HomeMy WebLinkAboutORDINANCE 21-740 0 ORDINANCE NO.21 -74 AN ORDINANCE AMENDING CHAPTER 13.12 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK, COLORADO,THE SAME PERTAINING TO THE LIGHT AND POWER RATE SCHEDULES CONTAINING CHARGES FOR THE SERVICE OF ELECTRIC ENERGY BY THE LIGHT AND POWER DEPARTMENT OF THE TOWN OF ESTES PARK,COLORADO. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That Chapter 13.12 of the Municipal Code of the Town of Estes Park,Colorado,be and the same is hereby amended to read as follows: Chapter 13.12 Light and Power Rate Schedules 13.12.010 Generally.The schedules of rates set forth in this chapter for the service of electric energy by the town of Estes Park are fixed and adopted to begin with the billing period beginning after October 1,1974 and shall remain in effect until repealed or amended. 13.12.020 Rate 1--Residential Service.A.Applicability: The rates set forth in this section shall be applicable in Estes Park service territory. B.Availability—-Single Family Basis:This schedule is available to residential consumers for all domestic users in single family private dwellings or individually metered apartments and is not available for resale service. C.Rate: The first 30 kwh per month $2.20 The next 20 kwh per month,per kwh at .073 The next 50 kwh per month,per kwh at .048 The next 200 kwh per month,per kwh at .024 All additional kwh used per month,per kwh at .0185 Minimum —Net minimum charge per meter per month 2.20 D.Availability--Multi-Family Basis:The foregoing rate schedule is also available for multi-family residential use by multiplying the blocks of the rate and the minimum by the following factors: Two units 1.9 Three units 2.7 Four units 3.4 Five units 4.1 More than 5 units, add 0.7 per unit Q 0 E.Payment:The above rates are net.Bills for electric service are due and payable within ten days from date of bill. F.Contract Period and Conditions:All contracts under this schedule shall be for a minimum period of twelve months and thereafter until terminated,where service is no longer required,on three days’written notice. 13.12.030 Rate 2--Combined residential and water heating. A.Applicability:The rates set forth in this section shall be applicable in Estes Park service territory. 3.Availability--Single Family Basis:This schedule is available to residential consumers for all domestic uses in single family private dwellings or individually metered apartments,metered through one meter,where in addition to the use of lighting and household appliances,the consumer installs and uses for all his water heating requirements a solidly connected electric water heater.This schedule is not available for resale service. C.Rate: The first 30 kwh per month $2.20 The next 20 kwh per month,per kwh at .073 The next 50 kwh per month,per kwh at .049 The next 150 kwh per month,per kwh at .024 The next 250 kwh per month,per kwh at .0155 All additional kwh used per month,per kwh at .0185 Minimum —Net minimum charge per meter per month 2 .20 D.Availability--Multi-Family Basis:The foregoing rate schedule is also available for multi—family residential use by niultipyling the blocks of the rate and the minimum by the following factors: Two units 1.9 Three units 2.7 Four units 3.4 Five units 4.1 More than 5 units, add 0.7 per unit E.Payment:The above rates are net.Bills for electric service are due and payable within ten days froni date of bill. F.Contract Period and Conditions:All contracts under this schedule shall be for a minimum period of twelve months and thereafter until terminated where service is no longer required on three days’written notice.This rate is not available to hotels,motels,clubs,hospitals,rest homes or similar uses. This rate shall be applicable only where all of the water heating requirement is provided with automatic storage type water heaters. —2— o.0 Service for water heating may be limited to off-peak hours as determined by the town.The off—peak hours,subject to change at the option of the town,shall not total less than eighteen hours per day. Control equipment for automatically limiting the use of service for water heating to off—peak hours may be furnished by the town for all electric water heating installations but shall be installed by consumer’s electrical contractor at consumer’s expense.All control equipment shall be sealed and controlled by the town. Water heaters shall be oE a two—element storage type approved by the town.Each element shall be noninductive and shall be connected through a separate thermostat.The capacity rating of the lower and upper units shall be twenty and thirty watts per gallon,respectively,to the nearest NEMA Standard.Water heaters of the quick recovery type shall be forty gallons or larger and the capacity rating of each of the lower and upper elements shall not exceed five thousand watts.The upper thermostat and element shall be interconnected with the lower thermostat and element to allow operation of only one element at the same time.The lower, or base,element shall be placed so as to heat the entire tank and the upper,or booster,element shall lie placed so as to heat not more than the upper one—third of the tank. 13.12.040 Rate 3-—All-electric residential service. A.Applicability:The rates set forth in this section shall be applicable in Estes Park service territory. B.Availability--Single Family Basis:This schedule is available through a single meter for residential electric service for all domestic purposes in single family private dwellings or individual apartments where electricity is the sole source of energy for space heating,cooking and water heating.Air conditioning use is permissible under this rate.This schedule is not available for resale service. C.Rate: The first 100 kwh per month $6.20 The next 150 kwh per month,per kwh at .025 The excess kwh per month,per kwh at .0155 Minimum per month 6.20 D.Availability—-Multi-Family Basis:The foregoing rate schedule is also available for ;ulti—fami1y residential use by multiplying the blocks of the rate and the minimum by the following factors: Two units 1.9 Three units 2.7 Four units 3.4 Five units 4.1 More than 5 units, add 0.7 per unit E.Payment:The above rate is net.Bills for electric service are due and payable within ten days from the date of bill. —3— (0 F.Contract Period and Conditions:All contracts under this schedule shall be for a minimum period of twelve months and thereafter until terminated where service is no longer required on three days’written notice. This rate may not be applied to hotels,motels,clubs, hospitals,rest homes or similar uses. Electric space heating units or electrically operated central year—round air conditioning equipment shall be the sole means of heating the dwelling unit.Fireplaces using wood for fuel are the only supplementary heating sources permitted.The electric water heater shall be the exclusive source of hot water. The town shall be advised as to the impending installation of the electric space heating equipment in advance in order to determine if extensions of,or additions to the town’s facilities will be required and to allow arrangements therefor, and to determine the available voltage at the consumer’s installation. Each space heating element over one thousand six hundred fifty watts shall be individually controlled by a thermostat. No single space heating element shall have a rated capacity greater than five kilowatts.No thermostat shall control more than five kilowatts. Water heaters shall be of the two-element storage type approved by the town.Each element shall be noninductive and shall be controlled by a separate thermostat.The capa city rating of the lower and upper units shall be twenty and thirty watts per gallon,respectively,to the nearest NEMA Standard.Water heaters of the quick recovery type shall be forty gallons or larger and the capacity rating of the lower and upper elements shall not exceed five thousand watts each.The upper thermostat and element shall be intercon nected with the lower thermostat and element to permit opera tion of only one element at the same time.The lower,or base,element shall be placed so as to heat the entire tank and the upper,or booster,element shall be placed so as to heat not more than the upper one-third of the tank. 13.12.050 Rate 4—-Commercial lighting-—General. A.Applicability:The rates set forth in this section shall be applicable in Estes Park service territory. B.Availability:This schedule is available for busi ness lighting and small power use including only single-phase motors not exceeding five horsepower in size.All service will be supplied only through a single meter.This schedule is not available for resale service. C.Rate:For all energy used between meter readings taken approximately May 20th to September 20th —- —4— 0 First 22 kwh used per month-$2.40 The next 78 kwh used per month,per kwh at .088 The next 100 kwh used per month,per kwh at .065 The next 800 kwh used per month,per kwh at .056 The next 1500 kwh used per month,per kwh at .041 The next 2500 kwh used per month,per kwh at .030 All additional kwh used per month,per kwh at .0205 For all energy used between meter readings ajproximately September 20th to May 20th —- First 23 kwh used per month $2.40 The next 77 kwh used per rcLonth,per kwh at--.078 The next 100 kwh used per month,per kwh at-.039 The next 800 kwh used per month,per kwh at-.034 The next 2000 kwh used per month,per kwh at .0265 All additional kwh used per month,per kwh at .0205 D.Minimum:Net minimum charge per meter per month $2.40 E.Payment:The above rates are net.Bills for electric service are due and payable within ten days from date of bill. F.Contract Period and Conditions:All contracts under this schedule shall be for a minimum period of twelve months and thereafter until terminated,where service is no longer required,on three days’written notice. The foregoing provisions of this schedule are subject to the definitions,terms and conditions of the GEneral and Business Lighting Schedule Rules and Regulations made a part hereof by reference thereto. Energy supplied for business lighting,incidental power and miscellaneous uses will be approximately sixty cycle, single—phase alternating current,one hundred twenty—volt, two—wire or one hundred twenty/two hundred forty volt, three—wire service.Single—phase motors with “locked—rotor’ values in excess of twenty amperes shall not be used on one hundred twenty-volt service.Single-phase motors in excess of five horsepower shall not be used on two hundred forty volt service. Luminous electric discharge tubes or other equipment of inheriently low power factor characteristics shall,at all times,be provided with effective power factor correc tion such that the power factor of customer’s electric service shall not be less than ninety percent. 13.12.060 Rate 5—-Commercial water heating. A.Applicability:The rates set forth in this section shall be applicable in Estes Park service territory. —5— I.!C 3.Availability:This schedule is available for electric water heating service for corruitercial users where such service may be rendered without additional distribution system investment by the town.This schedule is not available for resale service. C.Rate:All kwh used per month,per kwh at $0.0188 D.Minimum:Net minimum charge per month $1.60 E.Payment:The above rate is net.Bills for electric service are due and payable within ten days from date of bill. F.Contract Period and Conditions:All contracts under this schedule shall be for a minimum period of thirty days and thereafter until terminated,where service is no longer required,on three days’written notice. Water heating equipment shall be connected by a separate circuit enclosed for its entire length in rigid metal conduit or armored cable.No equipment,except approved water heat ers,shall be connected to such circuit.The town will in stall a separate meter to measure the energy used for water heating under this schedule.Service for water heating may be limited to off-peak hours as determined by the town.The off-peak hours,subject to change at the option of the town, shall not total less than eighteen hours per day.Control equipment for automatically limiting the use of service for water heating to off-peak hours may be furnished by the town for all electric water heating installations but shall be installed by consumer’s electrical contractor at consumer’s expense.All control equipment shall be sealed and controlled by the town.Water heaters shall be of a two—element storage type approved by the town.Each element shall be noninduc tive and shall be connected through a separate thermostat. A.Availability:Available throughout the entire territory served by the town of Estes Park for three—phase power service,where available,at the voltage of the town’s existing distribution,for loads aggregating in excess of ten kw.Single—phase power loads may be used from this service.The customer will provide any necessary transformers to adapt the service voltage to customer’s requirements. —6— 0 0 B.Rate Per Month: First 20 kwh per kw of billing demand but not less than 200 kwh,per kwh $.06 Next 40 kwh per kw of billing demand but not less than 400 kwh,per kwh .048 Next 100 kwh per kw of billing demand but not less than 1000 kwh,per kwh .036 All additional kwh,per kwh .03 C.Determination of Billing Demand:The billing de mand,which in no event shall be taken as less than ten kw,nor less than seventy—five percent of the manufacturer’s rating of largest motor connected,shall be determined at the option of the town,by either of the following methods: 1.Connected Load Basis:The following percentages of the total connected load shall determine the billing de mand.For installations of: a.One motor 100% b.Two motors 80% c.Three motors 70% d.Four motors 60% e.Five motors 50% f.Six or more motors 45% Provided that motors of less than one horsepower rating and miscellaneous appliances of less than one thousand watts shall not be counted as motors in the determination of the above percentages but shall be considered as part of the total connected load. 2.Measured Demand Basis:The contract kw shall be taken as the measured demand,determined by suitable meter measurement,but shall in no event be less than thirty percent of the total connected load. D.Minimum: Subject to special provisions of extension policy. The monthly minimum per kw of billing demand $1.20 But not less than 12.00 Subject to special provisions of extension policy. All contracts under this schedule shall be for a minimum period of three months and thereafter until termi nated,where service is no longer required,on thirty days’ notice. E.Power Factor:If the power factor during the time the billing demand is established falls below 90%lagging,adjust ment may be made by increasing the measured demand for each month by 1%for each 1%or major fraction thereof by which the power factor during the billing period is less than 90%lagging. F.Rules and Regulations:The above provisions of this schedule are subject to the definitions,terms and conditions of the general and power service rules and regulations made a part hereof by reference thereto. —7— 0 13.12.080 Rate 7-—Large combined light and power. A.Applicability:The rates set forth in this section shall be applicable in Estes Park service territory. B.Availability:This schedule is available on an op tional basis for supplying all of the electric lighting and power requirements of a consumer through a single meter and not for stand—by or for resale to others.Service under this schedule is available at three—phase at the established voltage of either the town’s primary or secondary distribution system. C.Rate: The first 100 kwh per month per kw of demand,but not less than 10,000 kwh per month per kwh at $.035 The next 100 kwh per month per kw of demand,but not less than 10,000 kwh per month per kwh at .024 The excess kwh used per month,per kwh at .0094 D.Minimum:The minimum charge per meter per month shall be not less than $280.00 per month nor $1.20 per kw of billing demand,whichever shall be the greater. E.Payment:The foregoing rate is net.Bills for electric service are due and payable within ten days from date of bill. F.Contract Period and Conditions:All contracts under this schedule shall be for a minimum period of twelve months and thereafter until terminated where service is no longer required on ten days’written notice. The billing demand shall be determined by suitable meter measurement of the highest fifteen—minute integrated demand occurring during the monthly billing period,provided that it shall be not less than seventy percent of the highest billing demand occurring during the preceding months of June through and including September.The consumer shall be required to properly balance his loads. If the power factor during the time the billing demand is established falls below ninety percent lagging,adjustment may be made by increasing the measured demand for each month by one percent for each one percent or major fraction thereof by which the power factor during the billing period is less than ninety percent lagging. The foregoing schedule shall be net where service is metered at the primary voltage of the distribution system and consumer owns and maintains transformer equipment. Where service is metered under this schedule at secondary voltage,an additional charge shall be made each month of two percent of the bill for service.Where service is taken at the town’s established secondary voltage and the town furnishes the transformers and substations converting to secondary voltage,an additional charge shall be made of two percent of the monthly bill. —8— C 13.12.090 Rate 8-—Electric rates--Urban street lighting. A.Applicability:The rates set forth in this section shall be applicable in corporate limits of Estes Park. B.Availability:Available for municipal Street, park lighting and public buildings. C.Rate:(net) Metered service All kwh used per month,per kwh $0.02 13.12.100 Rate 9-—Reserved.Rate 9 shall be reserved for future filing. 13.12.110 Rate 10-—Reserved.Rate 10 shall be reserved for future filing. Section 2.Except as herein specifically amended, Title 13 and all ordinances or parts of ordinances of the Municipal Code of the Town of Estes Park relative to the Light and Power Department shall be and are hereby designated to remain in full force and effect and are hereby ratified, confirmed and approved. Section 3.The Board of Trustees hereby authorizes the Town Clerk and other officials of the Town to file with the Public Utilities Commission of the State of Colorado such documents and to take such action,including the employment of personnel and the payment therefor,as may be required to obtain the approval of said Public Utilities Commission as may be required under the applicable law,but subject only to such jurisdiction as may exist in the Public Utilities Commission relative to the matters herein stated.The rates and rules and regulations set forth in this Ordinance shall be effective outside the boundaries of the Town of Estes Park upon the first billing for service commencing after October 1,1974,provided approval thereof by the Public Utilities Commission has been theretofore received and said rules,regulations and rates shall be effective within the boundaries of the Town of Estes Park beginning with the service and billing period beginning after said October 1,1974. Section 4.The provisions of this Ordinance are hereby declared to be severable,and if any section,provisions,or part thereof shall be declared unconstitutional or invalid, the remainder of this Ordinance shall continue in full force and effect,it being the legislative intent that this Ordinance would have been adopted even if such unconstitutional or invalid matter had not been included therein.It is further declared that if any provision or part of this Ordinance,or the application thereof to any person or circumstances,is held invalid,the remainder of this Ordinance and the ap plication thereof to other persons shall not be affected thereby. —9— Section 5.All ordinances or parts of ordinances of the Town of Estes Park or sections of the Municipal Code of the Town of Estes Park in conflict with the provisions of this Ordinance are hereby repealed.Provided,however, that Section 13.12 shall be and is hereby specifically repealed as enacted in prior ordinances. Section 6.The Board of Trustees herewith finds, determines and designates that this Ordinance is necessary for the immediate preservation of the public peace,health and safety,for the establishment of light and power rate schedules affects the public peace,health and safety;and whereas,in the opinion of the Board of Trustees,an emer gency exists,this Ordinance shall take effect and be in force five (5)days after its final passage,adoption and publication.
