AN ORDINANCE AMENDING SECTIONS 13.24.060,
13.32.010,13.32.020,13.32.040,13.32.080,
13.32.090,13.32.110,13.32.130 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,THE SANE PERTAINING TO WATER RULES,
REGULATIONS,RATES AND CHARGES.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.Section 13.24.060 of the Municipal Code of
the Town of Estes Park,Colorado is amended to read as follows:
13.24.060 Service pipe regulations.No consumer
shall be permitted to conduct water pipes across lots or build
ings to adjoining premises without the permission of the water
superintendent.Water service for a property must be from one
source,either from the town’s water service or a well.Water
service to a portion of developed property shall not be permitted.
Service must include all improvements on the property with no
cross connections with any other water supply.Service pipes
must be laid at least four feet below the surface of the ground.
The town shall not be responsible for the service pipes and fix
tures.All owners at their own expense,must keep service pipes
from the town main and all their apparatus in good working order
and properly protected from frost and other disturbances.No
claim shall be made against the town on account of the breaking
of service pipes or apparatus or for failure in the supply of
water.No reduction in the rates will be made for any time
that service pipes or fixtures may be frozen.
Section 2.Section 13.32.010 of the Municipal Code of
the Town of Estes Park,Colorado is amended to read as follows:
13.32.010 Tapping charge--Water rights fee.The
consumer shall pay the town clerk for each new water tap a fee
which shall be the total sum of the following charges:the
actual cost to the town of the corporation cock,expansion joint,
curb box,tapping saddle,and water meter furnished by the town,
to make such tap,and the following sums for each connection
to the town’s water system:

The size of all connections shall be determined by
the town.If the size of a connection is increased,the con
sumer shall pay the difference between the cost of the existing
connection and the new connection.
In addition to the foregoing water tap fee,the con
sumer shall pay to the town a water rights fee in accordance with
the following schedule:
Single-family dwelling having
forty fixture values or less,$645.00
All other water users,except those
special users provided for below
not less than $645.00 and an addi
tional $16.00 for each roughed-in
or installed fixture value in excess
of forty fixture values,and an
additional $16.00 for each fixture
value roughed—in or installed after
the initial water rights fee has been
paid;
Except those consumers applying for a tap
to be used on property for which there
has been furnished water,or its money
equivalent paid,when the property was
annexed to the town.
In lieu of the above water rights fee,the consumer
may transfer to the town Northern Colorado Water Conservancy Dis
trict water in such amounts as shall be set by resolution of the
board of trustees.
The consumer shall submit sufficient information,
in the form of plans and/or specifications,when an application
for a water tap is made for a new connection,to enable the town
to determine the number or kind of water—using devices or f ix—
tures and the corresponding weight in fixture values in accor
dance with the following table:

At the time additional fixtures are installed,the
consumer shall pay for such additional units at the above rate
of fixture value charges.
Should a consumer install a water—using device that
is not defined above,or should special use of water be required,
the consumer shall submit sufficient information thereon to
enable the town to determine the fixture value weight for such
device or use.
All necessary pipe,fittings,valves,shutoff,
trenching,backfilling and installation of the tap,must be
at the expense of the consumer and under the supervision of the
water superintendent.All water service connections and all
water service extensions,both within and without the town limits,
are subject to special fees as adopted by the board of trustees.
Tapping must be done by a licensed plumber and a standard cor
poration cock and expansion joint,furnished by the town,must
be used.No water service shall be furnished to the consumer
until all tap fees and water rights fees have been paid to the
town clerk.
All property for which a connection fee has been
paid after December 1,1972,as herein provided,must be con
nected to the town’s water system and put into service for the
improvement it is to serve within one year from the date of the
payment of such fee.All property for which a water connection

fee has been paid after January 20,1966,but before December
1,1972,must be connected to the town’s water system and put
into service for the improvement it is to serve within ten years
from the date of the payment of such fee.All property for
which a connection fee has been paid prior to January 20,1966,
must be connected to the town’s water system and put into ser
vice for the improvement it is to service prior to January 20,
1986.After the expiration of the applicable provided connection
dates provided in this section,a new application for water ser
vices must be made and another connection fee paid at the rate
then prevailing for such fees before water service will be fur
nished to the property for which the application pertains.
“Water tap,”as used in this chapter,means the
physical connection to a town water main so as to let out or
draw water therefrom to furnish water service to a consumer.
In addition to the foregoing charges,the consumer
shall pay to the town any charges the town has agreed to collect
for property to be served by the water main to which the con
sumer’s service line is to be connected.
Section 3.Section 13.32.020 of the Municipal Code of
the Town of Estes Park,Colorado is amended to read as follows:
Section 13.32.020 Additional services or fixtures.
Should the owner or occupant of the premises desire additional
service or fixtures,or to apply the water for a purpose not
stated at the time of the original application,permission must
be obtained therefor.When additional fixtures are added and
permission therefor has not been obtained,such person shall be
charged a water rate at double the regular rate charged,the
water rights fee of sixteen dollars for each fixture value added
without permission,and a five dollar penalty for such violation.
All of such charges are to be added on to and collected with the
water bill.
Section 4.Section 13.32.040 of the Municipal Code of
the Town of Estes Park,Colorado,is amended to read as follows:

13.32.040 Discontinuance of service.Any person
who desires to discontinue the use of water shall file written
notice with the finance officer and pay all current and back
charges for water used.
Section 5.Section 13.32.080 of the Municipal Code of
the Town of Estes Park,Colorado is amended to read as follows:
13.32.080 Unpaid water and connection charges a
lien.All water and connection charges shall be charged against
the owner of the property served and shall be a lien upon the
respective lots or parcels of land where the water is used from
the time when due and shall be a perpetual charge against the
lots or parcels of land until paid,and in the event said
charges shall not be paid when due,for property within town
limits,the town clerk shall certify such delinquent charges to
the county treasurer and the charges shall be collected in the
same manner as though they were part of the taxes.On all
delinquent water and connection charges,for property outside
the town limits,there shall be a charge of one and one—half
percent per month on the amount due,which shall be added to the
amount due until paid.In the case of condominiums to which
water is furnished,the consumption of every condominium unit,
the lien for the unpaid water,interest and costs,if any,im
posed by this code shall attach upon such condominium unit in
an amount which is computed by dividing the total amount of the
lien by the number of condominium units.
Section 6.Section 13.32.090 of the Municipal Code of
the Town of Estes Park,Colorado,is amended to read as follows:
13.32.090 Schedule of water rates and rate pro
ration.There shall be no reduction in rates or charges or any
rebates thereof for use for less than a two-month period;except
the rates charged consumers making new connections to the town’s
water system,which rates shall be prorated on the basis of the
number of days remaining in the two month billing period in
which the new connection is made.

Section 7.Section 13.32.110 of the Municipal Code of
the Town of Estes Park,Colorado,is amended effective June 1,
1972,to read as follows:
Section 13.32.110 Urban gravity and pumped-flow
water rate.A•Applicability.This schedule is applica
ble for water service to consumers within the town limits.
B.Availability.This schedule is available
for single-family and multifamily residential,commercial,
business,industrial,professional and service establishments,
hotels,motels,hospitals,nursing homes,beauty salons,schools,
churches,government facilities,swimming pools and all similar
uses.
C.Rates.Minimum charge for up to 5,000
gallons of water used in each two month billing period is $12.26.
Additional charge for each 1,000 gallons over the first 5,000
gallons used in each two month billing period is $.968.
D.Payment.Bills for water service will be
rendered by the town to each water customer on or about August 1
for the months of June and July and every two months thereafter.
All bills shall be due and payable within ten days from the
date of the bill.Bills shall become delinquent thirty days
from the date of the bill.
E.Contract Period and Conditions.Service
under this schedule shall be for a minimum period of twelve
months and,thereafter,until terminated.Notice of a request
to terminate water service must be given by ten days written
notice prior to the end of each annual term.
Service under the foregoing schedule is subject to
this code,ordinances of the town,and rules and regulations
of the water department.
F.Minimum Rate.A minimum rate of one-half
the metered minimum bill shall be charged for all property within
the town limits which is connected to the town’s water system

to which no water has been supplied.When property is discon
nected from the town’s water system,the tapping charge and
water riahts fee provided for in Section 13.32.010 shall be
paid to the town clerk as a reconnection fee before water service
is restored to the property.
G.Additional Pumped-flow Rates:In addition
to the above rates,all consumers within the town limits who are
connected to a town—owned and town—maintained pumped—flow water
system shall lie charged the following additional sums:a minimum
charge of $5.63 each two month billing period plus $0.055 per one
thousand gallons of water used in excess of the minimum usages
provided for in subsection C of this section.
Section 8.Section 13.32.130 of the Municipal Code of
the Town of Estes Park,Colorado is amended effective on June 1,
1978,to read as follows:
13.32.130 Rural gravity and pumped-flow water rates
schedule.A.Applicability.This schedule is applica
ble for water service to consumers outside the town limits.
B.Availability.This schedule is available
for single-family and multifamily residential,business,indus
trial,professional and service establishments,hotels,motels,
hospitals,nursing homes,beauty salons,schools,churches,
government facilities,swimming pools and all similar uses.This
schedule must be used by all consumers outside the town limits
who receive water from a town—owned and town—maintained pumped—
flow water system.
C.Rates.Minimum charge for up to 5,000
gallons of water used each two month billing period is $19.86.
Additional charge for each 1,000 gallons over the first 5,000
gallons used in each two month billing period is $l.569.

D.Payment.Bills for water service will be

Section 9.The Board of Trustees of the Town of Estes
Park,Colorado,herewith finds,determines and designates that
this Ordinance is necessary for the immediate preservation of

the public peace,health and safety for the regulation of water
use and the rates for water affect the public peace,health and
safety;and whereas,in the opinion of the Board of Trustees,
an emergency exists,this Ordinance shall take effect and be in
force after its final passage,adoption and the approval and
signature of the Mayor.
