ORDINANCE NO.

AN ORDINANCE CREATING AND ORGANIZATION ESTES
PARK GENERAi IMPROV’1ENT SEWER DISTRICT NO.1,
ESTES PARK,COLORADO,AND DECLARING AN EMER
GENCY.
WHEREAS,Petitions for the organization of Estes Park
General Improvement Sewer District No.1,Estes Park,Colorado,
have bean heretofore presented to the Mayor and the Town Board
of said Town;and
WHEREAS,said Petitions are signed by at least a majority
of the taxpaying electors of the proposed district,who,together
with the other owners of property within the district having signed
consents to inclusion,own property therein having a valuation for
assessment of not less than one-half of the valuation for assessment
of all the real and personal property in said district;and
WHEREAS,said Petitions comply fully with the requirements
of Chapter 89,Article 14,Colorado Revised Statutes 1963,as amended;
and
WHEREAS,a Bond has been filed to pay all expenses con
nected with the proceedings in case the organization of the Dis
trict be not effected,which Bond is hereby approved;and
WHEREAS,on,the day of

1969,the Board
of Trustees of said Town adopted a Resolution and entered an Order
authorizing Notic of Hearing on the Petitions for the organization
of said District,said date of Hearing being the 23d day of June,
1969;and
WHEREAS,on the 23d day of June,1969,it was determined
that certain legal technicalities existed which would complicate
matters if the hearing were to be held as scheduled,and therefor
the hearing was adjourned to be rescheduled later;and

WHEREAS,on the lLth day of July,1969,the Board adopted
a Resolution and entered an Order rescheduling said adjourned hear
ing for the 11th day of August,1969,and ordering the publication
and mailing thereof;and
WHEREAS,the Town Clerk of said Town caused Notice by
publication to be made of the pendency of the Petitions,of the.
purposes and boundaries of the proposed District,and of the time
and place of Hearing thereon,such Notice having been published
once a week in four consecutive weekly editions to the Estes Park
Trail,a newspaper published and of general circulation in the
proposed District;and
WHEREAS,the Town Clerk of said Town also caused a copy
of the Notice.of said Hearing to be mailed to each taxpaying elec
tor of the District at his or her last-known address,as disclosed
by the tax records of Larimer County,Colorado;and
WHEREAS,on the 11th day of August,1969,the Board of
Trustees of said Town met at the.Town Hall,in Estes Park,Colorado,
at the hour of 7.o’clock tM.,for the purpose of holding a
Hearing on the Petition for the organization of said District;and
WHEREAS,said Public Hearing was duly held,and the
following persons were heard on the proposal to create the District:

8.Within thirty (30)days after the date of the adoption
of this Ordinance.,the Town Clerk shall submit to the County Clerk
and Recorder of Larimer County,Colorado,and to the County Assessor
of said County,copies of this Ordinance to be filed in said offices.
9.That if any one or more sections or parts of this
Ordinance shall be adjudged unenforceable or invalid,such judg
ment shall not affect,impair or invalidate the remaining provi—
sions hereof,it being the intention that the various provisions
of this Ordinance are.and shall be severable.
10.That by reason of the fact that the area included
within the District is without any adequate and sufficient means
of disposing of sewage wastes,and is in grave need of such facil—
ities and service as will be provided by said District in order to
adequately protect the health and welfare of the inhabitants of
the area,it is hereby determined and deblared that an emergency
exits,and that this Ordinance is necessary to the.immediate
preservation of the public health and safety.
11.That after its passage this Ordinance shall be
published one time in the Estes Park Trail in its edition dated
August 15,1969,and as an Emergency Ordinance shall become ef
fective five (5)days after its publication.
