HomeMy WebLinkAboutORDINANCE 09-73Q ORDINANCE NO.9-73 AN ORDINANCE ANENDING SECTIONS 16.28.020 AND 16.28.060 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORA]DO,RELATING TO ANNEXATION AND SUBDIVISION MAPS OR PLATS. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Section 16.28.020 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 16.28.020 Legibility,size and border.The final annexation map or subdivision plat,including all drawings and signatures,shall be clearly and legibly drawn in black waterproof ink on tracing cloth or acetate material of a good quality,or on mylar.Each sheet shall be twenty—four inches by thirty-six inches in size with a marginal line one inch from each edge.The title,all drawings,affidavits,certifi cates,acknowledgments,endorsements,acceptances of dedication, and notarial seals shall be within the marginal lines.The original,a mylar reproducible copy and eight copies shall be filed in the office of the town clerk. Section 2.Section 16.28.060 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 16.28.060 Dedications.The form of all dedications, together with the acknowledgment,shall be as follows: “KNOW ALL PiEN BY THESE PRESENTS that ________, being the owners of the following described property located in Section ______, Township ____ North,Range ______ West of the 6th P.M.,being more particularly described as follows: (insert description) do hereby subdivide the same into lots and blocks,recreation areas,passageways,streets,future streets,utility and other 0 0 easements as shown on this Nap (Plat);*and do hereby designate and dedicate all such recreation areas,parks,passageways, streets,future streets and easements,other than utility ease ments,to and for public use,all such utility easements to and for public use for the installation and maintenance of utility, irrigation and drainage facilities;and do hereby designate the same as _________________ Addition to the Town.of Estes Park, Colorado.(or ____________ Subdivision of _________ Addition to the Town of Estes Park,Coloradoj* *(Use portion in parenthesis when not an annexation map.) (Insert here the following when the lots will not be served by a public,or approved sewage disposal system.) “This addition (subdivision)*is not provided with Public Sewer Facilities.Permits must be obtained before the installation of any sanitary disposal system.Approval of plat does not guarantee that the size of soil conditions of any lot shown hereon are such that a sewage disposal permit may be issued.It is also hereby agreed by the Subdivider, his heirs,successors,and assigns,that in the event that the proper authorities of the Larimer County Health Department shall determine that the surface or subsurface water in the area is becoming contaminated by the use of septic tanks,the owners of the properties in the addition (subdivision)*shall install,at their own expense,a commercial or private sewage disposal system.This is a covenant running with the land.
