HomeMy WebLinkAboutORDINANCE 07-704 ORDINANCE NO.7-70 AN ORDINANCE VACATING A PORTION OF BIG HORN DRIVE,LOCATED ALONG THE NORTH LINE OF LOT 12)4 OF AL FRESCO PLACE,AN ADDITION TO THE TOWN OF ESIES PARK,COLORADO. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That that portion of Big Horn Drive located along the North line of Lot 12)4 of Al Fresco Place, an Addition to the Town of Estee Park,Colorado,according to Amended Plat filed May 17,1910,more particularly described as follows: That portion of Big Horn Drive located along the North line of Lot 12)4 of Al Fresco Place,an Addi tion to the Town of Estee Park,Colorado,according to Amended Plat filed Nay 17,1910,more particu larly described as follows:Beginning at a point that is North 133.68 feet from the SW corner of said Lot 12)4;thence S 8)4°SP E a distance of 53.37 feet to the beginning of a curve to the right with a radius of 50 feet;thence along this curve )43.85 feet to the point of tangency;thence S 3)403513011 E a distance of 31.0 feet to the beginning of a curve to the left with a radius of 108.77 feet; thence along this curve 1)4.81 feet more or less to its intersection with the Southerly right-of-way of Big Horn Drive as shown on said Amended Plat of Al Fresco Place;thence along the street right- of—way N 67°321 W a distance of 126.32 feet to the West line of the Addition;thence North 15.1 feet to the point of beginning; be and the same is hereby vacated. Section 2.The Board of Trustees of the Town of Estes Park herewith finds,determines and declares that said portion of said street is not needed for ingress or egress to or from any property adjacent thereto,and that the con venience of the people will not in any way be affected or impaired by vacating said portion of said street,and that the owner of the land abutting on said portion of said street has duly requested the Board of Trustees to vacate the same. 0 Section 3.The Board of Trustees of the Town of Estes Park,Colorado herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety,and whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication. /c,J May9*Pro Tern / A TTES -2-
