HomeMy WebLinkAboutORDINANCE 23-1922; An Ordinance Concerning Public health and the Sanitary Condition of all Premises within the Town of stes Park and of any Offensive or Unwholesome business or Establisbment Wit1iin ue hue of the Town Limits of the Town of Estee Park,Colorado. Be it Ordained by the Board of Trustees of the Town of hstes arh,liolorado: Section 1:The mayor and Board of Trustees of the Town shall constitute the Board of health of tais Town,and shall have the power to compel the removal or abatement of any nuisance,source of filth,causeiof disease or unwholesome business or estaliuisliment within the Town limits or .;ithin one mile of the outer boundaries thereof,and shall have such powers and perform such duties as nob’;are ,or hereafter be prescribed by the laws of b±is state or the ordinances of this town. Section 2:said oard of health shall appoint a iown Physician,who shall be the healtu officer of this town and who shall hold office during the plasare of said board,and shall advise said board concerning all matters upon w11ich it shall require medical advice as suca board,and shall attend to complaints of nuisances and orders relating thereto and perform such othr service as the board of trustees may impose by ordinance,or the Board of health lawfully require of him. bection :The hnlth officer and any member of tue Board of health or town marshall ahall have power to enter into any building,cellar,yard or inciosure,or upon any lot of ground within the town limits,or within one mile of the outer boundaries thereof,fur the purpose of examing any reported or suspected nuisance or cause of disease and may order or direct the cleaning 1. OhDIiJhli IO.23. 4 ..ir1 of any such olace and the removal of all nuisances in and about such premises,vithin the town limits,and the discontinuance of any offensive or ufl:hoiesDme business or establisliment in an offensive or unwholesome manner,within one mile beyond tue outer limits of this town.And every person being tce owner,agent or occupant of any premises within the town limits who shall, within twenty-four hours after being duly notified,fail,neglect or refuse to comply with any SuCu orders rLade by tue Board of health and reove such nuisance,or who shall be tfle owner,agent, occupant or person in charge or person carrying on any offensive or unwholesome business or etablislir.ent within one mile beyond the outer limits of the town,and who shall,.fter forty—eight hours notice from tue Board of health,fail,neglect or refuse to comply with any order of said Board of Health concerning the cleansing or abating of said offensive or unwholesome bosiness or establishment,shall upon conviction tciereof be fined and punished as provided in this ordinance. Section 4:If any cellar,vault,lot,drain,place or premises within the town shall be unwholesome,offensive or filthy, or be covered by stagnant or impure water,or shall have thereon any decaying vegetable matter,or shall be in such dondition as to produce unwholesome or offensive exhalatations,the Board of health may cause tile same to be filled up,drained,cleaned or purified, or may require the owner,occupant or person in cuarge of such lot, premises or place to perform such duty;and upon failure of such person to c:mply with said order the board may,afLr twenty—four hours notice,riiove or abate said nuisance and assess the cost thereof against said lot or premises,and any person refusing or neglecting to comply witu any order of said Board of health concerning any 8id nuisance or the abatement tLrereof or the cleaning of said premises shall be subject to the fine in tuis ordinance provided. Section 5:Vdhenever any householder suall know that any person wituin his house is taken sick,or infected,with szall-pox,cholera,diptieria,scarlet fever or other contagious, infectious,malignant or dangerous diseases,Lie shall iimediately give notice thereof to the Board of Health or tue uealtu officer of th town and whenever any physician siiall know that any person whom he is called to visit,or who is brought to hlio for examination is so _nfected or sick with any such disease,he shall immediately give notice to the health officer or Board of Licaith,and LL:ediately upon receipt of any such notice,the healtu officer shali investigate said case and shall order the prompt and thorough isolation of those sick or infected with such disease,so long as tuere is danger of their communicating the disease to other persons,and shall give public notice of the quarantine so esbabiished by posting placards upon the infected remises,which quarantine so established shall be by all persons respeoted and observed,and no person other than the attending physician shll be pernLitted to enter or leave said premises until said quarantine is raised,and no quarantine shall be deemed raised until a certificate duly issued and signed by the health officer is delivered to the occupant of said preAss. Before any quarantine is raised tfle health officer shall require the tuorough disinfection of the house,room,clothing and creiises, and all articles likely to be infected,and if in his opinion any article cannot be fully dsinfected,he may cause the irne to be burned.Any person failing or refusing to disinfect suoh pre.ises or article as herein provided,or who shall violate any provision of tis section,uPon conviction thereof,shall be fincd as in this ordinance hereinafter provided. Section 6:Said Board of Healtn than have pover to establish a pest—iaouse and reLiove to and keep therein all persons infected viith a highly dangerous disease,and may provide for 3. • the care of all persons therein. Section 7:Afl person who shal*violate any provision of tls ordinance,or vmo shall neglect,fail or refuse to comply with any order,notice,rule or regulation of the Board of llelth or health officer,made,given or served for the urpoe of carrying out tne provisions of this ordinance or any of the rules and regulations of ttie said Board oi Health,shall, upon conviction thereof,be fined in any sum not exceeding one hundred doLLars and costs of suit,and in default of payment of such fine and costs,such person may lie iririsoned until such fine and costs are paid,but not to exceed ninety days imprisonment for each offense.
