BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Sections 13.12.020 C,13.12.030 C, 13.12.040 C,13.12.050 C and D,13.12.060 C and D,13.12.070 B and D,13.12.080 C and D,and 13.12.090 C of the Municipal Code of the Town of Estes Park,Colorado are amended to read as follows: 13.12.020 C.Rate: The first 30 KWH per month $2.74 The next 20 KWH per month, per KWH at .09096 The next 50 KWH per month, per KWH at .06396 The next 200 KWH per month, per KWH at .03896 All additional KWH used per month,per KWH at .03316 Minimum —Net minimum charge per meter per month $2.74 13.12.030 C.Rate: The first 30 KWH per month $2.74 The next 20 KWH per month, per KWH at .09096 The next 50 KWH per month, per KWH at .06496 The next 150 KWH per month, per KWH at .03896 The next 250 KWH per month, per KWH at .02996 .0 0 All additional KWH used per month,per KWH at .03316 Minimum —Net minimum charge per meter per month $2.74 13.12.040 C.Rate: The first 100 KWH per month $7.91 The next 150 KWH per month, per KWH at .03996 The excess KWH per month, per KWH at .02996 Minimum per month $7.91 13.12.050 C.Rate:For all energy used between meter readings taken approximately between May 20th and September 20th, the rate shall be: First 22 KWH used per month $2.85 The next 78 KWH used per month,per KWH at .10696 The next 100 KWH used per month,per KWH at .08196 The next 800 KWH used per month,per KWH at .07296 The next 1500 KWH used per month,per KWH at .05696 The next 2500 KWH used per month,per KWH at .04496 All additional KWH used per month,per KWH at .03526 For all energy used between meter readings taken approximately between September 20th and May 20th,the rate shall be: First 23 KWH used per month $2.85 The next 77 KWH used per month,per KWH at .09596 The next 100 KWH used per month,per KWH at .05496 The next 800 KWH used per month,per KWH at .04996 The next 2000 KWH used per month,per KWH at .04196 —2— 0 All additional KWH used per month,per KWH at .03526 D.Minimum: Net minimum charge per meter, per month $2.85 13.12.060 C.Rate: All KWH used per month, per KWH at $.03346 D.Minimum: Net minimum charge per month $2.84 13.12.070 B Rate per month: First 20 KWH per KW of billing demand,but not less than 200 KWH,per KWH $.07696 Next 40 KWH per KW of billing demand,but not less than 400 KWH,per KWH .06396 Next 100 KWH per KW of billing demand,but not less than 100 KWH,per KWH .05196 All additional KWH,per KWH .04536 D.Minimum: The following minimum rates are subject to the special provisions of the extention policy: The monthly minimum per KW of billing demand $1.27 But not less than $12.70 All rates and contracts shall be subject to all special provisions of the extension policy. All contracts under this schedule shall be for a mini mum period of three months and thereafter shall be terminated, where service is no longer required,on thirty (30)days notice. 13.12.080 C.Rate: The first 100 KWH per month per KW of demand,but not less than 10,000 KWH per month,per KWH at $.05096 The next 100 KWH per month per KW of demand,but not less than 10,000 KWH per month,per KWH at .03896 —3— 0 The excess KWH per month, per KWH at .02352 B.Minimum:The minimum charge per meter per month shall not be less than $296.00 per month nor less than $1.27 per KW of billing demand,whichever shall be the greater. 13.12.090 C Rate:(net) Metered Service All KWH used per month,per KWH $.03496 Section 2.Except as herein specifically amended, Title 13 and all ordinances or parts of ordinances of the Muni cipal Code of the Town of Estes Park relative to the Light and Power Department shall be and hereby are designated to remain in full force and effect and are hereby ratified, confirmed and approved. Section 3.The Board of Trustees hereby authorizes the Town Clerk and other officials of the Town to file with the Public Utilities Commission of the State of Colorado such docu ments and to take such action,including the employment of per sonnel and the payment therefor,as may be necessary to obtain the approval of said Public Utilities Commission as may be re quired under applicable law for changes in rates for electric service,but subject only to such jurisdiction as may exist in the Public Utilities Commission relative to electric service provided outside the municipal boundaries of the Town. Section 4.The Board of Trustees of the Town of Estes Park,Colorado,herewith finds,determines and desig nates that this Ordinance is necessary for the immediate preservation of the public peace,health and safety,for reliable electric service affects the public peace,health and safety;and the changes in electric rates authorized herein are necessary to maintain reliable electric service and preserve —4— 0 the financial and operating integrity of the municipal electric system;and whereas,in the opinion of the Board of Trustees,an emergency exists,this Ordinance shall take effect and be in force as of the first electric billing period commencing after January 9,1979,or as of the first billing period commencing after the final approval of the rates set forth in this Ordinance relative to the service provided outside the municipal boundaries of the Town is obtained from the Public Utilities Commission of the State of Colorado,whichever date is the later to occur,and after its final passage,adoption and the signature of the Mayor.
