ORDINANCE NO.295
AN ORDINANCE ANENDING SECTIONS 12.2-2,
12.3,12.6,AND 12.1L OF ThE MUNICIPAL
CODE OF THE TOWN OF ESThS PARK,COLORADO,
TIlE SANE PERTAINING TO ZONING AND SIGNS.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF ESTES PARK,COLORADO:
Section 1.That Section 12.2-2 of the Municipal
Code of the Town of Estes Park,Colorado be and the same
is hereby amended by adding thereto the following:
12.2-2 Specific Words and Terms.
Basement:Basement is that portion of a building
as defined in the Uniform Building Code,Vol.1,1961 Edition,
issued by the International Conference of Building Officials,
610 South Broadway,Los Angeles 1L,California,made a part
of this Code by Section 11.1 thereof.
Section 2.That Section 12.3 of the Municipal Code
of the Town of Estes Park,Colorado be and the same is hereby
amended by adding thereto the following:
12.3 Zoning Districts.
H Residence District
Section 3.That Section 12.6 of the Municipal Code
of the Town of Estes Park,Colorado be and the same is hereby
amended by adding thereto the following:
12.6 R Residence District.
12.6-1 Use Restrictions.No building or premises
shall be used,and no building shall be hereafter erected
or structurally altered,unless otherwise provided herein,
except for one or more of the following uses:
1.One-family dwelling.
2.One guest dwelling.
3.Uses customarily incidental to any of the above
uses,when located on the same lot and not
a.

involving the conduct of a business on the
premises.
L1..Accessory buildings limited to private garages.
5.Domestic animals;provided such animals are
household pets and that kennels are not
maintained.
6.Public utility mains,lines and substations,
where no public office and no repair or storage
facilities are maintained.
7.Fences,hedges and walls,provided such uses
are less than 3-feet in height when located
within 100 feet of the center line intersection
of two streets or roads.
12.6-2 Yards.For every building there shall be a
front yard,rear yard and side yard of not less than 25 feet.
12.6-3 Lot Area Per Family.For every one-family
dwelling there shall be provided a minimum lot area of 21,760
square feet.
l2.6-L Floor Area Per Dwelling.There shall be
permitted upon each lot,one residence building containing
not less than 800 square feet of floor area;one guest house
containing not less than 600 square feet of floor area;and
one private garage which may be either a separate structure
or combined with the residence house or guest house.Basement
floor areas shall not be included to determine compliance with
the above minimum floor area requirements.
Section L.That the first paragraph of Section l2.lL
of the Municipal Code of the Town of Estes Park,Colorado be
and the same is hereby amended to read:
l2.lL1 Mon-Conforming Uses.Except as provided in
this section,the lawful use and location of any building or

land existing at the time of enactment of this ordinance,
or of any amendments to this ordinance,may be continued
even though such use or location does not conform to the
requirements of this ordinance;except the use limitation
pertaining to signs as provided in Section 12.12-2(6)of
this Code.
Section 5.The Board of Trustees herewith finds,
determines and designates that this ordinance is necessary
for the immediate preservation of the public peace,health
and safety,and whereas in the opinion of the Board an
emergency exists,this ordinance shall take effect and be in
force five (5)days after its final passage,adoption and
publication.
