ORDINANCE 256
AN ORDINANCE VACATING A PORTION OF A STREET
OR EASEMENT DEDICATED TO PUBLIC USE IN SECOND
RIVERSIDE SUBDIVISION TO THE TO1 OF ESTES
PARK,COLORADO.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.That the portion of a ten (10)foot strip,
street or easement between lots and river as shown on the Plat
of Second Riverside Subdivision to the Town of Estes Park,
Colorado dated July 9,1917,recorded September 29,1917 in
P1st Book 14.,Page 17 of the records in the office of the
Clerk and Recorder of Larimer County,Colorado and contained
within the following described property,to-wit:
Considering the line between the official U.S.General
Land Office brass capped pipe marking the center *
corner of Section 25;Township 5 North;Range 73 West
of the 6th Principal Meridian and the brass capped
pipe stsmed Town of Estes Park marking the NE corner
of the SE of the NW*of said Section 25 as having a
bearing of North as shown on the corrected Flat of
Riverside Subdivision to the Town of Estes Park,
Colorado as recorded in the Larimer County records
and commencing at the above mentioned *corner;
thence North 67O.L feet;thence S.82dl1T E.a distance
of 222.26 feet along the North side of Lot #8,Riverside
Subdivision to the 11W corner of Lot #Ll and the True
Point of Beginning;thence S.82°llt E.along the North
side of Lot #14 a distance of 106.8 feet to the West
side of the Big Thompson River;thence S.23°OLT W.a
distance of 53.6 feet;thence S.29o55T W.a distance
of 96.514.feet to a point that is S.75O33T V.a dis
tance of l3L.9 feet from the HW corner of Lot #26;
thence N.82°L2T V.a distance of 12.0 feet;thence
S.72°17’W.a distance of 85.8 feet to the intersection
with the East right-of-way of West Riverside Parkway;
and the SW corner of Lot #14;thence along the East
side of West Riverside Parkway N.lL°32t E.a distance
of 78.85 feet;thence N.20033?E.a distance of 51.23
feet;thence N.2l°5l’E.a distance of 51.53 feet to
the True Point of Beginning;
be and the same is hereby vacated.
Section 2.The Town Board herewith finds,determines
and declares that said ten (10)foot strip,street or easement
is not needed for ingress or egress to and from any property
0
adjacent thereto and that the convenience of the people will
not in any way be affected or impaired by vacating said portion
of said ten (10)foot strip,street or easement,and that the
owner of the land abutting on said portion of said ten (10)foot
strip,street or easement has requested the Town Board to vacate
the same.
Section 3.The Town Board herewith finds,determines
and designates that this ordinance is necessary for the immediate
preservation of the public peace,health and safety,and whereas
in the opinion of the Toi.m Board an emergency exists,this
ordinance shall take effect and be in force five (5)days after
its final passage,adoption and publication.
