AN ORDINANCE ANENDING SECTION iL.L{OF ThE
MUNICIPAL CODE OF ThE TOWN OF E$ThS PARK,
COLORADO,THE SAKE PERTAINING TO STORAGE
OF FLAMMABLE OR COMBUSTIBLE LIQUIDS.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF ThE TOWN
OF ESTES PARK,COLORADO:
Section 1.That Section 1L.L of the Municipal Code
of the Town of Estes Park,Colorado is amended by adding
thereto the following:
lL.L-lLj Abandonment or Removal of Underground Tanks.
All underground tanks used for storage of flammable or com
bustible liquids taken out of service shall be safeguarded or
disposed of in the following manner:
a.Methods.
Underground tanks taken out of service
shall be safeguarded or disposed of by any
one of the three following means:
(1)Placed in a Titemporarily out of
serviceTi condition.Tanks shall be
rendered ‘Ttemporarily out of service
only when it is planned that they shall
be returned to active service at the
location within 90 days.
(2)Abandoned in place,with proper
safeguarding.
(3)Removed.
b.Records.
In cases where tanks are either rendered
TTtemporarily out of service”or permanently
abandoned,records shall be kept by the owner
of the property upon which the tanks are lo
cated of the tank size,location,date of

abandonment,and method used for placing the
abandoned tank in a safe condition.With
any of the methods described in subsection
a.above,no cutting torch or other flame
or spark producing equipment shall be used
until the tank has been completely purged or
otherwise rendered safe.In each case,the
proceedures given shall be carried out suc
cessively.
c.Tanks Rendered Temporarily Out of Service.
When tanks are rendered I!temporarily
out of service”,
(1)The fill line,gage opening,and
pump suction shall be capped and secured
against tampering.
(2)The vent line shall be left open.
d.Tanks Abandoned in Place.
When undergound tanks are abandonded in
place,
(1)All flammable or combustible liquid
shall be removed from the tank and from
all connecting lines.
(2)The suction,inlet,gage and vent
lines shall be disconnected.
(3)The tank and any remaining stubs
shall be filled completely with a non-
shrinking inert solid material.
(L1)All tank inlets and outlets shall
be capped.
a.Tanks Removed.
When underground tanks are removed,
(1)All flammable or combustible liquids
in the tank and connecting lines shall be
removed.

(2)The suction,inlet,gage and vent
lines shall be disconnected.Sections
of connecting lines which are not to be
used shall be removed.Inlets,outlets,
and leaks,if any,shall be capped or
plugged.
(3)After removal,the tank shall be
gas freed;on the premises if it can be
done safely at that location,or trans
ported to an area not accessible to the
public and the tank gas freed at that
location.
Section 2.The Board of Trustees herewith finds,
determines and designates that this ordinance is necessary for
the immediate preservation of the public peace,health and
safety,for the regulation of storage of flammable or com
bustible liquids affects the public peace,health and safety,
and whereas in the opinion of the Board of Trustees an emer
gency exists,this ordinance shall take effect and be in force
live ()days after its final passage,adoption and publication.
