Commission: 1.The Town Attorney’s letter of January 9,1973 pointed out errors in citations of the Municipal Code.These errors have now been corrected. 2.The Water Superintendent’s letter of January 10,1973 requested a 4”main be installed in the existing Park View Lane to a point opposite Lot 4.The gaskets on cast iron pipe must be of a conductive type.The fire plug shall be Muller or equal to Town specifications.Mr.Newton agreed to these suggestions. 3.The Street Superintendent’s letter of January 10,1973 requested that that portion of Lot 13,Little Prospect Mountain Addition,which Park View Lane crosses be dedicated.There should be provisions for storm drainage where Park View Lane crosses the northeast corner of Lot 13,Little Prospect Mountain Addition.Mr.Newton informed the Commission that Mr.Kezer,owner of Lot 13,Little Prospect Mountain Addition,would only agree to deeding 10 feet for street right-of-way.Mr.Newton and Mr.Brown stated that the storm drainage provisions will be made. RECORD OF PROCEEDINGS Planning Commission Meeting January 16,1973 Page two 4.The Town Planner’s letter of January 11,1973 pointed out the three exceptions requested by Mr.Newton’s petition. The Town Planner also advised the Coimnission that the ease ment shown on the plat for the road encroachment should be replaced by a dedicated right-of-way and that the storm drainage,as platted,should be changed to include a pro vision for drainage at the southeast corner of the sub division.In addition to the above code requirements, the Town Planner suggested the lack of adequate frontage on Lots 7,8 and 10,combined with the logical locations of building sites on these adjoining lots,produce an undesirable density of homes on the perimeter of the cul-de-sac.The Town Planner recommended that Lot 8 be combined with Lot 7,and Lot 9 be combined with Lot 10. The Town Planner also recommended a 20’wide right-of-way street dedication be obtained from Lot 13,Little Prospect Mountain Addition. The Commission,the Newton’s,Mr.Brown and the Town Staff discussed the pros and cons of the 20 foot street right-of-way needed from Mr.Kezer at length. Member Wagner moved the Commission accept a 10 foot right-of-way from Mr. Kezer.There was no second to the motion.Chairman Prosser ruled the motion lost for the lack of a second. Member Hix moved the Commission table any further consideration of the preliminary plat of Park View Subdivision until such time as the 10 or 20 foot street right-of-way is resolved.Member Tregent seconded the motion and upon roll call the motion passed by the following votes: those voting “yes”Members lix,Petrocine and Tregent.Those voting “no”Members Prosser and Wagner.
