ORDINANCE NO.5 -79 AN ORDINANCE AMENDING CHAPTER 17 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COLORADO,THE SAME PERTAINING TO MOBILE HOME PARKS BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.That Section 17.08.200 of the Municipal Code of the Town of Estes Park,Colorado,is hereby deleted. Section 2.That Chapter 17.28 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 17.28.010 Boundaries.The boundaries of the R—3 mobile home district shall be as set forth in this section.Included in the R—3 mobile home park district shall be the following described lands:all the lands included in Lots 1,6,7,l6A and 163 of the Sunny Acres Addition. 17.28.020 Permitted Uses.No building or premises shall be used,and no building shall be hereafter erected or structurally altered,unless otherwise provided herein,except for one or more of the following uses: 1.Any use permitted by right in the R—l residential district; 2.Any use permitted by right in the R—2 multiple family residential district; 3.Uses permitted by special review:nursing homes, carillons,and electronic instruments imitating a carillon,and mobile home parks. 17.28.030 Yards.For every building used as permitted in the R—l residential district,or in the R—2 multiple family district,the yard requirements for such buildings shall be the same as provided in these districts. 17.28.040 Lot area per family.For every use permitted in the R—l residential district,the lot area per family shall be the same as lot areas per family required in the R—l residential district.For every use permitted in the R—2 residential district,the lot area per family shall be the same as lot areas per family required in the R—2 residential district. 17.28.050 Minimum 1t width.Every lot used as permitted in the R—l residential district or in the R—2 multiple— family residential district shall have a width of not less than thirty feet as measured along the front lot line,as such line is defined in Chapter 16.08 of this code,and a width of not less than seventy—five feet as measured along the lot setback,as such setback is defined in Chapter 16.08 of this code,which may be more than the minimum set forth within this chapter.Corner lots shall be at least one hundred twenty feet in width at the front setback line.The minimum mobile home lot size and frontage shall be as provided in Section 17.28.090 10.of this Code. 17.28.060 Definitions.For the purposes of this Chapter, the following terms are hereby defined as follow: 1.Mobile Home —A structure,transportable in one or more sections which is built on a permanent chassis and is designed to be used with or without a permanent foundation when connected to the required facilities,not including recreational vehicles or travel trailers. © 2.Mobile Home Lot —A parcel of land for the placement of a single mobile hone and the exclusive use of its occupants. 3.Mobile Home Park —A single parcel of land which has been planned and approved for the placement of mobile homes for nontransient use. 4.Mobile Hone Stand —That part of an individual lot which has been reserved for the placement of the mobile home, appurtenant structures or additions. 5.Service Building —A structure housing toilet, lavatory and such other facilities as may be required by this Chapter. 6.Recreational Vehicle or Travel Trailer.A structure designed for use as a temporary dwelling or sleeping accomodation for travel,recreation and vacation uses,including but not by way of limitation,travel trailers,self—contained travel trailers,pick—up campers,tent trailers and motorized homes. 17.28.070 Administration and Enforcement. 1.Special Review Provisions.All applications for mobile home parks shall be administered in accordance with the provisions of Chapter 17.56 of the Code relating to uses permitted by special review,except where said chapter is amended,modified, extended or otherwise altered by the provisions of this chapter. 2.Effective Date.The provisions of this title shall apply to all mobile home parks constructed,established,altered or extended after the effective date hereof. 17.28.080 Applications. 1.Application Requirements.All applications for construction,establishment or alteration of mobile home parks within the Town of Estes Park shall be made in writing to the Town Clerk and shall contain the following information and conform to the following requirements: a.Name and address of the applicant. b.Designation of all persons having an interest in the mobile home park and a description of said interest. c.Location and legal description of the mobile home park. d.A special review site plan conforming to the requirements of Section 17.56.030 of the Code and including in addition to the requirements of said Section,the following: i.The number,location and size of all mobile home lots; ii.The location,width and proposed uses of all roadways and walkways; iii.The location of service buildings; iv.The location and description of all water and sewage systems; v.The location and description of all lighting and electrical systems; vi.The location and description of a drainage system. vii.The location,size and description of all recreation areas. viii.All other information necessary for the Planning Commission to determine whether or not said application —2— conforms to all requirements of this chapter or any other applicable provision of the Code. 2.Application Fee.All persons filing applications as herein provided shall be charged a fee of $25.00. 17.28.090 Mobile Home Park Requirements. 1.General Requirements.Condition of the soil, groundwater level,drainage and topography shall not create hazards to the property or the health or safety of the occupants. The site shall not be exposed to objectionable smoke,noise,odors or other adverse influences,and no portion subject to unpredictable and/or sudden flooding,subsidence or erosion shall be used for any purpose which would expose persons or property to hazards.All streets within the mobile home parks shall be private streets and shall be maintained by the owners of the mobile home park. 2.Soil and ground cover requirements.Exposed ground surfaces in all parts of every mobile home park shall be paved,or covered with stone screenings or other solid material,or protected with a vegetative growth that is capable of preventing soil erosion and of eliminating objectionable dust. 3.Site drainage requirements.The ground surface in all parts of every mobile home park shall be graded and equipped to drain all surface water in a safe,efficient manner. 4.Park areas for nonresident uses. a.No part of any park shall be used for nonresidential purposes,except such uses that are required for the direct servicing and well—being of park residents and for the management and maintenance of the park. b.Nothing contained in this section shall be deemed as prohibiting the sale of a mobile home located on a mobile home stand and connected to the pertinent utilities. 5.Required recreation areas. a.In all parks there shall be one (1)or more recreation areas which shall be easily accessible to all park residents. b.The size of such recreation areas shall be based upon a minimum of one hundred (100)square feet for each mobile home lot.No outdoor recreation area shall contain less than two thousand five hundred (2,500)square feet. c.Recreation areas shall be so located as to be free of traffic hazards and should,where the topography permits, be centrally located. 6.Park street system. a.General requirements.All mobile home parks shall be provided with safe and convenient vehicular access from abutting public streets or roads to each mobile home lot.Align ment and gradient shall be properly adapted to topography and shall provide good drainage. b.Access.Access to mobile home parks shall be designed to minimize congestion and hazards at the entrance or exit and allow free movement of traffic on adjacent streets.The entrance road connecting the park streets with a public street or road shall have a minimum road pavement width of thirty—four (34) feet where parking is permitted on both sides,or a minimum road pavement width of twenty—seven (27)feet where parking is limited to one (1)side. c.Internal streets.Surfaced roadways shall be —3— of adequate width to accomodate anticipated traffic,and in any case shall meet the following minimum requirements: i.All streets,except minor streets,34 feet. ii.All minor streets,where no parking is allowed on both sides of the street,twenty (20)feet;where no parking is allowed on one side of the street,twenty—seven (27) feet.(Acceptable only if less than five hundred (500)feet long and serving fewer than twenty—five (25)mobile homes,or of any length if one—way and providing access to abutting mobile home lots on one (1)side only.) iv.Dead—end streets shall be limited in length to five hundred (500)feet and shall be provided at the closed end with a turnaround having an outside paved roadway diameter of at least ninety (90)feet. d.Required illumination of park street systems.All parks shall be furnished with lighting units so spaced and equipped with luminaires placed at such mounting heights as will provide illumination for the safe movement of pedestrians and vehicles. e.Street construction and design standards. i.Pavement.All streets shall be provided with a smooth,hard and dense surface (asphaltic concrete or portland cement concrete)which shall be durable and well—drained under normal use and weather conditions.Pavement edges shall be protected to prevent raveling of the wearing surface and shifting of the pavement base.Street surfaces shall be maintained free of cracks,holes and other hazards. ii.Design Standards.Design standards for all streets shall meet the requirements of Chapter 16.16 of the Code. 7.Walks. General requirements.All parks shall be provided with safe,convenient,all—season pedestrian accesses of adequate width for intended use,durable and convenient to maintain,between individual mobile homes,the park streets and all community facilities provided for park residents. 8.Mobile Home Stands.The area of the mobile home stand shall be improved to provide an adequate foundation for the placement and tie—down of the mobile home,thereby securing the superstructure against uplift,sliding,rotation and overturning. a.The mobile home stand shall not heave,shift or settle unevenly under the weight of the mobile home due to frost action,inadequate drainage,vibration or other forces acting on the superstructure. b.The mobile home stand shall be provided with anchors and tie—downs such as cast—in—place concrete “dead men” eyelets imbedded in concrete foundations or runways,screw augers, arrowhead anchors or other devices securing the stability of the mobile home. c.Anchors and tie—downs shall be placed at least at each corner of the mobile home stand,and each shall be able to sustain a minimum tensile strength of two thousand eight hundred (2,800)pounds. d.All mobile home parks or mobile homes located in the Area of Special Flood Hazard shall meet the requirements of the flood plain regulations as described elsewhere in this Code. e.All mobile home stands shall be visibly numbered. 9.Maximum Density.There shall be allowed only seven (7)mobile home lots per each acre of the mobile home park.In determining the acreage of each mobile home park,all property included within the outer boundaries of said mobile home park —4— 0 shall be used,including but not limited to roads,walkways, recreational areas,landscaping areas and parking areas. 10.Minimum lot size.Each mobile home lot shall contain at least 4500 square feet,not including street areas,and shall have a minimum of a twenty—five (25)foot street frontage. 11.Setbacks.Each mobile home shall be set back from each mobile home lot line the following minimum requirements: a.Front yard minimum 10 feet; b.Side yard minimum 5 feet; c.Rear yard minimum 20 feet. 12.Utility lines.All utility lines shall be underground. 13.Screening.All mobile home parks shall be screened from adjacent property with trees,shrubs,other planting arrangements,and/or walls designed to provide noise and sight buffers.Such screening shall be at least six feet in height, provided such screening shall be less than three and one—half feet in height when located within 100 feet of the center line intersection of two streets or roads,and provided that trees and shrubs used may be of a type capable of attaining the minimum height requirement within five years. 14.Utility easements.Utility easements shall be provided for as required by the Town. 15.Occupation.All mobile homes shall be occupied as only one dwelling unit.For the purposes of this chapter,one dwelling unit shall consist of one or more rooms and a single kitchen designed for or occupied as a unit by one person,persons or family,for living and cooking purposes. 16.HUD Seal.All mobile homes in a mobile home park shall contain the United States Department of Housing and Urban Development seal or substantially conform to the requirements necessary to obtain said seal if said mobile home was constructed prior to the adoption of said seal. 17.Recreational Vehicles or Travel Trailers.No recreational vehicles or travel trailers shall be used as residences in a mobile home park. 18.Restrictions on Occupancy.A mobile home shall not be occupied for dwelling purposes unless said home is properly placed on a mobile home stand and connected to water,sewage and electrical utilities. 19.Commercial Use Prohibited.No mobile homes shall be used as a store,office or as a place for the carrying on of a business,trade or profession. 17.28.100 Service Facilities Requirements. 1.General.The requirements of this section shall apply to service buildings,recreation buildings and other community service facilities such as: a.Management offices,repair shops and storage areas. b.Sanitary facilities. c.Laundry facilities. d.Indoor recreation areas. e.Commercial uses supplying essential goods or services for the exclusive use of park occupants. —5— 2.Required community sanitary facilities.Every park shall be provided with the following emergency sanitary facilities:for each one hundred (100)mobile home lots or fractional part thereof,there shall be one (1)flush toilet and one (1)lavatory for each sex.The building containing such emergency sanitary facilities shall be accessible to all mobile homes. 3.Structural requirements for buildings.All buildings constructed upon mobile home parks in the Town of Estes Park shall conform with the requirements of the Building Code of the Town of Estes Park. 17.28.100 Nonconforming Placement or Occupation.No mobile home shall be placed or occupied within the Town,except in a mobile home park complying with the provisions of this chapter. Any mobile home parks or mobile homes in existence within the Town at the time of the enactment of this ordinance shall be governed by the provisions of Chapter 17.68 of this Code. Section 3.That Section 17.12.010 of the Municipal Code of the Town of Estes Park,Colorado,is amended to read as follows: 17.12.010 Designated.In order to regulate and restrict the location of trades,callings,industries,and other uses,and the location of buildings designed,erected,altered or occupied for specific purposes,the percentage of lot that may be occupied, the size of yard,courts and other spaces,and to regulate and limit the density of population,The town of Estes Park is divided in the following zoning districts: R residential district; R—l residential district; R—2 multiple family residential district; R—3 mobile home park district; C—l commercial district; C—2 restricted commercial district; 1—1 restricted industrial district; E—l estate district;and E—2 estate district;and DR developing resource district. Section 4.The board of trustees of the town of Estes Park,Colorado,herewith finds,determines and designates that this ordinance is necessary for the immediate preservation of the public peace,health and safety;for special review procedure effect the public peace,health and safety;and whereas,in the opinion of the board of trustees,an emergency exists,this ordinance shall take effect and be in force after its final passage,adoption and the approval and signature of the mayor.
