HomeMy WebLinkAboutORDINANCE 268-64ORDINANCE NO.26 AN ORDINANCE VACATING AN EASEMENT OF THE TOWS OF ESTES PARK,COLORADO,IN A PORTION OF LOT 11,VILLAGE ACRES SUBDIVISION,AN ADDITION TO THE TOWN OF ESTES PARK, COLORADO,AND AUTHORIZING A DEED THEREOF. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That an easement of the Town of Estes Park,Colorado,in Lot 11,except that portion thereof described as follows:Beginning at the Southwest corner of said Lot 11;thence Northerly along the Westerly line of said Lot 11 to the Northwest corner of said Lot 11;thence Easterly along North line of said Lot 11 a distance of 60.6 feet;thence Southerly,parallel to the West line of said Lot 11,168.8 feet to the South line of the said Lot 11;thence Westerly along the South line of the said Lot 11 a distance of 60 feet to the point of beginning,in Village Acres Subdivision,an addition to the Town of Estes Park,Colorado,obtained in Paragraph No.5 of the Declaration of Protective Covenants of a plat of said Village Acres Subdivision,an addition to the Town of Estes Park,Colorado,recorded in P1st Book 6,Page 123, in the records of the Clerk and Recorder of Larimer County, Colorado,be and the same is hereby vacated,and that the Mayor and Town Clerk be,and they hereby are,authorized and directed to execute in behalf of the Town of Estes Park,Colorado,a Quit Claim Deed conveying all of the Town of Estes Park’s right,title and interest in and to said easement to the present owner of said Lot. Section 2.The Board of Trustees herewith find, determine and declare that the above mentioned easement is not needed and that the convenience or needs of the people will not in any way be affected or impaired by vacating and deeding said easement to the present owner of said Lot for the Town has 0 0 obtained from said owner a new easement for utility purposes in said Lot. Section 3.The Board of Trustees herewith determines and designates that this Ordinance is necessary for the immediate preservation of the public peace,health and safety and whereas in the opinion of the Board of Trustees,an emergency exists, this Ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication.
