ORDINANCE NO.16-72
AN ORDINANCE AMENDING SECTION 6.21 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,RELATING TO METERED WATER SERVICE.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.That Section 6.21 of the Municipal Code
of the Town of Estes Park,Colorado,be and the same is
hereby amended to read as follows:
6.21 Metered Service.
6.21—1 Definitions.As used herein,the following
words and phrases are defined as follows:
(a)Consumer:The person in whose name a water
account is carried in the Town’s records.
(5)Commercial:Any use of water for other
than single family dwelling purposes.The words “dwelling”
and “family”shall have that meaning as said words are
defined in the Uniform Building Code adopted by Section 11.1
of the Municipal Code of the Town of Estes Park,Colorado.
6.21—2 Board of Trustees Order Metered Service.
Any service may be metered when in the judgment of the Board
of Trustees the same is necessary or beneficial.
6.21—5 Commercial Consumers Metered.All commercial
water consumer services shall be metered.
6.21-4 Water Meter Installation and Cost.The Town
Water Superintendent shall determine the type,make,size and
location of all meters installed.The cost of all water meters
and their installation shall be charged to the consumer,and
paid for by the consumer as provided in this chapter for the
payment of water rent.In the event said charges shall not
be paid when due,the provisions and procedures of this chapter
pertaining to delinquent water rent shall apply to said
delinquent water charges.

6.21—5 Consumer Liable for Damage to Meter.All
consumers shall be liable for any damage to a water meter
caused by freezing or the willful or negligent acts of the
consumer.All such damages shall be charged to and paid for
by the consumer as provided in this chapter for the payment
of water rent.In the event said damages shall not be paid
when due,the provisions and procedures of this chapter
pertaining to delinquent water rent shall apply to all unpaid
charges for such damages.
Section 2.The Board of Trustees of the Town.of
Estes Park,Colorado,herewith finds,determines and
designates that this ordinance is necessary for the immediate
preservation of the public peace,health and safety for the
regulation of water service affects the public peace,health
and safety,and whereas in the opinion of the Board of Trustees
an emergency exists,this ordinance shall take effect and be
in force five (5)days after its final passage,adoption and
publication.
