ORDINANCE NO.25-71
AN ORDINANCE TO LEASE-OPTION CERTAIN LAND
FOR GOVERNMENTAL OR PROPRIETARY PURPOSES
AND PRESCRIBING THE TERMS RELATING TO
EXPENSES OF SAID LAND AND OPERATION OF
SAID LAND AND AUTHORIZATION TO ENTER INTO
SAID LEASE-PURCHASE.
WHEREAS,under the constitution and the laws of the
State of Colorado as heretofore and now in force the Town
of Estes Park has authority to establish and regulate the
use of the streets and public places and traffic thereon,
and to construct,maintain and operate public parking
facilities,and
WHEREAS,by reason of the growth of the Town of
Estes Park it has become necessary to obtain additional
property for governmental or proprietary purposes.
WHEREAS,under the provisions of Article 61,Chapter
139 of the Colorado Revised Statutes,1963,authority is
granted,in order to provide necessary land for governmental
or proprietary purposes,to enter into long term rental or
leasehold agreements with an option or options to purchase
and acquire title to such leased property.
NOW THEREFORE,BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE TOWH OF ESTES PARK,COLORADO:
Section 1.That the Town of Estes Park elects to
act under the authority of Article 61,Chapter 139,Colorado
Revised Statutes,1963,to enter into a lease-option agreement
for governmental or proprietary purposes.
Section 2.That the Mayor and Town Clerk be and
they are hereby authorized and directed to execute and seal
on behalf of the Town of Estes Park the proposed lease now
on file with the Town Clerk between School District No.R-3,
in the County of Larimer and State of Colorado and the Town
of Estes Park,Colorado.

Section 3.That all of the rent provided for in
the lease referred to in Section 2 above and all expenses
of every kind and nature incurred by the Town of Estes Park
in the operation and maintenance of said land shall be paid
from the General Fund of the Town.
Section L.In the opinion of the Board of Trustees
of the Town of Estes Park,Colorado,the leasing of land
for governmental or proprietary purposes is necessary for
the immediate preservation of the public peace,health and
safety of the Town of Estes Park for by reason of the growth
of the Town of Estes Park it has become necessary to obtain
additional property for governmental or proprietary purposes,
and whereas in the opinion of the Board of Trustees an
emergency exists,this ordinance shall take effect and be
in force thirty (30)days after its final passage,adoption
and publication.

day of October,1971.
