HomeMy WebLinkAboutORDINANCE 29-73ORDINANCE NO.29-73 AN ORDINANCE AMENDING CHAPTER 12.20 OF THE MUNICIPAL CODE OF THE TON OF ESTES PARK,COLORADO,RELATING TO THE REMOVAL OF SNOW AND ICE FROM SIDEWALKS AND THE ASSESSMENT OF COSTS THEREFOR. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Section 12.20.060 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 12.20.060 Removal of snow and ice.It shall be unlawful for any owner,tenant or agent in charge of any lot, block or parcel of real property within the town to allow any snow or ice,or both,to accumulate or remain upon any side walk along such property longer than twenty—four hours from the last accretion of such snow or ice,or both,provided no snow shall be allowed to accumulate to a depth of three inches above the sidewalk at any one time within any twelve hour period of time. Section 2.Chapter 12.20 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended by adding thereto the following: Removal——Notice——by town——Assessment.If any person shall fail to comply with Section 12.20.060,in addition to the penalty provided therefor,a written notice may be served upon the owner,tenant or agent in charge of such property requiring the removal of such snow or ice,or both.If the snow or ice,or both,is not removed within twenty—four hours after the service of such notice,the town may remove the snow or ice,or both,and assess the whole cost thereof, including five percent (5%)for inspection and other incidental costs in connection therewith,upon the lot,block or parcel of real property from which the snow or ice,or both,is removed. 0 0 Such notice shall be served by delivering a copy thereof to such owner,tenant or agent in charge,or by leaving such copy with some person,above the age of fifteen years,who is a member of such owner’s,tenant’s or agent’s family and residing with such owner,tenant or agent,or,in case no one is on the property from which the snow or ice,or both,is to be removed or at the residence of such owner,tenant or agent in charge,if within the town,then by posting such copy in some conspicuous place on the property from which the snow or ice,or both,is to be removed.The assessment shall be a lien against each such lot,block or parcel of real property until paid and shall have priority over all other liens except general taxes and prior special assessments.If such assess ment is not paid within thirty days after it is made,the assessment shall be certified by the town clerk to the treasurer of Larimer County,Colorado,who shall collect the assessment, together with a ten percent (10%)penalty for cost of collection, in the same manner as other taxes are collected.The laws of the state for assessment and collection of general taxes, including the laws for the sale and redemption of property for taxes shall apply to the collection of such assessment.
