HomeMy WebLinkAboutORDINANCE 198a ORDINANCE NO./9%(’ AN ORDINANCE RELATING TO THE CONSTRUCTION,REPAIR, MAINTENANCE AND USE OF SIDEWALKS,CURBS,CURB CUTS AND DRIVEWAYS WITHIN THE TO’1N OF ESTES PARK,COLORADO BE IT ORDAINED by the Board of Trustees of the Town of Estes Park,Colorado: Section 1.No person,firm or corporation shall construct or reconstruct sidewalks,driveways,curbs or curb cuts on, adjacent to,or near to any public right of way within the Town of Estes Park without first obtaining a permit to do so from the Building Inspector of the Town of Estes Park. Section 2.All sidewalks,driveways,curbs or curb cuts hereafter constructed on,adjacent to or near to any public right of way in the Town of Estes Park shall be constructed of the size,in the location,upon the grade,and according to the specifications contained in the permit therefor. Section 3.No person shall remove,repair or in any manner disturb any such sidewalk,driveway,curbs or curb cuts without first having obtained a permit from the Building Inspector of the Town of Estes Park.This permit shall specify the work to be done and the specifications therefor. Section 4.Whenever the Town Board,by resolution,shall determine that the construction of any sidewalk,curb or curb and gutter,or the repair thereof,is necessary for the public safety,it shall be the duty of the owner of the property adjacent to or upon which the improvement is to be constructed 0’ 0 for the service of notice upon the owne’or agent in charge, and if the same shall not be paid within thirty (30)days after the service of said demand,the Town Clerk shall certify said assessment to the Treasurer of Larimer County,Colorado, for extension of said assessment upon his Tax Roll for the collection of said assessment in the same manner as other taxes assessed upon said property. Section 6.Any person,firm or corporation found guilty of a violation of any of the provisions of Sections 1,2 and 3 of this Ordinance shall,upon conviction,be fined in an amount of not to exceed Three Hundred Dollars ($300.00).
