HomeMy WebLinkAboutORDINANCE 02-740 Q ORDINANCE NO.2-74 AN ORDINANCE AIVrNDING CHAPTERS 17.08, 17.16,17.20,17.24,17.28 AND 17.40 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,RELATING TO ZONING DEFI NITIONS,PERMITTED USES,DWELLING AREA, LOT AREA PER FAMILY AND MINIMUM LOT WIDTH. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Section 17.08 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended by adding thereto the following: 17.08.280 Tourist accommodation unit.“Tourist accommodation unit”means a room,in a building,without cooking facilities,which is designed for or occupied by any number of persons temporarily residing together in the room as a single unit,but shall not include a group of more than four individuals not related by blood,marriage or adoption. Section 2.Sections 17.16.060,17.20.060,17.24.020 5.,17.24.040,17.24.050,17.24.060,17.28.050 and 17.40.060 of the Municipal Code of the Town of Estes Park,Colorado, are hereby amended to read as follows: 17.16.060 Minimum lot width.Every lot shall have a width of not less than thirty feet as measured along the front lot line,as such line is defined in Chapter 16 of this code,and a width of not less than seventy—five feet as measured along the lot setback,as such setback is defined in Chapter 16 of this code,which may be more than the mini mum set forth within this chapter.Corner lots shall be at least one hundred twenty feet in width at the front setback line. 17.20.060 Minimum lot width.Every lot shall have a width of not less than thirty feet as measured along the C a front lot line,as such line is defined in Chapter 16 of this code,and a width of not less than seventy—five feet as measured along the lot setback,as such setback is defined in Chapter 16 of this code,which may be more than the mini mum set forth within this chapter.Corner lots shall be at least one hundred twenty feet in width at the front setback line. 17.24.020 Permitted uses. 5.Tourist accommodations required and used by tourists,including the following and none other: a.Rental cabins,tourist homes and resort cabins. b.Lodges,boarding and lodging accommodations, hotels and motels. 17.24.040 Dwelling area.A minimum of six hundred square feet of floor area on the main floor of each family dwelling unit shall be provided for each family to occupy the building. 17.24.050 Lot area per family.The lot area per family shall be two times the total floor area of the building but not less than eighteen thousand square feet for a one family dwelling or a two family dwelling,plus two thousand five hundred seventy square feet for every dwelling unit in excess of two.For permitted uses,Section 17.24.050 5.b., the area shall not be less than twenty-five thousand nine hundred square feet for the first two tourist accommodation units,plus two thousand five hundred seventy feet for each tourist accommodation unit in excess of two.For permitted uses,Section 17.24.020 4.and 5.,the area shall not be less than twenty—five thousand nine hundred square feet. 17.24.060 Minimum lot width.Every lot shall have a width of not less than thirty feet as measured along the front lot line,as such line is defined in Chapter 16 of —2— 0 0 this code,and a width of not less than seventy—five feet as measured along the lot setback,as such setback is defined in Chapter 16 of this code,which may be more than the minimum set forth within this chapter.Corner lots shall be at least one hundred twenty feet in width at the front setback line. 17.28.050 Minimum lot width.Every lot used as permitted in the R-1 residential district or in the R-2 multiple family residential district,shall have a width of not less than thirty feet as measured along the front lot line, as such line is defined in Chapter 16 of this code,and a width of not less than seventy—five feet as measured along the lot setback,as such setback is defined in Chapter 16 of this code,which may be more than the minimum set forth within this chapter.Corner lots shall be at least one hundred twenty feet in width at the front setback line.For trailer courts the minimum lot or space width shall be as provided elsewhere in this code. 17.40.060 Minimum lot width.Every lot shall have a width of not less than thirty feet as measured along the front lot line,as such line is defined in Chapter 16 of this code, and a width of not less than seventy—five feet as measured along the lot setback,as such setback is defined in Chapter 16 of this code,which may be more than the minimum set forth within this chapter.Corner lots shall be at least one hundred twenty feet in width at the front setback line. Section 5.The board of trustees of the town of Estes Park,Colorado,herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety for zoning definitions, permitted uses,dwelling area,lot area per family and minimum lot width affect the public peace,health and safety,and whereas in the opinion of the board of trustees an emergency —5— C exists,this ordinance shall take effect and be in force five (5)days after its final passage,adoption and publi cation.
