A ORDINANCE LICENSING AND REGULATING SOLICITORS BY TELEPHONE
Be it Ordained by the Board of Trustees of The Town of Estes Park,Colorado;
Section 1:That no person,firm or corporation shall engage in the
)usiness of a solicitor by telephone without having first procured a license
from The Town of Estes Park.Application for such license shall be made to
the Town Clerk and shall be accompanied by a detailed statement of the business,
procedure and personnel of the applicant.Such application shall be referred
by the Town Clerk to the Town Board at its next meeting.If the Board grants
such license it shall fix the fee for the same which shall be not less thak.
$10.00 nor more than 100.00 and shall be varied by the Board depending on
the nature,length of time and purpose of the telephone solicitation.The
Board may RiO require a proper surety bond guaranteeing the good faith of
such solicitors or his agents,
Section 2.No person,firm or corporation shall enter into any contract
or agreement with any person,firm or corporation or shall negotiate any such
contract or agreement calling for the solicitation by telephone unless the
person,firm or corporation designated to perform the solicitation shall be
licensed to engage in such business,
Section 3.The term “solicitor by telephone”shall mean and include
any person,firm or corporation who calls other persons by telephone without
their previous knowledge or consent,for tickets,pictures,merchandise,
advertising,wares,rights,chances,admissions and the like,It shall not
include those who make only occasional calls for such purpose,The term
“solicitation by telepnone”shall mean and include the practice of calling
others by telephone without the previous knowledge or consent of such other
person,for the purpose of selling,offering for sale or soliciting orders
for tickets,pictures,merchandise,advertising,wares,rights,chances,
admissions or the like,
Section 4.Any person engaging in the business of soliciting by
telephone or making any telephone call for such purpose shall state the name
and location of the licensed solicitor,No such solicitor shall argue,
threaten,missrepresent,or use profanity during any such call.
Section 5.Any person,firm or corporation violating any of the pro
visions of this Ordinance shall,upon conviction thereof,be fined not less
than five dollars nor more than three hundred dollars.
Section 6,This Ordinance shall be in force and effect from and after
its passage and publication as provided by law.
