HomeMy WebLinkAboutORDINANCE 13-77ORDINANCE NO.13 —77 AN ORDINANCE AMENDING CHAPTERS 13.24,73.2$and 13.32 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO, RELATING TO METERED WATER SERVICE. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Section 73.24.730 A.of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 13.24.130 Mains --Extension and repair. A.All water main extensions shall be made in conformity with the following provisions: 1.The customer shall pay for the total cost of main extension if the extension is for the customer’s benefit alone and the expansion or extension is not a designated “(A)”item of the water department’s distribution system p]an entitled “A plan for growth of the Estes Park,Colorado water system dated December 26,196$.The minimum size water main shall be six-inch.The material used and the type and method of construction shall be approved by the water superintendent. Section 2.Chapter 73.24 of the Municinal Code of the Town of Estes Park,Colorado,is hereby amended by the addition of Section 73.24.220,as follows: 77.24.220 Notice to users.Billing for water service and any other notices relating to the water utilities shall be effective upon mailing of said billing or notice to the last known address of the water user as shown on the records of the town water department. Section 3.Section 13.28.060 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 13.28.060 Water installations.All water installations,both urban and rural,including a summer service being converted to a winter service,shall include a water meter,a meter pit or other meter location within the residence, yokes and a remote reader.All such installations shall be approved by the water superintendent.All costs related to such water installations shall be charged to the consumer and paid for by the consumer as provided in Chapter 13.32 for the payment of water rent.In the event such charges are not paid when due, the provisions and procedures of Chapter 13.32 pertaininc’to delinciuent water rent shall be applied to such delinquent charges.Meter seals shall not be re moved by anyone other than an employee of the town water department. Section 4.Chapter 13.28 of the MunIcipal Code of the Town of Estes Park,Colorado,is hereby amended by the addition of Section 13.28.070,as follows: 13.28.070 Meters -Test renuired before installation.Each water meter shall be tested either by the direction of the town water department or the man ufacturer,and shall be found to be correct and properly adiusted before I being installed.If the test is made by the manufacturer,a renort of such test result shall be furnished to the town prior to the installation. Section 5.Chapter 13.28 of the Municipal Code of the Town of Estes Park, Colorado,is hereby amended by the addition of Section 13.28.080,as follows: 13.28.080 Meters -Interfering with or by-pass.It is unlawful for any meter user under meter rates as set forth in this code,or for any other person to tamper or interfere with any meter,remote reader or meter seal,or to so arrange his water service or pipinq so that the use of water will not actuate the meter.The Town shall discontinue water service immediately to any user who violates the provisions of this section until satisfactory payment has been made for all water used and all repairs to the meter. Section 6.Chapter 13.28 of the Municipal Code of the Town of Estes Park, Colorado,is hereby amended by the addition of Section 13.28.090,as follows: 13.28.090 Charges when meter fails to register.If any meter shall fail to register in any billing period,the water user shall be charged accordina to the average quantity of water used in a similar period as shown by the meter when in order,and the town water department may prorate any water bill for any such period of time water service is received while not beinq metered. Section 7.Section 13.32.080 of the Municipal Code of the Town of Estes Park,Colorado,is hereby amended to read as follows: 13.32.080 Unpaid water and connection charges a lien.All water and connection charges shall be charged against the owner of the oronerty served and shall be a lien upon the respective lots or parcels of land where the water is used from the time when due and shall he a perpetual charge against the lots or parcels of land until paid,and in the event said charoes shall not be paid when due,for property within town limits,the town clerk shall certify such delinquent charges to the county treasurer and the charoes shall be collected in the same manner as though they were part of the taxes.On all delinquent water and connection charoes,for property outside town limits, there shall be a charge of two-thirds of one oercent per month on the amount due which shall be added to the amount due until paid.In case of condominiums to which water is furnished other than by metering the consumption of every condominium unit,the lien for the unpaid water,interest and costs,if any, imposed by this code shall attach upon such condominium unit in an amount which is computed by dividing the total amount of the lien by the number of condo minium units. —2— V 4N’ ‘S Section 8.The board of trustees of the Town of Estes Park,Colorado, herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety,for the regulation of water service affects the public peace,health and safety;and whereas,in the opinion of the board of trustees,an enierpency exists,this ordinance shall take effect and be in force after its final passaqe,adoption and approval and the signature of the mayor.
