ORDINANCE NO.)-2—1
AN ORDINANCE ANENDING ORDINANCE NO.214,PASSED AND ADOPTED THE
24th DAY OF APRIL,1961,AND BEING ENTITLED:AN ORDINANCE ENACTING
AND ADOPTING BY REFERENCE A PRIMARY CODE OF ORDINANCES FOR THE TOWN
OF ESTES PARK,COLORADO,IN PUBLISHED FORM,TO BE KNOWN AS THE
“MUNICIPAL CODE OF THE TOWN OF ESTES PARK.”
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,
COLORADO;
SECTION 1.THAT THE MUNICIPAL CODE BE,AND THE SANE IS
HEREBY ANENDED BY THE ADDITION THERETO OF A NEW SECTION TO BE
NUMBERED 14-13 AND RELATING TO THE LICENSING AND REGULATING OF
PRIVATE AMBULANCES AND DRIVERS,TO READ AS FOLLOWS:
14-13.PRIVATE AMBULANCES.
14-13 .1 Definitions.
14-13.1 (1).“Ambulance”is any privately owned emer
gency vehicle equipped or used for transporting the wounded,in
jured or sick.
14-13.1 (2).“Town”is the Town of Estes Park,Colorado.
14-13.1 (3).“Town Clerk”is the Clerk of the Town of
Estes Park,Colorado.
14-13.1 (4).“Person”is any person,firm,partnership,
association,corporation,company or organization of any kind.
14-13.2.License Required.It shall be unlawful for any
person to regularly operate or conduct,or to advertise or publicize
the operation of an ambulance service in the Town of Estes Park with
out first obtaining a license as hereinafter provided from the Town
Clerk.
14-13.3.Application for License.Applicants for li
censes under this section shall file an application with the Town
Clerk,which shall contain the following:
14-13.3 (1).The name and address of the owner of the
ambulance.
14-13.3 (2).A description of the ambulance,including
the make,model,year of manufacture,Colorado State license number
for the current year,motor and chassis numbers,and the length of
time the ambulance has been in use.
14-13.3 (3).The location and description of the place
or places from which it is intended to operate.
14-13.3 (4).Such other information as the Town Clerk
shall find reasonably necessary to a fair determination of whether
the terms of this Ordinance have been complied with.
14-13.5.Duties of Town Clerk.Within ten (10)days
after receipt of an application with payment of fees as provided
for herein,the Town Clerk shall cause an investigation to be

made of the applicant and his proposed operation.
14-13.5 (1).Standards for issuance of permit.The
Town Clerk shall issue a license hereunder when he finds:
a.That the applicant is currently insured by a
reputable insurance company,said policy providing insurance
coverage for each and every ambulance owned,operated or leased
by the applicant for injury to or death of persons in accidents
resulting from any cause for which the owner of the said vehicle
would be liable on account of any liability imposed on him by
law,regardless of whether the ambulance was being driven by the
owner,his agent or lessee,and as against damage to the property
of another,including personal property,under like circumstances,
in the following minimum limits:Bodily Injury,$25,000.00 each
person,$50,000.00 each accident;Property Damage,$5,000.00;
and that the applicant carries Workmen’s Compensation Insurance
as provided by the laws of the State of Colorado.
b.That the applicant and all attendants and
drivers are fit and proper persons to conduct or work in the
proposed business.
c.That all the requirements of this Ordinance
and all other governing laws and ordinances have been met.
14-13.6.Duties of Town Health Officer.The Town
Health Officer shall inspect the vehièles and premises designated
in an application hereunder and shall certify his approval to the
Town Clerk when he finds that such vehicles and premises are suit
able from the standpoint of health and sanitation for the conduct
of an ambulance business and that all state laws and local ordin
ances relating to health,safety and sanitation have been complied
with.
14-13.7.Insurance policy.An applicant hereunder
shall file with the Town Clerk an Insurance Policy or certified
copy thereof,to be approved by the Town Clerk providing insurance
coverage for each and every ambulance owned,operated or leased by
the applicant for injury to or death of persons in accidents re
sulting from any cause for which the owner of said vehicle would
be liable on account of any liability imposed on him by law,re
gardless of whether the ambulance was being driven by the owner,
his agent or lessee,andas against damage to the property of
another,under like circumstances,in sums to be approved by the
Town Clerk.
14-13.7 (1)Coverage Period.Every insurance
policy required hereunder shall extend for the period to be cover
ed by the license applied for and the insurer shall be obliged to
give not less than ten (10)days written notice to the Town Clerk
and to the assured before any cancellation or termination thereof
earlier than its expiration date and the cancellation or other
termination of any such policy shall automatically revoke and
cancel the licenses issued for the ambulances covered by such
policy,unless another insurance policy complying with the provi
sions of this section shall be provided and be in effect at the
time of such cancellation or termination.
14-13.8.License of Drivers and Attendants.No
person shall drive or serve as attendant of an ambulance licensed

hereunder without first procuring a license therefor from the Town
Clerk.
14-13.8 (1)Standards for Issuance.The Town Clerk shall
issue a license as driver,attendant,or driver and attendant,accord
ing to the application and the qualifications of the applicant,under
this Section when he finds that the applicant:
a.Is of the age of 21 years or over.
b.Is of sound physique with good eyesight and notsubjecttoepilepsy,vertigo,heart trouble,or any other infirmity
of body or mind which might render him unfit for the sale operation
of an ambulance,as evidenced by a medical certificate from a licensed
medical doctor.
c.Has completed and is currently qualified under
the Standard Course,American Red Cross First Aid.
d.Has complied with the requirements of this Ord
inance and all other governing laws and ordinances.
14-13.9 Application,Application Fee and License Fee for
Drivers and Attendants.Applicants for licenses under this Section
shall file an application with the Town Clerk which shall contain the
following:
14-13.9 (1)Age and chauffeur’s number.
14-13.9 (2)Whether or not he has previously been
licensed as a driver,chauffeur or attendant,and if so,when and
where,and whether or not his license has ever been revoked or sus
pended and for what cause.
14-13.9 (3)Whether or not he has ever been convicted
of a felony or a misdemeanor.
14-13.10.Records.Every person licensed as an operator
of private ambulance under this Article shall keep records showing
the name and address of every wounded,sick or injured person trans
ported,the place of pick-up and delivery of such person and the date
and hour of the pick-up and delivery.Such records shall be available
for inspection by the Town Clerk at any reasonable time.
14-13.11.Rules and Regulations.The Town Clerk may
issue and promulgate from time to time rules and regulations to pro
vide for the health,safety and welfare of the Town of Estes Park in
relation to ambulance services,drivers and attendants.Such rules
and regulations may pertain,by way of example,to the duties of li
censees,manner of conduct of ambulance service,businesses,drivers
and attendants,and reports to be furnished to the Town Clerk.
14-13.12.Revocation.Any license granted hereunder may
be revoked by the Town Clerk or the Town Board upon the violation of
one or more of the provisions herein.
Section 2.The Board of Trustees of the Town of Estes
Park herewith finds,determines and designates that this ordinance
is necessary for the immediate preservation of the public peace,
health and safety,and in the opinion of the Board of Trustees an
emergency exists and therefore this ordinance shall take effect and
be in force immediately after its passage and adoption.
