AN 0INANCE CONCERNING MAINTEN.ANCE CHARGES
TO BE COLLECTED BY TEE TOWN OF ESTES PARK FROM
CERTAIN HOTELS LOCATED 0UIDE THE TOVN LflIS BUT
COIECTED WITH i\ND USING TEE SEVIER SYSTI OF THE
TOVIN OF ESTES PARK,.AND DESIATING A LTHOD FOR
TI-TE COLLECTIO21 THEREOF.
WHEREAS,the Town of Estes Park now owns and operates a
sewer system composed of main trunk lines and a disposal plant which
was acquired and constructed in the first instance by the said Town
at an expense of 17,000.00 ;and
WHEREAS,in the year 1918 it became necessary to provide
additional facilities for the disposal of sewage carried thrauh said
system,and the then owners of the hotels located outside of the
corporate limits of said Town and hereinafter named contributed to the
Town of Estes Park for such purpose the sis set opposite their
respective names for the betterment of said system,to—wit:
The Stanley Hotel l5OO.OO
Elkhorn Lodge 1200.00
The Crags Hotel 900.00;and
at the tine said sums were so contributed as aforesaid
the owners of said hotels were permitted to connect the said hotels with
said sewer syst without any contract or plan of any kind for the
maintenance of said sewer system and said hotels now are and have been
so connected since said date.Said system has been maintained and
improved by the Town of Es tea Park at the expense of the taxpayers
thereof without any further sums baying been paid by the owners of
said hotels;and
iEBEAS,the cost of maintaining said sewer system has become
a heavy burden upon all the taxpayers of said Town,and in fact,the
annual maintenance cbarr:e no amounts to more than l6O0.00;and
WHEREAS,in the opinion of the Board of Trustees of the Town
of Estes Park it is wholly unjust and inequitable to the taxpayers within
the corporate limits of the Town of Estes Park to maintain said sewer
system and disposal plant at the sole expense o1 said Town;now,

Section 1.That there be charged to and collected from the
owners of the £tanley Hotel an annual maintenance fee of lll.5O;
and that there be charged to and collected from the owners of the
Elkhorn Lodge an annual ma itenance fee of 8l.0O;and that there
be charged to and collected from the owners of the Drags Hotel
an annual maintenance fee of 53.0O.
Section 2.That said annual maintenance fees shall become
due and jayable January 1st,1934,and on the first day of January
each year tlie:eafter.
Section 3.The annual rental fee above mentioned shall
apply only to the hotels asthey now exist;any further additions
to said hotels or any increased use of the sewer system by said
hotels shall be paid for by the said hotels u-on suoh reasonable
terms and conditions,and upon the ayeient of such additional fees
as the Board of Trustees may then determine.
Section 4.Upon failure of the owners of any of said
hotels to ;ay the annual fee due for said hotel within thirty days
after the same becorns due,then and in that event the Town of Estes
Park is hereby authorized to sue in any court the owners of said
hotel Who are so in default with their hotel still connected with
said system,or the Board of Trustees of the Town of Estes ark may
at its election disconnect the sewer of said hotel from said Town
sewer systero and refuse to further carry and disjos of sewage from
said hotel.
Passed and adopted this 23rd day of October,A.D.1933.

I,Charles F.Hix,do hereby certify that the aboveand
foregoing ordinance No.67,concerning maintenance charges to be
collected by the Town of Estee i-ark from certain hotels located
putside the Town limits but onnected with the Town sewer system,
was introduced and read at a regular meeting of the Town of Estee
Park,Colorado,on the 23rd day of October,A.D.1933;that said
ordinance was duly passed and ado.ted by the Town 3oard at its
reular meeting held on the 23rd day of October,A.J.l93;that
said ordinance aftr its final passge as a proved and signed
by the Mayor and ws published in lull in the Estee Park Trail,
a newspaper of general circulation within the Town of stes Park,
in its issue ci the 27th day of October,A.D.1933.
