ORDINANCE NO.2-71 AN ORDINANCE AMENDING CHAPTER 12 OF THE MUNICIPAL CODE OF TEE TOWN OF ESTES PARK, COLORADO,RELATING TO ZONING,HEIGHT LIMITATIONS,MINIIVRJM FLOOR SPACE,NINIMUI”I LOT AREA,AND FLASHING SIGNS. BE IT ORDAINED BY TEE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That Section 12.5 of the Municipal Code of the Town of Estes Park,Colorado be and the same is hereby amended to read: 12.5 Zoning Restrictions.Except as hereinafter provided,no building shall be erected,reconstructed,or structurally altered,and no building or land shall be used for any purpose other than is permitted in the zoning district in which such building or land is located.No lot area shall be so reduced or diminished that the yards or other open spaces shall be smaller than prescribed herein,nor shall the lot area be reduced in any manner except in conformity with the area regulations herein established for the zoning district in which such building is located.No yard or other open space provided about any building for the purpose of comply ing with this ordinance shall be considered as providing a yard or other open space for any other building.No building shall exceed a height of thirty (30)feet. Section 2.That Section l2.6-D-3 of the Municipal Code of the Town of Estes Park,Colorado be and the same is hereby amended to read: 12.6-D-3 Lot Area Per Family.For every one-family dwelling there shall be provided a minimum lot area of 9,000 square feet,and for every two-family dwelling a minimum lot area of 13,500 square feet. Section 3.That Section l2.b-D of the Municipal Code of the Town of Estes Park,Colorado be and the same is hereby amended by adding thereto the following: l2.6-D-L Dwelling Area.For every one-family dwell ing there shall be provided a minimum of 600 square feet of floor area on the main floor. Section L.That Section 12.7 of the Municipal Code of the Town of Estes Park,Colorado be and the same is hereby amended by adding thereto the following: 12.7-3 Dwelling Area.For every one-family dwelling there shall be provided a minimum of 600 square feet of floor area on the main floor. Section 5.That Section 12.7 of the Municipal Code of the Town of Estes Park,Colorado be and the same is hereby amended by adding thereto the following: l2.7-L Lot Area Per Family.Two times the total floor area of the building but not less than 7,000 square feet for a one-family dwelling or a two-family dwelling, plus 1,000 square feet for every dwelling unit in excess of two.For permitted uses (3)through (5)the area shall not be less than 16,000 square feet. Section 6.That Section 12.12-2 of the Municipal Code of the Town of tstes Park,Colorado be and the same is hereby amended by adding thereto the following: 12.12-2 (iL.)Flashing Signs.Flashing signs of any type are prohibited;provided,that the provisions of Section 12.12-2 (6)shall apply to all existing flashing signs. Section 7.The Board of Trustees of the Town of Estes Park herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety,for the regulation of zoning affects the public peace,health and safety,and -2- © whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five ()days after its final passage,adoption and publication. / / -/1, Nyor -3-
