AN ORDINANCE AMENDING SECTIONS 13.08.050 B, 13.12.020 C,13.12.030 C,13.12.040 C, 13.12.050 C and D,13.12.060 C and ID, 13.12.070 B and ID,13.12.080 C and ID, AND 13.12.090 C OF THE MUNICIPAL CODE OF THE TOtTN OF ESTES PARK,COLORADO,RELATING TO INTEREST PAID ON DEPOSITS FOR ELECTRIC SERVICE AND TO LIGHT AND POWER RATE SCHEDULES CONTAINING CHARGES FOR THE SERVICE OF ELECTRIC POWER AND ENERGY BY THE LIGHT AND POWER DEPART MENT OF THE TOWN OF ESTES PARK,COLORADO. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.Section 13.08.050 B of the Municipal Code of the Town of Estes Park,Colorado is amended to read as follows: 13.08.050 B.Service Deposits:The department may, at any time,require that the user maintain a deposit with the department of a sum not exceeding an estimated ninety days’bill or a satisfactory guarantee of the payment be made for service for a like period.Such deposits will not be considered as advance payment for service bills and will be applied as credits to users’ accounts only after service has been discontinued.The deposit may be in addition to any advance,contribution, or guarantee in connection with construction of any lines or facilities as provided for in the department’s line extension policies.In the event any person is in arrears to the department for electric service,satisfactory arrangements must be made for paying for the old accounts in full before any application for new service will be approved. The department may return deposits at any time and will return such deposits upon discontinuance of the service after withholding therefrom payment for unpaid charges or bills for service.Deposits will be returned only after the department has determined that sufficient evidence exists that the user is entitled to the return of the deposit. The interest rate applied to deposits,the calcula tion of interest and the distribution of interest on deposits shall be made in accordance with the applicable rule governing customer deposits as promulgated by the Public Utilities Commission of the State of Colorado, as may be amendedor modified from time to time.The superintendent of the department is hereby authorized to file the required tariffs with the Public Utilities Commission,as required under the applicable Commission rules and regulations,setting forth the interest rate to be applied to deposits,the calculation of interest and the distribution of interest earned on customer deposits. 0 0 Section 2.Sections 13.12.020 C,13.12.030 C, 13.12.040 C,13.12.050 C and D,13.12.060 C and D,13.12.070 B and ID,13.12.080 C and ID,and 13.12.090 C of the Municipal Code of the Town of Estes Park,Colorado are amended to read as follows: 13.12.020 C.Rate: The first 30 KWH per month $2.76 The next 20 KWH per month, per KWH at .09147 The next 50 KWH per month, per KWH at .06447 The next 200 KWH per month, per KWH at .03947 All additional KWH used per month,per KWH at .03367 Minimum -Net minimum charge per meter per month $2.76 13.12.030 C.Rate: The first 30 KWH per month $2.76 The next 20 KWH per month, per KWH at .09147 The next 50 KWH per month, per KWH at .06547 The next 150 KWH per month, per KWH at .03947 The next 250 KWH per month, per KWH at .03047 All additional KWH used per month,per KWH at .03367 Minimum -Net minimum charge per meter per month $2.76 13.12.040 C.Rate: The first 100 KWH per month $7.96 The next 150 KWH per month, per KWH at .04047 The excess KWH per month, per KWH at .03047 Minimum per month $7.96 —2— 0 13.12.050 C.Rate:For all energy used between meter readings taken approximately between 1ay 20th and September 20th, the rate shall be: First 22 KWH used per month $2.86 The next 78 KWH used per month,per KWH at .10747 The next 100 KWH used per month,per KWH at .08247 The next 800 KWH used per month,per KWH at .07347 The next 1500 KWH used per month,per KWH at .05747 The next 2500 KWH used per month,per KWH at .04547 All additional KWH used per month,per KWH at .03577 For all energy used between meter readings taken approximately between September 20th and May 20th,the rate shall be: First 23 KWH used per month $2.86 The next 77 KWH used per month,per KWH at .09647 The next 100 KWH used per month,per KWH at .05547 The next 800 KWH used per month,per KWH at .05047 The next 2000 KWH used per month,per KWH at .04247 All additional KWH used per month,per KWH at .03577 D.Minimum: Net minimum charge per meter, per month $2.86 13.12.060 C.Rate: All KWH used per month, per KWH at .03397 D.Minimum: Net minimum charge per month $2.88 —3— 0 0 Section 3.Except as herein specifically amended, Title 13 and all ordinances or parts of ordinances of the Muni cipal Code of the Town of Estes Park relative to the Light and Power Department shall be and hereby are designated to remain in full force and effect and are hereby ratified, confirmed and approved. Section 4.The Board of Trustees hereby authorizes the Town Clerk and other officials of the Town to file with the Public Utilities Commission of the State of Colorado such docu ments and to take such action,including the employment of per sonnel and the payment therefor,as maybe necessary to obtain the approval of said Public Utilities Commission as may be re quired under applicable law for changes in rates for electric service,but subject only to such jurisdiction as may exist in the Public Utilities Commission relative to electric service provided outside the municipal boundaries of the Town. Section 5.The Board of Trustees of the Town of Estes Park,Colorado,herewith finds,determines and desig nates that this Ordinance is necessar for the immediate preservation of the public peace,health and safety,for reliable electric service affects the public peace,health and safety;and the changes in electric rates authorized herein are necessary to maintain reliable electric service and preserve the financial and operating integrity of the municipal electric system;and whereas,in the opinion of the Board of Trustees,an emergency exists,this Ordinance shall take effect and be in force as of the first electric billing period commencing after January 7,1980,or as of the first billing period commencing after the final approval of the rates set forth in this Ordinance relative to the service provided outside the municipal boundaries of the —5— C Town is obtained from the Public Utilities Commission of the State of Colorado,whichever date is the later to occur,and after its final passage,adoption and the signature of the Mayor.
