AN ORDINANCE ATNDING CHAPTER 8 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARE,
COLORADO BY ADDING THERETO SECTION 8.5,
PERTAINING TO INDIVIDUAL AND INSTITUTIONAL
WASTE DISPOSAL SYSTEMS AND INSTALLERtS
LICENSES.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF ESTES PARK,COLORADO:
Section 1.That Chapter 8 of the Municipal Code
of the Town of Estes Park,Colorado is amended by adding
thereto the following:
8.5 Individual and Institutional Waste Disposal
Systems.
8.5-1 Unlawful Without Permit.It shall be unlawful
for any person,persons or corporation to construct or recon
struct in the Town of Estes Park any individual or institutional
waste disposal system without first obtaining a sewage disposal
system permit from the Town Building Inspector.
*8.5-2 Requirements for Permit.Before a sewage
disposal system permit shall be issued by the Building
Inspector,the following requirements must be complied with
by the applicant:
(a)Each application for a permit shall be made
on a standard form provided to the applicant by the Town of
Estes Park.
(b)The application shall be accompanied by one
set of plans and specifications of the proposed waste disposal
system when a system’s capacity will exceed 1500 gallons.
(c)A plot plan on a scale one inch equaling
twenty-five feet shall be submitted with each application
showing all property lines,the location of the proposed waste
disposal system and all buildings and other improvements on
the property.

(d)A fee of $5.00 shall be paid to the Town
of Estes Park for each individual waste disposal system upon
application for a permit.
(e)Upon approval of the application by the
Building Inspector,a preliminary permit shall be granted to
the applicant.
Ci’)When the installation of the waste dis
posal system is ready for back-filling and covering,the
applicant shall give the Building Inspector notice thereof
and request a final inspection and final permit for such
installation.
(g)The Building Inspector,his agents or
deputies,shall inspect said installation within twenty-four
hours after receiving the above notice from any applicant
that the applicants installation is ready for inspection;
provided,that said twenty-four hour period shall not include
Sundays or holidays.
(h)Upon a determination from said final
inspection that any such installation has been constructed
in accordance with the provisions of the preliminary permit
and the provisions of this ordinance and Code of the Town of
Estes Park,the Building Inspector,his agents or deputies,
shall issue a final permit to the applicant.
8.5-3 Standards and Regulations.The Building
Inspector shall not issue a preliminary permit for a sewage
disposal system or issue a final permit for any installation
that does not conform to and meet the following standards
and regulations.
(a)Standard for sewage disposal systems
other than for individual residences.
1.Any person,association of persons or
corporation desiring to install individual sewage disposal

systems for small factories,trailer courts,cafes,apartment
houses,multiple family dwellings,or other institutions is
hereby required to submit complete plans therefor to the
Building Inspector and to obtain his approval and a permit
therefor prior to commencing any construction thereof.
2.Any individual sewage disposal system
in the Town of Estee Park,designed to serve,or serving,
twenty-five or more persons shall have the approval of the
Colorado Department of Public Health in addition to the
approval of the Building Inspector of the Town of Estee Park.
3.The Building Inspector in approving
or disapproving said systems shall be guided by the standards
set forth in the “Manual of Septic Tank Practice,”United
States Public Health Service Publication No.526 as re
printed May,1963,pages L7 to 63.
L1..Disposal systems for kitchens
preparing food for twenty or more persons shall have a grease
trap installed ahead of the septic tank with a minimum capacity
of 15 gallons.The minimum capacity of the grease trap shall
be increased 5 gallons for each additional twenty persons
for which food is prepared.
(b)Standards for sewage disposal systems
for one family dwellings.
1.An approved sewage disposal system
shall be provided for each individual one family occupancy.
2.Each one family sewage disposal system
shall include a minimum septic tank capacity of 1200 gallons.
The minimum septic tank capacity shall be increased 300
gallons for each bedroom from the first,to and including
the fourth bedroom.The minimum septic tank capacity shall
be increased 250 gallons for each additional bedroom over a
total of four.

3.All waste discharged from a one family
dwelling shall be disposed of through an approved disposal
system.
(c)Standards for Septic Tanks.
1.All septic tanks constructed,recon
structed,installed or operated within the corporate limits
of the Town of Estes Park shall meet the minimum standards
of this Code.
2.All septic tanks shall be adequately and
durably constructed of materials not subject to corrosion or
decay such as properly cured,pre-cast or cast-in-place
reinforced concrete tanks.Adequate man-holes shall be
provided for inspection and cleaning of all septic tanks.
3.The minimum effectual capacity of a
septic tank shall be 1200 gallons.The liquid depth shall
not be less than sixty inches.The smallest plan dimension
shall not be less than four feet.
L1.The inlet shall enter the tank at
least two inches above liquid level and the inlet tee or
baffle shall extend not less than six inches below the liquid
level.
5.The air space above the liquid level
and below the cover of the septic tank shall be a minimum of
20%of the liquid depth.
6.The outlet of the septic tank shall
be a minimum of two inches lower than the inlet.The outlet
tee or baffle shall extend below the liquid level a distance
equal to a minimum of L0%of the liquid depth,and extend
to within one inch of the top of the tank.
7.When two-compartment septic tanks
are installed the first compartment shall be equal to
0.
two-thirds of the effective capacity of the tank unit.
8.Man-holes of a size of at least
sixteen inches by sixteen inches shall be installed.If
the top of a septic tank is located more than eighteen
inches below the finish grade,man-holes and inspection
holes shall extend to approximately eight inches below
the finish grade.
9.Abandoned septic tanks shall be
pumped out and filled with earth or rocks.
10.A septic tank shall be located
a minimum distance of fifty feet from any source of potable
water supply.
(d)Standards for Sub-Surface Disposal
System -Leaching Trenches of Seepage Beds.
1.The soil in which leaching trenches
or seepage beds are constructed must have an acceptable
percolation rate without interference from ground water or
impervious strata below the level of the absorption system.
The percolation time shall be within the range of those
specified in Table 1 below.The maximum elevation of the
ground water shall be no higher than four feet below the
surface.Rock formation or other impervious strata shall
be at a depth greater than four feet below the bottom of
the trench or seepage pit.Unless the foregoing conditions
are satisfied,the site shall be deemed unsuitable for a
sub-surface disposal system,except for isolated systems,and
a permit therefor shall not be granted.
2.Percolation tests shall be made at
the site of the leaching area and such tests shall be done
in the manner prescribed in these Regulations.

L1.Requirements for standard leaching
trenches:
a.A minimum width of eighteen inches,
and a maximum width of thirty-six inches.
b.A minimum of six inches of washed
gravel shall be placed under the drain tile and two inches
above the tile;except when the percolation test is ten
minutes or more,then twelve inches shall be placed under the
tile and six inches above the tile.
c.The washed gravel shall be covered
with untreated building paper,newspapers,straw,sawdust or
similar material.Tar paper or other substances impermeable
to air shall not be used.
d.No trench shall be deeper than
three feet,unless a deeper trench is authorized by the
Building Inspector,in sandy or gravelly soils,in which
event there shall be sufficient area for the installation
of a new leaching system in the event of a failure of the
original system.

e.Gravel size:three-fourths inch
to one and one-half inch.
f.The trench shall be back—filled
with twelve to twenty-four inches of over-fill.
g.A leaching system shall not be
installed under a roadway,driveway,or other compacted area.
5.Additional requirements for trenches
in a sub-surface disposal field:
a.Two or more trenches shall be
installed,preferably connected at the ends in series.
b.The maximum length of any line
shall be one hundred feet.
c.A distribution box should be
installed for trenches in sloping and terraced ground to
insure unified dispersing of liquid,when required by the
Building Inspector.
d.The minimum soil or ground area
between trenches shall be six feet.
e.The maximum grade of tile lines
shall be two inches per one hundred feet.
f.The minimum grade of tile lines
shall be three-fourths inch per one hundred feet.
g.All joint openings between drain
tile shall be one-eighth to one-fourth inch.
h.Each tile joint shall be covered
with a strip of tar paper or similar material over the upper
half of the joint opening.
i.All bends used in the disposal
field shall have one tight joint at each end of the bed.9iP1’
j.All tile drain lines shall be
four inch agricultural drain tile,concrete pipe or perforated
non—metallic pipe,or other approved similar material.

k.There a leach line crosses a water
line it must be water tight for at least ten feet on either
side of the water line,with cast iron piping with leaded
joints.
6.Seepage beds as leaching systems.
a.Instead of standard trenches,a
seepage bed wider than thirty-six inches may be used.The
bottom absorption area shall be the same as for standard
trenches and based on the percolation rate and other require
ments as shown in Table 1 above.
b.The bed shall have a minimum
depth of twenty-four inches below natural ground level to
provide a minimum earth back-fill cover of twelve inches.
c.The bed shall have a minimum
depth of twelve inches of large size washed gravel under
the tile;and six inches above the tile.
d.The bottom of the bed and dis
tribution tile or perforated pipe shall have a relatively
level grade.
e.All lines for distributing
effluent shall be spaced not greater than five feet apart
and not greater than five feet from the bed sidewalls.
The maximum width for one tile is five feet;the maximum
width for two tiles is fifteen feet,and the maximum width
for three tiles is twenty feet.
f.Then more than one bed is used,
there shall be a minimum of six feet of undisturbed earth
between adjacent beds and the beds shall be connected in
series.
7.Method for making percolation tests
and computing the leaching area:

Dig or auger two holes in the area
to be used for leaching twenty to fifty feet apart,two to
three feet deep,and four to twelve inches wide with vertical
sides.Put three inches of fine gravel in the bottom of the
hole.Scratch the sides of the hole with a sharp instrument
to eliminate smeared or compacted surfaces.If necessary,
insert a sleeve of hardware cloth or similar material to
prevent caving.Fill the hole with water and let it soak
for twelve to twenty-four hours.In sandy soils where water
seeps away rapidly;that is,when the level drops at a
minimum of six inches in thirty minutes,the foregoing
procedure may be omitted and the test made as soon as the
rate of water seepage becomes constant.After soaking,add
water back to within one foot of the ground surface.Measure
the distance from the top of the hole to the water surface,
using a batter board or other solid guide.Record the
distance and the time the measurement was taken.Measure
again in sixty to one hundred twenty minutes.Record the
distance and the time again.Divide the elapsed time by
inches dropped to get the percolation rate in inches per
minutes.
8.Example of the method for computing
the leaching area required by these regulations:
Table 1 shows 16$square feet of
leaching area per bedroom is required when a ten minutes
percolation rate is found.For a three bedroom home -
3 x 16$=L19$square feet of leaching area.
The above leaching area is adequate
to permit garbage grinders and automatic washers.To obtain
the above area,standard trenches or leaching beds may be
used.Use two hundred fifty feet of two foot trenches,or

three trenches eighty feet long in series,or use a seepage
bed twenty feet by twenty-five feet with three tile lines.
9.Location of Systems.
All parts of an individual sewage
disposal system,except the part which is water tight,shall
be located in an unobstructed,uncompacted,unshaded area.
The following are the minimum distances that shall separate
the sub-surface soil absorption or seepage pits from:
Any source of domestic water supply 100 feet
Streams or water courses 100 feet
Buildings 5 feet
Large trees 10 feet
Water distribution lines 20 feet
8.5-Li.Additional Approved Sewage Disposal Systems.
(a)Water flush toilets with a collector
vault of reinforced water-tight concrete.
(b)Privy toilet with water-tight concrete
vault.
(c)Gas fired toilet of approved design.
(d)Chemical toilet using lye or caustic
compound.
8.5-5 OtherSewage Disposal Systems Unlawful
Except by Permit.It shall be unlawful to install,construct,
or maintain any other type of individual sewage disposal
system within the corporate limits of the Town of Estes Park
except those permitted by this Code,without the written
authorization for a departure from the requirements of this Code
by the Building Inspector,which authorization shall not be
granted without the approval of the Board of Trustees of the
Town of Estes Park.
8.5-6 Toilet and Sewer Facilities Required.Every
residence,place of business or other building or place where
persons congregate,reside or are employed,shall be provided
with toilet facilities and sewage disposal facilities that

do not pollute the ground surface or the ground water or any
stream or lake and do not permit the access of flies or
animals thereto.
8.5-7 Cesspools and Earth Privies Unlawful.It shall
be unlawful to install,construct or maintain a cesspool or
earth privies in the Town of Estes Park.
8.5-8 Ground Conditions Unlawful.It shall be
unlawful for the owner of any real property to permit the
presence of human excreta or septic tank effluent on the
ground surface of his property.
8.5-9 Individual Sewage and/or Waste Disposal
System Installer’s License Required.
(a)It shall be unlawful for any person to
engage in the installation of sewage disposal systems within
the corporate limits of the Town of Estes Park,without first
having procured a license therefor.The requirement for a
license shall not apply to the owner of any property doing
such installation on his own property,provided that he first
obtain the necessary permits therefor and satisfies the
Building Inspector that he is competent to make such in
stallation.
(b)Application for an Installer’s License
shall be made to the Town Clerk,upon forms provided for this
purpose.At the time of making such application,the
applicant shall establish that he is capable of making correct
percolation tests and installing septic tanks and leaching
systems according to the provisions of this Code.
(c)The annual license fee for an
License shall be $35.00 and said license shall expire on
December 31,each calendar year.
(d)An Installer’s License can be revoked by

the Building Inspector upon his conviction of a violation of
any of the provisions of this Code pertaining to the
installation of sewage disposal systems.
(e)The revocation of an Installer’s License
shall be subject to the review of the Board of Trustees of
the Town of Estes Park,provided written application therefor
is filed with the Town Clerk within thirty days after the
date of the revocation.
Section 2.The Board of Trustees herewith finds,
determines and designates that this ordinance is necessary
for the immediate preservation of the public health and
safety for regulation of individual and institutional waste
disposal systems affects the public health and safety,and
whereas in the opinion of the Board of Trustees an emergency
exists,this ordinance shall take effect and be in force
five ()days after its final passage,adoption and
publication.
