Section 1.It shall be unlawful for any prson,firm or
corroration to sell,serve or diotribute for cunerciel purposes
within the corporate limits of the Town of Ostes Park alcoholic
liuor containing more than 3.2%of alcohol by weight,except as
permitted and.in the manner ovided by the Lsws of the United States
as now in force or hereafter adopted,and except as permitted and in
the manner provided by the Laws of the State of Colorado and the
provisis of this ordinance.
Section 2.Evary person,firm or cioraticn selling any beer,
wine or other alcoholic liquors containing more than 3.2%alcohol
within the Town of Estes Park shall first obtain a license thefor.
The license aforesaid shall be issued by the Town Clerk but only after
the applicant shall have submitted proof to said Clerk that said
applicant hs cnplied with the :rovisions of all the Federal and
State Laws relating to the Eale of said liquors.The annual license
fee to be paid to the To.:n of Estes Park for said license shall be
as follows:
For a license to sell liquor where the same is to be consumed
upon the premises where sold,the sum of 2OO.OO per annum for each
place so Ucensed,and for each place where any such licuor shall be
sold not to be consumed on the place where sold,the sum of 3DO.OO
per annum.All fees for said license shall be payable in advance.
Section 3.The Town Clerk shall only issue licenses f the
sale of ilnuor to be conbumed u’on the premises to persons,firms or
corporations engaged in the business or businesses allowed to dispense

licuor for consinption upon the vremises whe sold as prescribed
and defined under Chapter 12 of the iession Laws passed by the
Extraordinary Session of the Legis1atue,193,which Act was approved
August 22,193.
Section 4.It shall be unlawful for any person,firm or corporation
licensed under this ordinance to sell any such licuor on Sunday or on
any Primary,Snecial or General Election Day during polling,but
nQthing herein shall prohibit the selling and serving for consumption
on the premises àf malt or vinous liquors as irovided in Chapter 12
of the Session Laws above referred to.
Section 5.Every person,firm or corporation licensed under this
ordinance shall observe all the laws,rules and reilations prescribed
by Chapter 12 of the Session Laws passed by the Extraordinary Session
of the 19i Lerislature,ich Act xsas approved iu€ust 22,l93,and
a violation of any of the provisions of said Chapter shall be a violation
of this ordinance and subject the licensee to a fine hereunder in the
same manner as though each and every section of said Chapter 12 were
enixaerated in this ordinance,
Section b.If any licensee under this orflnce shall be
convicted of a violation of any of the prisions hereof or a violation
of any of the Laws of the State of Colorado relating to the selling of
beer,wine,malt,vinous orspiritous liucrs,or if such licensee shall
permit any unseemly conduct of any person or persons upon the Wemises
of such licensee,then in addition to any other penalties hein provided
the Board of Trustees shall have the power to suspend or revoke such
license entirely,and in case any such license shall be suspended or
revoked as aforesaid,no port of the fee therefor shall be remitted to
such offender,provided,hovjever,no such license shall be suspended or
revoked until the licensee has been notified and given an opportunity
to appear at a regular or scial meeting of the Board of ustees,
at which time and place said licensee shall have the privilege of
nresenting any matters on his behalf.

Section 7.The provisions of this ordinance shall not apply
to the sale or distribution of sacramental or medicinal licuors.
Section E.ny pLr.on,firm or corporation convicted of a
violation of any of the provisions of this ordinance shall be fined
in a sum not less than 25.O0 nor more than )3O0,0O,and upon
failure to pay said fine and costs may be coiifined in the jail until
such fine and costs are paid,not to exceed ninety (90)days.
Section 9.The Board of Trustees of the Town of Estes Park now
find,determine end declare that this ordinance is necessary for the
immediate preservation of the public peace,health and safety.
Section 10.1hereas,in the opinion of the Board of Trustees
an emergency exists,therefore,this ordinance shall take effect
and be in force tu and after its passage end adoption.
