ORDINANCE NO.25—76
AN ORDINANCE AMENDING CHAPTER 17.66 OF THE MUNICIPAL
CODE OF THE TOWN OF ESTES PARK,COLORADO,RELATING TO
THE REGULATION OF SIGNS.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES
PARK,COLORADO:
Section 1.Section 17.66.090(39)of the Municipal Code of the
Town of Estes Park,Colorado is amended by the addition of the following
sub-subsection:
j.“Vending machine sign”means a sign that is incorporated into
and designed as a part of a vending machine.
Section 2.Section 17.66.190(B)of the Municipal Code of the
Town of Estes Park,Colorado is amended by the addition of the following
sub—subsection:
ii.A sign permit or sign permit fee shall not be required for
vending machine signs.
The signs permitted in subdivisions 1 through 7 and 9 and 11 of
this sub-section shall be permitted in addition to the siuns permitted by
Section 17.66.290 and shall not be counted against the total allowable sign
area or total number of signs permitted for the premises,unless such signs
exceed the limitations specified in subdivisions 1 through 7 and 9 of this
sub-section.
Section 3.Section 17.66.290 (C)of the Municipal Code of the
Town of Estes Park,Colorado is amended by the addition of the letter ‘i”
to the schedule under “Type of Sign Permitted”for the R-1,R,E-l and E-2
Zoning Districts.
Section 4.Section 17.66.300 of the Municipal Code of the Town
of Estes Park,Colorado is amended by the addition of the following sub-section:
10.Vending machine signs.The advertisement upon vending
machine signs shall be limited to the product vended.
Section 5.Section 17.66.100 of the Municipal Code of the Town of
Estes Park,Colorado is amended to read as follows:
17.66.100 Permits.Except as provided in subsection B of Section
17.66.190,it is unlawful to display,erect,relocate or alter any sign without

first filing with the building inspector an application in writing,and ob
taining a sign permit.When a sign permit has been issued by the building
inspector,it is unlawful to change,modify,alter or otherwise deviate from the
terms or conditions of the permit without prior approval of the building inspector.
A written record of such approval shall be entered upon the original permit
application and maintained in the files of the building inspector.
Section 6.Section 17.66.190(B)(10)of the Municipal Code of
the Town of Estes Park,Colorado is amended to read as follows:
10.In addition to the above,no permit shall be required for
text or copy changes on conforming or legal nonconforming signs specifically
designed to permit changes of the text or copy thereof;provided that no
structural changes are made to the sign,and provided that the name of the
business to which the sign belongs is not changed.
Section 7.Section 17.66.050 of the Municipal Code of the Town
of Estes Park,Colorado is amended to read as follows:
17.66.050 Enforcement.
1.The building inspector is authorized and directed to
enforce all provisions of this chapter.He shall appear for and on behalf of
the town in all matters regarding the interpretation and application of this
chapter,and shall resist and oppose any deviations from the provisions of
this chapter.Upon presentation of proper credentials,the building inspector
or his authorized representative may enter at reasonable times any building,
structure or premises in the town to perform any duty imposed upon him by
this chapter.
2.When it is the opinion of the building inspector that a
violation of this chapter exists,except a violation of Section 17.66.100,he
shall issue a written notice to the alleged violator.The order shall specify
those chapter sections of which the individual is allegedly in violation,and
shall state that the individual has a period of thirty days from the date of the
receipt of the notice in which to either correct the alleged violations or in
stitute appeal and/or variance procedures to the zoning board of adjustment.The
Board of Trustees of the Town may grant the individual a period of time greater
than thirty days in which to correct the alleged violation if it reasonably
appears that,due to the nature of the alleged violation,it cannot be corrected
within thirty days.

3.Notices under the provisions of this section shall be served upon
the alleged violator by the building inspector by certified mail,return receipt
requested.If the return receipt is not received by the building inspector

within thirty days from the dateof mailing of the notice,then the building
inspector shall proceed to obtain service of the notice upon the alleged
violator by delivering a true copy thereof to the alleged violator personally,
or in the event the process server is unable,after a reasonable attempt,to
make personal service,then by posting such copy in some conspicuous place on
the premises upon which the alleged violation is located.Service of the
notice,as aforesaid,shall be by the sheriff or by his deputy,of Larimer
County,Colorado,of if service is by personal service upon an alleged violator
at the time residing outside of Larimer County,Colorado,then by a sheriff,
deputy sheriff,constable,deputy constable,bailiff,deputy bailiff or other
officer haivng like powers and duties of the political subdivision in which the
service is made.If the person to be served refuses to accept a copy of the
process,service shall be sufficient if the person serving the same shall
state the name of the process and offer to deliver a copy thereof.
Section 2.Section 17.66.340(A)of the Municipal Code of the Town
of Estes Park,Colorado is hereby repealed.
Section 9.The Board of Trustees of the Town of Estes Park,Colorado,
herewith finds,determines and designates that this ordinance is necessary for
the immediate preservation of the public peace,health and safety,for the regu
lation of zoning affects the public peace,health and safety;and whereas,in
the opinion of the Board of Trustees,an emergency exists,this ordinance shall
take effect and be in force after its final passage,adoption and approval and
signature of the mayor.
