ORDINANCE NO.17-78
AN ORDINANCE APPROVING THE ANNEXATION OF
CERTAIN TERRITORY TO THE TOWN OF ESTES
PARK,COLORADO,TO BE KNOWN AND DESIG
NATED AS “EAST ELKHORN ADDITION”TO THE
TOWN OF ESTES PARK,COLORADO.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF ESTES PARK,COLORADO:
Section 1:That a Petition for Annexation,together
with four (4)copies of the plat of said territory as required
by law,was filed with the Board of Trustees on the 16th
day of May ,1978,by the owners of one hundred per
cent (100%)of the area of the territory hereinafter described.
The Board of Trustees,by Resolution at its regular meeting on
the 13th day of June ,1978,accepted said Peti
tion and found and determined that the applicable parts of The
Municipal Annexation Act of 1965 have been met and further
determined that an election was not required under Section
31-12-107(2)C.R.S.1973,as amended,and further found that
no additional terms and conditions were to be imposed upon said
annexation except those set out on said Petition.
Section 2:That the annexation to the Town of Estes
Park designated as “EAST ELKHOPN ADDITION”to the Town of Estes
Park,is hereby approved:
Property located in Section 25,Township 5 North,
Range 73 West of the 6th P.M.,Larimer County,
Colorado,being more particularly described as
follows:That portion of the following described
property lying Northerly and Easterly of Black
Canyon Creek:Commencing at the Northeast corner
of said Section 25;thence N 00°05’E along the
East line of the SE 1/4 of Section 24,T5N,R73W
of the 6th P.M.a distance of 40.70 feet to a point
on the Northerly right-of-way line of U.S.Highway
34;thence along said right-of—way line S 55°10’30”
W a distance of 1152.39 feet;thence continuing along
said right-of-way line a distance of 120.57 feet along
the arc of a non—tangent curve to the right to the
TRUE POINT OF BEGINNING,said curve has a delta angle
of lO°31’34”,and a radius of 656.30 feet and is sub
tended by a chord which bears S 60°l3’Ol”W a dis
tance of 120.40 feet;thence continuing along said
right-of-way line a distance of 76.23 feet along the
arc of a curve concave to the Northwest,said curve
has a delta angle of 06°39’l7”,a radius of 656.30 feet
and is subtended by a chord which bears S 68°48’25”W
a distance of 76.19 feet;thence continuing along said
right—of-way line S l7°4l’39”E a distance of 29.42
‘0
feet to a point on the Northerly right-of-way line
of Elkhorn Avenue;thence S 72°18’21”W a distance
of 97.84 feet along the Northerly right-of-way line
of Elkhorn Avenue;thence N 17°41’39”W a distance
of 328.97 feet along the East line of that tract
described in Book 1353 at Page 339 of the Larimer
County Records to a point on the boundary of the
Stanley Addition to the Town of Estes Park;thence
the following three courses and distances along the
boundary of said Stanley Addition;thence N 71°54’
E a distance of 257.70 feet;thence S 00037!W a
distance of 227.46 feet;thence S 09°00”E a dis
tance of 81.72 feet to the TRUE POINT OF BEGINNING.
Section 3:The Board of Trustees herewith finds,deter
mines and designates that this Ordinance is necessary for the
immediate preservation of the public peace,health and safety,
in order to provide for the orderly development of said area;
and whereas,in the opinion of the Board of Trustees,an emer
gency exists,this Ordinance shall take effect and be in force
immediately after its passage,adoption and signature of the
mayor.
