ORDINANCE NO.9-72
AN ORDINANCE AUTHORIZING THE SALE OF LOT 5 AND THE
EAST 95.0 FEET OF LOT 6,BUENNA VISTA TERRACE IN
THE TOWN OF ESTES PARK,COLORADO,AND AUTHORIZING
THE EXECUTION OF ALL NECESSARY INSTRUMENTS TO COM
PLETE THE SALE.
WHEREAS,under the laws of the State of Colorado,as hereto
fore and now in force the Town of Estes Park has authority by Ordinance
to sell and dispose of real estate owned by the Municipality upon such
terms and conditions as the Board of Trustees may determine.
WHEREAS,by reason of the acquisition by the Town of Estes
Park of certain other real property,the real property herein below
described is no longer needed by the Town of Estes Park for any purpose,
and
WHEREAS,the real property herein below described is not now
being used,nor has it ever been used,for a governmental purpose,and
WHEREAS,under the provisions of Article 32,Chapter 139 of
the Colorado Revised Statutes,1963,authority is granted to sell and
dispose of real estate owned by the Municipality upon such terms and
conditions as the Board of Trustees may determine,
NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF ESTES PARK,COLORADO:
Section 1.That the following described real property owned
by the Town of Estes Park,Colorado,situate in Larimer County,Colorado,
to —wit:
Lot 5 and the East 95.0 feet of Lot 6 in recorded
plat of Buenna Vista Terrace,a subdivision in the
Southeast Quarter of the Northwest Quarter lying
South of Fall River in Section 25,Township 5 North,
Range 73 West of the 6th P.M.,now known as Lots 5
and the East 95.0 feet of Lot 6,Buenna Vista Terrace
in the Town of Estes Park,Colorado.EXCEPT that
portion conveyed by Special Warranty Deed Recorded
in Book 1012,Page 456,Larimer County,Colorado
Records.
is hereby authorized to be sold to James H.Swickard and Nancy E.
Swickard for a total consideration of $66,000.00,payable as follows:

$5,000.00 upon the signing of an Agreement,$25,000.00 on or before
March 14,1972,and the balance of $36,000.00 on or before March 14,
1974.
Section 2.That the Mayor and the Town Clerk be,and they
hereby are,authorized and directed to execute in behalf of the Town
of Estes Park,Colorado,an Agreement for the sale of said property,
and a Warranty Deed conveying all of the Town of Estes Park’s right,
title and interest in and to said real property,in accordance with
the terms and conditions set forth in said Agreement,and to execute
all other necessary documents to complete the sale,and to accept,
in behalf of the Town of Estes Park,the sale price for said real
property.
Section 3.The Board of Trustees herewith find,determine
and declare that the above described property authorized to be sold
is no longer needed by the Town of Estes Park for any purpose,and is
not now being used,nor has it ever been used for a governmental
purpose.
Section 4.The Board of Trustees of the Town of Estes Park
herewith finds and determines that whereas in the opinion of the Board
of Trustees an emergency exists,this ordinance shall take effect and
1e in force five (5)days after its final passage adoption and publica
tion.
