AN ORDINANCE AMENDING SECTION 9.46.030
OF THE MUNICIPAL CODE OF THE TOWN OF
ESTES PARK,COLORADO,RELATING TO SOLIC
ITING SALES OF FERMENTED MALT BEVERAGES,
MALT,VINOUS AND SPIRITUOUS LIQUORS.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.Section 9.46.030 of the Municipal Code
of the Town of Estes Park,Colorado,is hereby amended to
read as follows:
9.46.030 Soliciting sales of fermented malt bever
ages,malt,vinous and spirituous liquors.It shall be un
lawful for any person to be employed in,or to frequent or
loiter in,any tavern or place where fermented malt bever
ages or malt,vinous or spirituous liquors are sold,for
the purpose of soliciting a person or persons to purchase
such beverages or liquors,where the person so soliciting
receives a percentage of,or commission based upon,the
sale price of such beverages or liquors sold to the person
or persons solicited.It shall also be unlawful for the
licensee,proprietor or operator of any such establishment
to allow the presence of any such person in his establish
ment for said purpose.
Section 2.The board of trustees of the town of Estes
Park,Colorado,herewith finds,determines and designates that
this ordinance is necessary for the immediate preservation of
the public peace,health and safety,for the control of sales
of fermented malt beverages,malt,vinuous and spirituous
liquors affects the public peace,health and safety;and where
as,in the opinion of the board of trustees,an emergency
exists,this ordinance shall take effect and be in force five
(5)days after its final passage,adoption and publication.
