BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOMU OF ESThS PARK,COLORADO: Section 1.That Section of the Municipal Code of the Town of Estee Park,Colorado is amended to read: Storage of Flammable or Combustible Liquids. lL.L-l Permit Required.It shall be unlawful for any person to keep or have in excess of five gallons of any flammable or combustible liquid on any premises within the corporate limits of the Town without first obtaining a permit from the Board of Trustees,except as hereinafter provided in this section. lL.L-2 Installation Permit and Fee.It shall be unlawful to install any tank,pump or apparatus for the storage or handling of flammable or combustible liquids without first obtaining a permit from the Board of Trustees. The fee for a permit to install any tank,pump or apparatus for the storage or handling of flammable or combustible liquids shall be $.OO for each permit. il.L-3 Issuance of Permit.All applications for such permits must be made in writing to the Town Clerk on forms provided for this purpose and accompanied with the required fee.The Building Inspector shall forthwith inspect the premises proposed to be used for such sale or storage,and the means of distribution,and if the conditions,surroundings and arrangements are such that the intent of this ordinance can be observed and there is no distinct hazard to persons or adjoining property,then he shall so report to the Board 0 0. of Trustees,and a permit shall be issued subject to final inspection. iL.L-L Inspection.Before any installation is covered from sight or placed in use,a notification in writing shall be given to the Building Inspector who shall inspect the installation within forty-eight hours after the receipt of such notice and give his written approval or disapproval. Upon failure of the Building Inspector to inspect within the required time,the installation may be covered but shall be subject to inspection by the Building Inspector at the expense of the Town. iL.L-Underground Storage Required.It shall be unlawful for any person to have or keep more than five gallons of any flammable or combustible liquid on his premises at any one time unless the same is contained in an approved storage tank constructed,installed and maintained in accordance with the following rules and requirements.All tanks and pumps used in connection with any flammable or combustible liquids shall be constructed under the super vision of the Underwriters’Laboratories,or such other agency or firm as shall be approved by the Building Inspector,and each tank and pump shall bear their label of approval showing that the device has been tested and approved. lL.L1-6 Exceptions.This section shall not apply to flammable or combustible liquids while contained in washers used in connection with dry cleaning establishments,when said establishments are located within a building that con forms to the provisions of the Uniform Building Code in force within the corporate limits of the Town of Estes Park,as provided in Section 11.1 of this Code. -2- C iL1.L-7 Installation of Tanks.Tanks shall have tops at least three feet below the surface of the ground, and below the level of the lowest pipe in the building to be supplied,except as hereinafter provided in this section. Tanks may be permitted underneath a building if buried at least three feet below the lowest floor.Tanks shall be set on a firm foundation and surrounded with soft earth or sand,well tamped into place,or encased in concrete.Tanks may have a test well,provided the test well extends to near the bottom of the tank,and the upper end shall be her metically sealed and locked except when necessarily open. When the tank is located underneath a building the test well shall extend at least twelve feet above the source of supply. The maximum limit of storage permitted in one tank shall be 10,500 gallons,and shall depend upon the location of tanks with respect to the building to be supplied and adjacent buildings and property as follows: (a)10,500 gallons total capacity if over thirty feet from any property line which may be built upon and if lower than any floor,basement,cellar or pit in any building within thirty feet; (b)L,ooo gallons total capacity if over twenty feet from any property line which may be built upon and if lower than any floor,basement,cellar or pit in any building within twenty feet; (c)1,100 gallons total capacity if over ten feet from any property line which may be built upon and if lower than any floor,basement,cellar or pit in any building within ten feet; (d)60 gallons total capacity if within ten feet of any property line which may be built upon and if not lower than every floor,basement,cellar or pit in any building within ten feet,in which case it must be entirely encased in six inches of concrete. -3- 0 0 iL.L-B Design and Construction of Tanks. a.Materials. (1)Tanks shall be built of steel except as provided in Sections lL.Lj-8a(2)through iL.L-8a(). (2)Tanks may be built of noncombustible materials other than steel if required by the properties of the flammable or combustible liquid stored. (3)Tanks built of materials other than steel shall be designed to specifications embodying principles recognized as good engineering design for the material used and shall be approved by the Building Inspector. (Lv)Unlined concrete tanks may be used for storing flammable or combustible liquids having a gravity of LO degrees API or heavier.Concrete tanks with special lining may be used for other services providing the design is in accordance with sound engineering practice. ()Tanks may have combustible or non- combustible linings. (6)Special engineering consideration shall be required if the specific gravity of the liquid to be stored exceeds that of water or if the tanks are designed to contain flammable or combustible liquids at a liquid temperature below zero degrees F. b.Fabrication. (1)Tanks may be of any shape or type con sistent with sound engineering design. (2)Metal tanks shall be welded,riveted and caulked,brazed,or bolted,or constructed by use of a combination of these methods.Filler metal used in brazing shall be nonferrous metal or an alloy having a melting point above 1000°F.and below that of the metal joined. -L1- / c.Atmospheric Tanks. (1)Tanks designed for underground service not exceeding 2,500 gallons capacity may be used aboveground when authorized by the Board of Trustees. (2)Low pressure tanks and pressure vessels may be used as atmospheric tanks. (3)Atmospheric tanks shall not be used for the storage of liquids which have flash points below 73°F.and having a boiling point below 100°F. d.Low Pressure Tanks.The normal operating pressure of the tank shall not exceed the design pressure of the tank.Atmospheric tanks built according to Underwriterst Laboratories,Inc.standards may be used for operating pressures not exceeding 1 psig.and shall be limited to 2.5 psig under emergency venting conditions.Pressure vessels may be used as low pressure tanks. e.Pressure Vessels.The normal operating pressure of the vessel shall not exceed the design pressure of the vessel. 1L.L-9 Venting of Tanks.All underground storage systems which may contain flammable or combustible liquids shall have at least a one inch vent pipe running from top of tank to a point outside of the building and acceptable to the Building Inspector,but which shall end at least twelve feet above the level of the source of supply and in a location remote from fire escapes and not less than three feet, measuring horizontally and vertically,from any window or other opening.The vent pipes from two or more tanks may be connected to one upright,provided they be connected at a point at least one foot above the level of the source of supply. -5- 0 lL.L-l0 Filling Pipes.Ends of filling pipes for all underground storage tanks shall be carried to an approved location outside of any building,but not within five feet of any entrance door,or cellar opening,and shall be set in an approved metal box with cover which shall be kept locked except during filling operations;this filling pipe shall be closed by a screw cap.A 30 x 30 mesh or equivalent brass screen strainer shall be placed in the supply end of the filling pipe.The piping of flammable or combustible liquids in the streets or alleys of the Town for any distance exceeding fifty feet shall not be permitted except in outlying districts where such piping can be buried properly below frost line, kept clear of other piping and sewers,and where in the judg ment of the Building Inspector such piping can be maintained properly and would in no way create a hazard to life and property. lL.L-ll Matches and Smoking Prohibited.It shall be unlawful to carry matches or smoke in any room or part of a building which contains flammable or combustible liquids in open containers or in which the vapors from such liquids are present or in which such liquids are used in any manufacturing process.Suitable signs lettered “Smoking Prohibited by Order of the Board of Trustees”shall be displayed. il.L-l2 Handling and Sale Regulated.It shall be unlawful for any person to open or fill any gasoline tank of an automobile or motorcycle while the engine or motor is running.No flammable or combustible liquids shall be drawn, handled or stored in the presence of or within dangerous proximity to open flame or fire. 1L.L-l3 Automatic Dispensing Units.It shall be unlawful to install and use unattended coin-operated dispensing -6- C C devices for liquids which have flash points below 1000 Fahrenheit. Section 2.That Section iL.5 of the Municipal Code of the Town of Estes Park,Colorado is amended to read: lLj..5 Deliveries of Flammable and Combustible Liquids. il.5-l Permits for Deliveries of Flammable or Com bustible Liquids Required.It shall be unlawful to make deliveries of flammable or combustible liquids to an outlet or location within the Town unless such outlet or location meets the requirements of Sections lL.5-2 and lL.-3 of this Code.It shall be unlawful for the owner or person in possession or control of any vehicle delivering flammable or combustible liquids to make deliveries thereof within the Town unless the owner or person in possession or control of such vehicle has a permit to make deliveries of such liquids to the outlets or locations set out in the permit.Applications for a permit required by this section must be filed with the Town Clerk,and must contain the land description of the outlet or location to which such deliveries are to be made. Upon the filing of an application for such permit,the Building Inspector shall inspect the outlet or location to determine if it complies with the provisions of Sections lL.-2 and 1L.-3 of this Code.If all such provisions are complied with the Town Clerk shall issue the permit upon the payment of a fee of $.00 for each permit. il.-2 Physical Characteristics of Outlets or Locations Desiring Deliveries of Flammable or Combustible Liouids.Any outlet or location for which a permit is requested for deliveries of flammable or combustible liquids must meet the requirements of this section.The outlet or location must contain sufficient room to accommodate the —7- Q delivery vehicle.Sufficient room to accommodate the delivery vehicle shall be defined to mean that the delivery vehicle must be capable of being parked entirely within the property boundary lines of the outlet or location and in such a manner that no part of the delivery vehicle shall extend into any street,alley,or sidewalk while such vehicle is off-loading flammable or combustible liquids.Further,the entrance and exit access ways provided for the delivery vehicle shall be so arranged that no undue obstruction of traffic results from the delivery vehicle entering or leaving the location or out let.It shall be unlawful for the owner,or person in possession or control of the premises of an outlet or location to accept deliveries of flammable or combustible liquids in violation of the provisions of this section,and it shall be unlawful to make deliveries to an outlet or location which does not meet the requirements of this section. lL.-3 Safety Devices Required for Outlets or Locations Accepting Deliveries of Flammable or Combustible Liquids.Any outlet or location,to be qualified to accept deliveries of flammable or combustible liquids,must contain,be equipped with,and use at all times,the following safety devices and structures. (1)Storage tanks for flammable liquids must be underground and constructed in accordance with Section l)4..L-8,except that storage tanks for bulk plants may be above ground. (2)The hose connection employed in making a delivery of flammable or combustible liquids must contain the safety device known as the 11glass elbow”device,to allow inspection of the contents of the delivery hose. (3)Any hose used in making deliveries of -8- 0 flammable or combustible liquids must contain the apparatus commonly known as the tight connection device to secure the off-loading device of the delivery vehicle to the intake structure of the storage tank. It shall be unlawful for the owner,or person in possession and control of the facilities,of an outlet or location to accept deliveries of flammable or combustible liquids in violation of the provisions of this section,and it shall be unlawful to make deliveries to an outlet or location which does not contain the safety devices required by this section. lL.-L Full Compartment Dumps Required.Any delivery vehicle which contains compartments larger than 600 gallons must empty each such compartment at a single stop,if any delivery of liquids is made at any outlet or location from any such compartment,except vehicles delivering liquefied petroleum gases and fuel oils. lL.-5 Identification and Safety Regulations.It shall be unlawful to operate,repair or store any vehicle used for the purpose of transporting or delivery of flammable and combustible liquids unless the following safety regulations are complied with: a.All vehicles transporting or delivering flammable or combustible liquids shall be equipped with at least one drag chain or other approved device long enough to reach the ground in order to drain off such static electrical charges as may be generated,and the tank,chassis,axles and springs shall be electrically bonded to take care of static electrical charges. b.Withdrawal of flammable or combustible liquids from vehicles transporting the same as defined herein -9- 0 0 shall be through approved draw-off valves having discharge end threaded or otherwise so designed as to permit a tight connection with hose,and installed in an approved location on said vehicles. c.Vehicles transporting or delivering flammable or combustible liquids are prohibited inside any building during delivery operations,and all containers shall be filled outside buildings. d.Vehicles which transport or deliver flammable or combustible liquids shall not be permitted inside any building except while undergoing repairs. e.Where flame,fire or other heat is required in repairing any part of a vehicle which transports any flammable or combustible liquid,its tanks shall first be made free of all such liquids or explosive vapors. 1.The transportation by land of flammable liquids as defined in Section lL1.-6 shall be by a vehicle delivering flammable or combustible liquids as such is defined in Section 1L1.5-6 except when such flammable or combustible liquids are transported and delivered in approved sealed containers. g.The fuel tank supplying any vehicle which transports flammable or combustible liquids shall not be filled during the loading and unloading of such vehicle nor while such vehicle is in operation. h.There shall be maintained on each vehicle which transports or delivers flammable or combustible liquids, at all times,at least one fully charged,approved portable fire extinguisher,located in a readily accessible place. i.Smoking is prohibited on any vehicle which delivers or transports flammable or combustible -10- Q materials at all times,and no smoking,flame or fire shall be permitted within twenty-five feet of such vehicle while loading or unloading. j.Delivery to underground tanks shall be made by means of tight connections between the hose and the fill pipe. lL.5-6 Definitions.As used in Sections lL.L and of this Code,the following words and phrases shall have the following meanings: Vehicle Delivering Flammable or Combustible Liquids. The term “vehicle delivering flammable or combustible liquids” shall mean every device upon or by which flammable or com bustible liquids are or may be transported or drawn upon a public highway,street,alley,avenue,boulevard,or place for the purpose of transportation or delivery of such flammable or combustible liquids. Boiling Point.The term “boiling point”shall mean the boiling point of a liquid at a pressure of lL..7 psia. Where an accurate boiling point is unavailable for the material in question,or for mixtures which do not have a constant boiling point,for purposes of this classification the initial point of a distillation as determined by applicable test procedures and apparatus specified ASTM D-86,Standard Method of Test for Distillation of Petroleum Products,1962 edition,may be accepted in lieu of the boiling point of the liquid. Flash Point.The term “flash point”of the liquid shall mean the minimum temperature at which it gives off vapor sufficient to form an ignitable mixture with the air near the surface of the liquid or within the vessel used as determined by applicable test procedures and apparatus as follows: -11- 0 Except for fuel oils and certain viscous materials, the flash point of a liquid having a flash point at or below l7°F.shall be determined in accordance with the applicable provisions of ASTM D-56,Standard Method of Test for Flash Point by the Tag Closed Tester,1961 edition. Except for fuel oils,the flash point of liquids having a flash point above 17°F.shall be determined in accordance with the applicable provisions of ASTM D-92, Standard Method of Test for Flash Point by the Cleveland Open Cup Tester,l97 edition. The flash point of fuel oils and certain viscous materials having a flash point at or below l7°F.shall be determined in accordance with the applicable provisions of AS1 D-93,Standard Method of Test for Flash Point by the Pensky-Martens Closed Tester,1962 edition. Liquid.The term l?liquidTl shall mean,when not otherwise identified,both flammable and combustible liquids. Combustible liquid shall mean any liquid having a flash point at or above lL..0°F.and below 200°F. Flammable liquid shall mean any liquid having a flash point below lLO°F.and having a vapor pressure not exceeding L0 pounds per square inch (absolute)at 100°F. Vapor Pressure.The term tapO pre35re!shall mean the pressure,measured in pounds per square inch (absolute) exerted by a volatile liquid,as determined by applicable test procedures and apparatus specified in ASTM D323,Standard Method of Test for Vapor Pressure of Petroleum Products (Reid Method),l98 edition. Section 3.The Board of Trustees herewith finds, determines and designates that this ordinance is necessary for the immediate preservation of the public health and -12- 0 © safety for the regulation of the storage and delivery of flammable and combustible liquids affect the public health and safety,and whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage, adoption and publication.
