HomeMy WebLinkAboutORDINANCE 06-740 0 ORDINANCE NO.6 -74 AN ORDINANCE AMENDING SECTIONS 2.64.010 AN]D 2.64.020 OF THE MUI’ICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,RELATING TO APPOINTMENT OF THE PLANNING COMMISSION. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Section 2.64.010 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 2.64.010 Appointment.There is established a planning commission of seven members for the town of Estes Park,Colorado,designated as the “town planning commission.” The town planning commission shall have and exercise all of the powers and duties set forth in Article 59,Chapter 159, Colorado Revised Statutes,1963,or any subsequent amendment thereto.The membership of such commission shall be deter mined and appointed in the following manner:Seven members who shall be appointed by the mayor subject to the approval of the board of trustees.Three of such members shall be ex officio members who are members of the board of trustees. All members of such commission shall be bona fide residents of the town of Estes Park.If any member ceases to reside in the town,his membership on the commission shall terminate immediately. Section 2.Section 2.64.020 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 2.64.020 Terms——Vacancies.All members of the commission shall serve without compensation.The appointed members shall hold no other municipal office,except that one such member may be a member of the zoning board of adjustment and except the three ex officio members.The terms of ex officio members shall correspond to their respective official tenures. The terms of all other members shall be six years or until their successors take office,except that the respective term of one of the members first appointed shall be two years;the respective term of one of the members first appointed shall be four years;and the respective terms of two of the members first appointed shall be six years.Members other than the members representing the board of turstees may be removed after public hearings,by the mayor,for inefficienty,neglect of duty or malfeasance in office.The mayor or the board of trustees,as the case may be,shall file a written statement of reasons for such removal.Vacancies occurring otherwise than through the expiration of term shall be filled for the remainder of the unexpired term by the mayor,subject to the approval of the board of trustees. Section 5.The board of trustees of the town of Estes Park,Colorado,herewith finds,determines and desig nates that this ordinance is necessary for the immediate preservation of the public peace,health and safety,for plan ning and the planning commission affects the public peace, health and safety,and whereas in the opinion of the board of trustees an emergency exists,this ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication.
