ORDINANCE NO.5-73
AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF THE T0N OF ESTES PARK,COLORADO,
RELATING TO THE PLANNING CO11MISSION.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.The Municipal Code of the Town of Estes
Park,Colorado,is hereby amended by adding thereto the
following:
Commission Established,Term,Powers.There is hereby
established a planning commission of seven members for the
town of Estes Park,Colorado,and designated as the “Town
Planning Commission.”The town planning commission shall
have and exercise all of the powers and duties set forth in
Article 59,Chapter 139,Colorado Revised Statutes,1963,or
any subsequent amendment thereto.The membership of such
commission shall be determined and appointed in the following
manner:Two members of the board of trustees,to be selected
by the mayor;a member of the board of trustees,to be selected
by the board of trustees;an administrative official of the
town,to be selected by the mayor;and three members to be
appointed by the mayor.All members of such commission shall
be bona fide residents of the town of Estes Park,and if any
member ceases to reside in the town his membership on said
commission shall immediately terminate.There shall be three
ex officio members consisting of the members of the board of
trustees.
All members of the commission shall serve as such
without compensation,and the appointed members shall hold
no other municipal office,except that one such appointed
member may be a member of the zoning board of adjustment.
The terms of the ex officio members shall correspond to
their official tenures.The term of the administrative
official selected by the mayor shall terminate with the term
of the mayor selecting him.The term of all other members
shall be six years or until his successor takes office.
Members other than the member selected by the board of trustees
may be removed,after public hearing,by the mayor for
inefficiency,neglect of duty or malfeasance in office.The
mayor,or the board of trustees,as the case may be,shall
file written statements of reasons for such removal.Vacancies
occurring otherwise than through the expiration of term shall
be filled for the remainder of the unexpired term by the
mayor in the case of members selected or appointed by him
or by the board of trustees in the case of a member selected
by them.
Order of Business.The order of business at all
regular meetings of the commission shall be as follows:
(a)Approval of minutes of previous meetings.
(b)At the first meeting in January each year there
shall be held an election of a chairman,vice
chairman and secretary as the officers of the
commission.
Cc)Unfinished business.
(d)New business.
(1)Zoning and special review hearings.
(2)Annexation and subdivision maps.
(3)General business.
Procedure.(a)Petitions,applications,maps,plats
and site plans.All petitions for rezoning and applications
for special review shall be in writing,signed by the property
owners and lien holders or their duly authorized representatives,
as evidenced by a duly executed and acknowledged power of
attorney,and filed in duplicate in such form as may be pre
scribed by the planning commission.All annexation maps,
subdivision plats and site plans shall contain the information

and be filed in the form and quantity as provided in the
Municipal Code of Estes Park and the Statutes of the State
of Colorado.All final maps,plats or site plans shall be
signed by all property owners and lien holders who have any
interest in the land shown thereon,or by their duly authorized
representatives,as evidenced by a duly executed and acknowl
edged power of attorney filed therewith,and by the surveyor
preparing the same,and all signatures shall be acknowledged
as provided in this code.
(b)Filing and time computation.All petitions for
rezoning,applications for special review,annexation maps,
subdivision plats and site plans shall be filed with the
town clerk at least twenty—one (21)calendar days prior to
the meeting at which they are to be heard or considered by
the planning commission.In computing any period of time
prescribed or allowed by this code,the day of the meeting
shall not be included.The first day of the period so
computed shall be included,unless it is a Saturday,or a
Sunday,or a legal holiday,in which event the filing may be
made until the end of the next day which is not a Saturday,
a Sunday,or a legal holiday.
Section 2.The present members and officers of the
town planning commission shall continue to serve as commission
members until the expiration of the terms for which they are
selected or appointed.
Section 5.The board of trustees of the town of Estes
Park,Colorado,herewith finds,determines and designates that
this ordinance is necessary for the immediate preservation of
the public peace,health and safety for planning affects the
public peace,health and safety,and whereas in the opinion
of the board of trustees an emergency exists,this ordinance

shall take effect and be in force five (5)days after its
final passage,adoption and publication.
