ORDINANCE NO.28 -78
AN ORDINANCE AMENDING SECTIONS 17.08.040,
17.08.190,17.32.030 AND ADDING SECTIONS
17.08.320,17.08.330,17.08.340 OF THE
MUNICIPAL CODE OF THE TOWN OF ESTES PARK,
COLORADO,THE SAME PERTAINING TO ZONING.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN
OF ESTES PARK,COLORADO:
Section 1.That Section 17.08.040 of the Municipal
Code of the Town of Estes Park,Colorado,is amended as
follows:
17.08.040 Building.“Building”means any struc
ture used or intended for supporting or sheltering any use or
occupancy.
Section 2.That Section 17.08.190 of the Municipal
Code of the Town of Estes Park,Colorado,is amended as
follows:
17.08.190 Structure.“Structure”means that
which is built or constructed,an edifice or building of any
kind,or any piece of work artificially built up or composed
of parts joined together in some definite manner.
Section 3.That Section 17.32.030 of the Municipal
Code of the Town of Estes Park,Colorado,is amended as
follows:
17.32.030 Setbacks.A horizontal setback of eight
feet from all property lines that are common with public street
lines and a vertical setback of ten feet from all sidewalks shall
be required,for sidewalk purposes.A setback of eight feet
shall be required from all river banks and river walls,as they
exist and are established at the time of the passage of the
ordinance codified in this title.
All measurements shall commence at the riverside of
any river bank or river wall.
Section 4.That Chapter 17.08 of the Municipal Code of
the Town of Estes Park,Colorado,is amended by adding the
following sections:
Section 17.08.320 Setback.“Setback”means the
distance which any structures are required to be set back from
the property line of any property.The only structures permitted
within the required setback are retaining walls,traffic control
devices,driveways,projecting signs,and architectural projec
tions;provided,however,that such structures do not interfere
with the free flow of pedestrian traffic on required sidewalks;
and provided further that no structures are permitted within or
above the required setback from river banks and river walls.
Section 17.08.330 Architectural Projection.
“Architectural Projection”means roof overhangs,mansards,un
enclosed exterior balconies,marquees,canopies,pilasters and
fascias,but not including signs.
Section 17.08.340 Retaining Wall.“Retaining Wall”
means a wall designed to resist the lateral displacement of soil
or other materials.
Section 5.The Board of Trustees of the Town of Estes
Park,Colorado,herewith finds,determines and designates that
this Ordinance is necessary for the immediate preservation of the
public peace,health and safety for zoning affects the public
peace,health and safety;and whereas,in the opinion of the Board
of Trustees,an emergency exists,this Ordinance shall take effect
and be in force after its final passage,adoption and the approval
and signature of the Mayor.

14th DAY OF November ,1978.
I hereby certify and attest that the above Ordinance was
introduced and read at a regular meeting of the Board of Trustees
on the 14th day of November ,1978,and published in a
newspaper of general circulation in the Town of Estes Park,
Colorado,on the 17th day of November ,1978,all as
required by the statutes of the State of Colorado.
