HomeMy WebLinkAboutORDINANCE 29-71Q 0 ORDINANCE NO.29-71 AN ORDINANCE AHENDING SECTIONS 12.2-2, 12.6-D-1,12.7-1 AND 12.12-1 (2)OF THE MGNICIPAL CODE OF THE TOWN OF ESThS PARK, COLORADO,RELATING TO ZONING AND UNIT DEVELOPNENTS. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That Section 12.2-2 of the Municipal Code of the Town of Estes Park,Colorado,is amended by adding thereto the following: 12.2-2 Specific 1Tords and Terms. Unit Development:A unit development is a project located on at least three acres of land,including common open space for the mutual benefit of the entire tract,and is designed to provide variety and diversity through the variance of normal zoning and subdivision standards so that maximum long range benefits can be gained and the unique features of the development or site preserved and enhanced, while still being in harmony with the surrounding neighbor hood. Common Open Space:The area of a unit development 1ci for common use and enjoyment by the residents of the unit development including walkways,but not including off-street parking areas,streets or driveways. Section 2.That Section l2.6-D-l of the Municipal Code of the Town of Estes Park,Colorado,is amended by adding thereto the following: l2.6-D-l Use Restrictions. 9.Uses permitted by special review. Unit Development Section 3.That Section 12.7-1 of the Municipal Code of the Town of Estes Park,Colorado,is amended by adding thereto the following: 0 12.7-1 Use Restrictions. 6.Uses permitted by special review. Unit Development Section L.That Section 12.12-1 (2)of the Municipal Code of the Town of Estes Park,Colorado,is amended by adding thereto the following: 12.12-1 (2)Uses Permitted by Special Review. B.Special Considerations. (1)Unit Developments.Unit developments as defined in Section 12.2 may be located in R-l end R—2 Districts. Where buildings are located in a unit development,the minimum area of a lot, minimum width of a lot and yard require ments may be varied as specified on the recorded unit development plan,provided the required yard requirements of the district shall apply on the boundaries of a unit development wherever it is adjacent to or across the street from a residential area having normal setbacks as required by the Zoning District. In addition,the unit development shall be subject to the following special conditions. (a)The proposed unit development shall include an area of not less than three acres. (b)The tract,parcel or lot of land involved shall be either in one ownership or the subject of an application filed jointly by the owners of all the property to be included. -2- (c)Residential densities shall not exceed the following: R—l Residence District —three dwelling units per acre. R-2 Residence District -thirteen dwelling units per acre. (d)Common open space shall not be less than 30 per cent of the total area. (e)Areas and facilities of joint use shall be retained in title by the developers,or deeded to an organization composed of the owners of the development in order that mutually owned property may be properly controlled and maintained. (f)Following approval by the Board of Trustees,and before a building permit is issued,the unit develop ment plan shall be filed with the Town Clerk. (g)A unit development plan may be amended by the addition of adjacent :3 land (which may be less than two acres in size)or the original design may be amended,provided all procedures followed are the same as those required for initial approval and provided the basic concept of the plan is preserved. (h)A minimum of two off-street parking spaces shall be provided for each -3- 0 dwelling unit.A garage,car port or a driveway shall be considered as two off-street parking spaces; provided they,or any two of them, areof sufficient size to permit the parking of two vehicles therein or thereon. fi)All unit developments shall be served by a public or private sanitary sewer system which has been approved by the Town,the Larimer County Health Department, and The Park Sanitation District when the property is served by said District. Section .The Board of Trustees herewith finds, determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety for the regulation of zoning affects the public peace,health and safety,and whereas in the opinion of the Board of Trustees an emergency exists,this ordinance shall take effect and be in force five ()days after its final passage,adoption and publication.
