HomeMy WebLinkAboutORDINANCE 19-740 0 ORDINANCE NO.19-74 AN ORDINANCE REGULATING BUILDING IN THE TOWN OF ESTES PARK,COLORADO;ADOPTING BY REFERENCE THE UNIFORN BUILDING CODE, 1973 EDITION;AIVIENDING SECTIONS 14.12.010, 14.12.020,14.12.030 AND 14.12.040 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO;AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Adoption.--—The Uniform Building Code, 1973 Edition,issued by the International Conference of Building Officials,5360 South Workman Mill Road,Thittier, CA 90601,at least three copies of which have been certi fied as true copies by the mayor and town clerk,Estes Park, Colorado,and which are now on file in the office of the town clerk,is hereby enacted,adopted by reference,incorpo rated herein and made a part of the Municipal Code of the town of Estes Park,Colorado,as hereinafter provided.The said Uniform Building Code is a complete code which governs the construction,alteration,moving,demolition,repair,and use of any building or structure within the town of Estes Park,Colorado,except work located primarily in a public way, public utility towers and poles,mechanical equipment not specifically regulated in this Code,and hydraulic flood con trol structures.Its purpose is to provide minimum standards to safeguard life or limb,health,property,and public wel— fabe by regulating and controlling the design,construction, quality of materials,use and occupancy,location and mainte nance of all buildings and structures within the town and certain equipment specifically regulated therein. Section 2.Additions and Modifications.———The said adopted Code is subject to the following additions or modi fications:The first paragraphs of Sections 3O2.(a)and 303.(a),and the second paragraph of Section 3O3.(b)are modified to read as follows: 0 Sec.302.(a)Issuance.The application,plans, and specifications filed by an applicant for a permit shall be checked by the Building Official.Such plans may be reviewed by other departments of the town to check compliance with the laws and ordinances under their jurisdiction.If the Building Official is satisfied that the work described in an application for permit and the plans filed therewith conform to the requirements of this Code and other pertinent laws and ordinances;that all provisions of the Ordinances and of the Municipal Code of the town of Estes Park that pertain to the land,or the use thereof,described in said application have been complied with;and that the fee speci fied in Section 303 (a)has been paid,he shall issue a permit therefor to the applicant. Sec.303.(a)Building Permit Fees.A fee for each building permit shall be paid to the Building Official as hereinafter set forth: 1.Five and one—half cents (5-Ø)per square foot for all one (1)or two (2)family dwellings,including basements located therein,if plumbing and electric lines are roughed in. 2.Two cents (2)per square foot for all accessory buildings,including private garages and basements, located in one (1)or two (2)family dwellings,if electric service only is roughed in. 3.Definitions.For the purposes of sub- paragraphs 1 and 2 above,certain words are defined as follows: ACCESSORY BUILDING:A subordinate building or portion of main building the use of which is incidental to that of the main building. DWELLING:A detached bu±lding designed for,or occupied by,one or more families. —2— a GARAGE,PRIVATE:A building designed and used for the housing of not more than three motor—propelled vehicles. 4.All other building permit fees shall be as set forth in Section 303(a). Sec.305.(5) Said plan—checking fees for build ings of Groups I and J Occupancies shall be one—half of the building permit fees.Plan-checking fees for all other buildings shall be 65 percent of the building permit fees as set forth in Section 505(a). Section 5.That Sections 14.12.010,14.12.020, 14.12.050 and 14.12.040 of the Municipal Code of the Town of Estes Park,Colorado,are hereby amended to read as follows: 14.12.010 Adoption by reference.The Uniform Building Code,1973 Edition,issued by the International Conference of Building Officials,5560 South Workman Mill Road,Whittier, CA 90601,of which three copies are now filed in the office of the town clerk,and may be inspected during regular busi ness hours,is enacted,adopted by reference as a secondary code and incorporated herein as if set out in length.The subject matter of the Uniform Building Code,is a complete code which governs the construction,alteration,moving, demolition,repair and use of any buildings and structures within the town.The purpose of this Code is to provide minimum standards to safeguard life or limb,health,property and public welfare by regulating and controlling the design, construction,quality of materials,use and occupancy,loca tion and maintenance of all buildings and structures within the town,and certain equipment specifically regulated there in. 14.12.020 Section 502(a)amended——Permit issuance. The first paragraph of Section 302(a)of the Uniform Building —5— Code,1975 Edition,is amended to read as follows: “Sec.502.(a)Issuance.The application,plans, and specifications filed by an applicant for a permit shall be checked by the Building Official.Such plans may be reviewed by other departments of the town.to check compliance with the laws and ordinances under their jurisdiction.If the Building Official is satisfied that the work described in an applica tion for permit and the plans filed therewith conform to the requirements of this Code and other pertinent laws and ordi nances;that all provisions of the Ordinances and of the Municipal Code of the town of Estes Park that pertain to the land,or the use thereof,described in said application have been complied with;and that the fee specified in Section 505 (a)has been paid,he shall issue a permit therefor to the applicant.” 14.12.050 Section 505(a)and (b)amended——Building permit fees.The first paragraph of Section 505(a)and second paragraph of Section 505(b)of the Uniform Building Code,1975 Edition,are amended to read as follows: “Sec.505.(a)Building Permit Fees.A fee for each building permit shall be paid to the Building Official as hereinafter set forth: 1.Five and one—half cents (5ø)per square foot for all one (1)or two (2)family dwellings,including basements located therein,if plumbing and electric lines are roughed in. 2.Two cents (2)per square foot for all accessory buildings,including private garages and basements, located in one (1)or two (2)family dwellings,if electric service only is roughed in. 5.Definitions.For the purposes of sub paragraphs 1 and 2 above,certain words are defined as fol lows: -4- 0 ACCESSORY BUILDING:A subordinate build ing or portion of main building the use of which is incidental to that of the main building. (b)Every person convicted of a violation of any provision stated or adopted in the Uniform Building Code, 1973 Edition,shall be punished as set forth in Section 1.20. 020. Section 4.Penalties.———The following penalties, herewith set forth in full,shall apply to this ordinance: (a)It is unlawful for any person to violate any of the provisions stated or adopted in this ordinance. (b)Every person convicted of a violation of any provision stated or adopted in this ordinance shall be punished by a fine not exceeding Three Hundred Dollars ($soo.oo),or by imprisonment not exceeding ninety (90)days or by both such fine and imprisonment. (c)Vhere any violation is a continuing offense, —5— 0 each day that the violation continues shall be considered and held to be a separate and distinct offense. Section 5.Validity.———If any part or parts of this ordinance are for any reason held to be invalid,such decision shall not affect the validity of the remaining portions of this ordinance.The board of trustees hereby declares that it would have passed this ordinance and each part or parts thereof,irrespective of the fact that any one part or parts be dedred invalid. Section 6.Repeal.———Existing ordinances or parts of ordinances covering the same matters as embraced in this ordi nance are hereby repealed and all ordinances or parts of ordi nances inconsistent with the provisions of this ordinance are hereby repealed,except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or commited in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 7.Interpretation.———This ordinance shall be so interpreted and construed as to effectuate its general pur pose of providing a just,equitable and practicable method for the construction,alteration,moving,demolition,repair, and use of any building or structure within the town of Estes Park,Colorado.Article and section headings of the Ordinance and the adopted Uniform Building Code,1975 Edition,shall not be deemed to govern,limit,modify or in any manner affect the scope,meaning or extent of the provisions of any article or or section thereof. Section 8.Publication.———The town clerk shall certify to the passage of this ordinance,cause notice of its contents and passage to be published,and make not less than three copies of adopted Code available for inspection by the public during regular business hours. Section 9.Effective Date.———The board of trustees of —6— 0 0 the town of Estes Park,Colorado,herewith finds,determines and designates that this ordinance is necessary for the im mediate preservation of the public peace,health and safety, for the regulation of the construction,alteration,moving, demolition,repair and use of buildings and structures affects the public peace,health and safety,and whereas in the opinion of the board of trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication.
