HomeMy WebLinkAboutORDINANCE 212ORDINANCE NO.212 AN ORDINANCE REGULATING THE USE AND OCCUPANCY OF STREETS,ALLEYS AND PUBLIC GROUNDS,PASSED AND ADOPTED ON THE 25 DAY OF JANUARY,1961 Section 1.BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO,that it shall be unlawful for any person,persons or corporation to use or occupy any street,alley or public ground for the purpose of moving a building across or thereon,without first having obtained a permit therefor from the Town Building Inspector.Said permit shall be issued only upon a written application therefor by the person,persons or corporation so desiring to use -f occupy the street,alley or public ground for moving pur poses,and upon a form to be prescribed by the Town of Estes Park.Said permit must be issued by the Town Building In spector 48 hours or more prior to the time when the moving of said building across or on any street,alley or public ground is to begin.Any permit which may be issued under the pro visions of this ordinance shall provide that the persons to whom it is issued expressly agree to save the Town of Estes Park harmless on account of any damage or injury to the street, alley or public ground so used,and on account of any damage or injury that may be sustained by any person or persons by reason of the use and occupancy of the Street by the person so obtaining a permit. Section 2.Before a permit shall be issued under this ordinance a fee of $50.00 shall be paid to the Town Building Inspector together with the estimated costs which the Town of Estes Park will incur for the safety of persons and the preservation of property and for any services required by the Town in connection with said permit. Section 3.Prior to the issuance of any permit author ized hereunder,the Town Building Inspector shall first inspect the building as to its condition for moving through the Town of Estes Park.The condition of the building to be moved must be such that it can be moved safely upon any street, alley or public ground within the Town of Estes Park. Section 4.Prior to the issuance of a permit hereunder, a detailed route of travel of the building to be moved through the Town of Estes Park must be submitted to the Light and Power Department of the Town of Estes Park,which Department must inspect and approve the proposed route and furnish to the Town Building Inspector an estimate of the expenses to be incurred by the Light and Power Department for its supervision relating to utilities during the move of said building.Representatives of the Light and Power Department must accompany the building to be moved during its entire movement within the Town of Estes Park. Section 5.A surety bond in an amount to be determined by the Town Building Inspector shall be required before any permit is issued hereunder,when in the discretion of the Town Building Inspector the building to be moved is of such size or condition that the movement thereof might re suit in damage to property of the Town of Estes Park or to the property of any other person,and a certificate of insurance must be furnished to the Town Building Inspector in the amount of $100,000 public liability for bodily injury per person,.$300,000 per accident and $50,000 property damage per occurrence. Section 6.Any person,firm or corporation violating any provision of this ordinance shall be fined in the sum -2- of not less than Five Dollars nor more than Three Hundred Dollars and costs for each offense,and upon failure to pay said fine may be confined in jail not to exceed ninety days. Section 7.Ordinance no.209 of the Ordinances of the Town of Estes Park,Colorado,is hereby repealed in its entirety. Section 8.The Board of Trustees of the Town of Estes Park herewith finds,determines,and designates that this Ordinance is necessary for the immediate preservation of the public peace,health and safety,and in the opinion of the Board of Trustees an emergency exists and therefore this ordinance shall take effect and be in force immediately after its passage and adoption.
