HomeMy WebLinkAboutORDINANCE 07-78S ORDINANCE NO.7—78 AN ORDINANCE TO PROVIDE MINIMUM STANDARDS TO SAFEGUARD LIFE OR LIMB,HEALTH,PROPERTY,AND PUBLIC WELFARE BY REGULATING AND CONTROLLING THE DESIGN,CONSTRUCTION,QUALITY OF MATERIALS, USE AND OCCUPANCY,LOCATION AND MAINTENANCE OF ALL BUILDINGS AND STRUCTURES WITHIN THE TOWN OF ESTES PARK,COLORADO,AND CERTAIN EQUIPMENT SPECIFICALLY REGULATED IN SAID CODE;ADOPTING BY REFERENCE THE 1976 EDITION OF THE UNIFORM BUIlDING CODE AND THE APPENDIX THEREOF;RE PEALING ALL ORDINANCES IN CONFLICT THEREWITH; PROVIDING PENALTIES FOR VIOLATION THEREOF;AND AMENDING SECTIONS 14.12.010,14.12.020,14.12.030, 14.12.040,14.12.050,OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Adoption.Pursuant to PART 2 of ARTICLE 16 of TITLE 31,C.R.S.1973,as amended,there is hereby adopted by reference the 1976 Edition of the UNIFORM BUILDING CODE AND THE APPENDIX THEREOF,except the sections or parts of sections thereof as are amended by this Ordinance;issued by the Inter national Conference of Building Officials,5360 South Workman Mill Road,WHITTIER,CALIFORNIA 90601,of which three (3)true copies thereof,duly certified by the Mayor and Clerk of Estes Park,Colorado,and are open to public inspection,and may be inspected during regular business hours,the same being adopted as if set out at length. Section 2.That Section 14.12.010 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 14.12.010 Adoption.The 1976 Edition of the Uniform Building Code and the Appendix thereof,issued by the International Conference of Building Officials,5360 South Workman Mill Road, Whittier,California 90601,except the sections or parts of sections thereof which are amended by Sections 14.12.020, 14.12.030,14.12.050 of the Municipal Code of the Town of Estes Park,Colorado,is enacted,adopted by reference as a secondary code and incorporated herein as if set out in length.Three copies of said code are now filed in the office of the Town Clerk and may be inspected during regular business hours. 0 0 Section 3.That Section 14.12.020 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 14.12.020 Section 302(a)amended --Permit Issuance. The first paragraph of Section 302(a)of the Uniform Building Code,1976 Edition,is amended to read as follows: Section 302(a)Issuance.The application,plans, and specifications filed by an applicant for a permit shall be checked by the Building Official.Such plans may be reviewed by other departments of the town to check compliance with the laws and ordinances under their jurisdiction.If the Building Official is satisfied that the work described in an application for permit and the plans filed therewith conform to the require ments of this Code and other pertinent laws and ordinances; that all provisions of the Ordinances and of the Municipal Code of the Town of Estes Park that pertain to the land,or the use thereof,described in said application have been complied with; and that the fee specified in Section 303 (a)has been paid,he shall issue a permit therefor to the applicant. Section 4.That Section 14.12.030 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 14.12.030 Section 303 (a)and (b)amended --Building permit fees.The first paragraph of Section 303 (a)and second paragraph of Section 303 (b)of the Uniform Building Code,1976 Edition,are amended to read as follows: Section 303 (a).Building Permit Fees.A fee for each building permit shall be paid to the Building Official as hereinafter set forth: 1.Five and one-half cents (5 l/2)per square foot for all one (1)or two (2)family dwellings,including basements located therein,if plumbing and electric lines are roughed in. —2— 0 0 2.Two cents (2)per square foot for all accessory buildings,including private garages and basements, located in one (1)or two (2)family dwellings,if electric services only is roughed in. 3.Definitions.For the purposes of subpara graphs 1 and 2 above,certain words are defined as follows: ACCESSORY BUILDING:A subordinate building or portion of a main building the use of which is incidental to that of the main building. DWELLING:A detached building designed for,or occupied by,one or more families. GARAGE,PRIVATE:A building designed and used for the housing of not more than three motor—propelled vehicles. 4.All other building permit fees shall be as set forth in Table No.3-A. Section 303 (b).Said plan—checking fees for buildings of Group I and J Occupancies shall be one-half of the building permit fees.Plan-checking fees for all other build ings shall be 65 percent of the building permit fees as set forth in Section 303 (a). Section 5.That Section 14.12.040 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 14.12.040 Violation.A.It is unlawful for any person to violate any of the provisions stated or adopted in the Uni form Building Code,1976 Edition. B.Every person convicted of a violation of any provi sion stated or adopted in the Uniform Building Code,1976 Edition, shall be punished as set forth in Section 1.20.020 of this code. Section 6.That Section 14.12.050 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 14.12.050 Section 1716 amended --Guardrails.Section 1716 of the Uniform Building Code,1976 Edition,is amended to read as follows: Section 1716.All unenclosed floor and roof openings; —3— 0 0 open and glazed sides of landings;balconies or porches which are more than 30 inches above grade;and roofs used for other than service of the building,shall be protected by a guardrail. Guardrails shall be not less than 42 inches in height,except that,in Group I,one and two—family occupancies,the guardrails shall be not less than 36 inches in height.Open guardrails and stair railings shall have intermediate rails or an ornamental pattern such that a 9—inch diameter sphere cannot pass through. The height of stair railings may be as specified in Section 3305(j). EXCEPTION:Guardrails need not be provided on the loading side of loading docks. Section 6.Validity.If any part or parts of this Ordinance are for any reason held to be invalid,such decision shall not affect the validity of the remaining portions of this Ordinance. Section 7.Repeal.Existing ordinances or parts of ordinances covering the same matters as embraced in this Ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this Ordinance are hereby repealed,except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Ordinance. Section 8.Effective Date.The Board of Trustees of the Town of Estes Park,Colorado,herewith finds,determines and designates that this Ordinance is necessary for the imme diate preservation of the public peace,health and safety,for the regulation of buildings and structures affects the public peace,health and safety;and whereas,in the opinion of the Board of Trustees,an emergency exists,this Ordinance shall take effect and be in force after its final passage,adoption and the approval and signature of the Mayor. —4— 0 PASSED BY THE BOARD OF TRUSTEES AFTER PUBLIC HEARING THIS _______ DAY OF ___________________, 1978.
