Home My WebLink AboutORDINANCE 17-740 0 ORDINANCE NO.17-74 AN ORDINANCE REGULATING THE ERECTION, INSTALLATION,ALTERATION,REPAIR, RELOCATION,REPLACEJVfENT,ADDITION TO, USE,OR MAINTENANCE OF ANY HEATING, VENTILATING,COOLING,REFRIGERATION SYSTEMS,INCINERATORS OR OTHER MISCEL LANEOUS HEAT-PRODUCING APPLIANCES; ADOPTING BY REFERENCE THE UNIFORM MECHANICAL CODE,1975 EDITION;AMENDING SECTION 14.16.010 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO; AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Adoption.--—The Uniform Mechanical Code, 1975 Edition,issued by the International Conference of Building Officials,5560 South Workman Mill Road,Whittier, CA 90601,at least three copies of which have been certi fied as true copies by the mayor and town clerk,Estes Park, Colorado,and which are now on file in the office of the town clerk,is hereby enacted,adopted by reference,incorporated herein and made a part of the Municipal Code of the town of Estes Park,Colorado,as hreinafter provided.The said Uniform Mechanical Code is a complete code which governs the erection,installation,alteration,repair,relocation,re placement,addition to,use,or maintenance of any heating, ventilating,cooling,refrigeration systems,incinerators or other miscellaneous heat—producing appliances within the town of Estes Park,Colorado.Its purpose is to provide minimum standards to safeguard life or limb,health,property and public welfare by regulating and controlling the design, construction,installation,quality of materials,location, operation,and maintenance of heating,ventilating,cooling, refrigeration systems,incinerators and other miscellaneous heat—producing appliances. Section 2.That Section 14.16.010 of the Municipal 0 0 Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 14.16.010 Adoption.The “Uniform Mechanical Code,” issued by the International Conference of Building Officials, 5360 South Workman Mill Road,Whittier,CA 90601,of which three copies are now filed in the office of the town clerk, and may be inspected during regular business hours,is enacted, adopted by reference as a secondary code and incorporated here in as if set out in length.The subject matter of the Uniform Mechanical Code relates to the erection,installation,alter ation,repair,relocation,replacement,addition to,use,or maintenance of any heating,ventilating,cooling,refrigeration systems,incinerators or other miscellaneous heat—producing appliances within the town.The purpose of the Code is to provide minimum standards to safeguard life or limb,health, property and public welfare by regulating and controlling the design,construction,installation,quality of materials, location,operation and maintenance of heating,ventilating, cooling,refrigeration systems,incinerators and other miscellaneous heat—producing appliances. Section 3.Penalties.———The following penalties, herewith set forth in full,shall apply to this ordinance: (a)It is unlawful for any person to violate any of the provisions stated or adopted in this ordinance. (b)Every person convicted of a violation of any provision stated or adopted in this ordinance shall be punished by a fine not exceeding Three Hundred Dollars ($300.00),or by imprisonment not exceeding ninety (90)days or by both such fine and imprisonment. (c)Where any violation is a continuing offense, each day that the violation continues shall be considered and held to be a separate and distinct offense. Section 4.Validity.-——If any part or parts of this —2— 0 0 ordinance are for any reason held to be invalid,such decision shall not affect the validity of the remaining portions of this ordinance.The board of trustees hereby declares that it would have passed this ordinance and each part or parts j thereof,irrespective of the fact that any one part or parts irrespective of the fact that any one part or parts be declared invalid. Section 5.Repeal.———Existing ordinances or parts of ordinances covering the same matters as embraced in this ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed,except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 6.Interpretation.---This ordinance shall be interpreted and construed as to effectuate its general pur pose of providing proper regulations for the erection,in stallation,alteration,repair,relocation,replacement, addition to,use,or maintenance of any heating,ventilating, cooling,refrigeration systems,incinerators or other miscel laneous heat—producing appliances.Article and section headings of the Ordinance and adopted Uniform Mechanical Code,1975 Edition,shall not be deemed to govern,limit,modify or in any manner affect the scope,meaning or extent of the pro visions of any article or section thereof. Section 7.Publication.—-—The town clerk shall cer tify to the passage of this ordinance,cause notice of its contents and passage to be published,and make not less than three copies of the adopted Code available for inspection by the public during regular business hours. Section 8.Effective Date.-——The board of trustees of the town of Estes Park,Colorado,herewith finds,determines —5— 4,,, and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety, for the regulation of the erection,installation,alteration, repair,relocation,replacement,addition to,use,or rnainte— nance of any heating,ventilating,cooling,refrigeration osystems,incinerators or other miscellaneous heat—producing appliances within the town affects the public peace,health and safety,and whereas in the opinion of the board of trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication.
